amending and supplementing Act No. 94 / 1963 Coll., on Family, as amended by Act No. 132 / 1982 Coll.
The Federal Assembly of the Czech and Slovak Federal Republic decided on this law:
Act No. 94 / 1963 Coll., on Family, as amended by Act No. 132 / 1982 Coll., is amended as follows:
1.
The marriage is concluded by a statement by a man and woman in agreement before a state body or before a church or religious society (hereinafter referred to as the "church body") that they are entering into marriage together in a public and solemn manner in the presence of two witnesses. "

Marriage before a State institution
(1) The declaration of marriage shall be made by a man and a woman with the authority in charge of maintaining a registry in which one of them has a permanent residence before the mayor or an authorised member of the municipal council in the presence of the matricide.
(2) For important reasons, the competent authority responsible for carrying out the matrices may authorise the conclusion of a marriage before another authority responsible for carrying out the matrices or at any appropriate place.
(3) If the life of a man who wants to marry is directly threatened, the marriage may be made before any local government authority in any place. "
3. The following Sections 4a, 4b and 4c are inserted after Section 4:
"The conclusion of marriage before a church institution
(1) A declaration of marriage shall be made by a man and a woman before the competent authority of the Church, before a person engaged in the activities of a spiritual registered church or religious society1 (hereinafter referred to as the "church form").
(2) Marriage in the ecclesiastical form is concluded in a church or in another appropriate place designated by the regulations of the church or religious society for religious ceremonies or religious acts.
(3) If the life of a man who wants to marry in a religious form is directly threatened, he can marry in any appropriate place.
(4) The institution of the church prior to the conclusion of the marriage is obliged to deliver without delay the Protocol on the conclusion of a marriage, stating the facts in accordance with the special legislation2) to the competent authority responsible for the management of the matrices in whose district marriage has been concluded.
The conditions of marriage laid down by this law also apply to the conclusion of marriage in the ecclesiastical form.
Marriage concluded by citizens of the Czech and Slovak Federal Republic during the period from 1 January 1950 until the entry into force of this Act in ecclesiastical form abroad under the law in force at the place of the marriage, is valid under Czechoslovak law. "
4. In Section 5, the words "Czechoslovak Socialist Republic 'are replaced by the words" Czech and Slovak Federal Republic'.
5. In Paragraph 6 (3), the words "the National Committee 'are replaced by the words" the competent authority responsible for the management of the matrix or the competent authority of the church'.
6. In Article 8 (1), the words "the devolving national committee 'are replaced by the words" the competent authority responsible for leading the matrix or the competent authority of the church'.
7. In Section 9, the words "the Regional National Committee 'are replaced by the words" the Regional Authority (4)'.
8. Paragraph 10 is deleted.
Act No. 97 / 1963 Coll., on Private International Law and Procedural Law, as amended by Act No. 158 / 1969 Coll., is amended as follows:
Paragraph 20 (2) is deleted; paragraph 1 is deleted.
This Act shall take effect on 1 July 1992.
