DECLARATION
of 21 July 2010
amending Decree No. 265 / 1999 of the Ministry of Defence Coll., laying down the period of service of professional soldiers preparing for the performance of their duties and the amount of remuneration which may be required on the professional soldier if he fails to comply with the agreement, as amended
The Ministry of Defence provides, pursuant to Articles 5 (6) and 60 (6) of Act No. 221 / 1999 Coll., on professional soldiers, as amended by Act No. 254 / 2002 Coll.:
Decree No. 265 / 1999 Coll., which provides for the duration of service of professional soldiers preparing for the performance of their duties by study and the amount of remuneration which may be required on the professional soldier if he fails to comply with the agreement, as amended by Decree No. 455 / 2002 Coll. and Decree No. 390 / 2005 Coll., is amended as follows:
1. in Article 1 (1) (b) and (c):
"(b) for study abroad or on secondment to study abroad under the study programme of a school in the Czech Republic, lasting for more than 4 weeks, for a period of five times the duration of the study but not more than 10 years,
(c) in the case of studies in the course of service or courses lasting more than 10 months in which teaching takes the form of study centres, for a period equal to the duration of the study; ';
2. in Article 1 (1) (d), "triple" is replaced by "triple";
3. in Article 2 (1) (a) and (b):
"(a) at present or daily studies
1. study programmes in the group of fields of education Special and interdisciplinary fields, associated with training of pilots and flight ducts, carried out by university, 30,000 CZK;
2. study programmes in the group of fields of medical science and pharmaceutical science, carried out by university, 12,000 CZK;
3. in Bachelor's, Master's or Doctoral Studies, carried out by a university in other study programmes not listed in points 1 and 2.9,000 CZK;
4. in language courses 6 000 CZK; or
5. in other cases not listed in points 1 to 4, 4 000 CZK,
(b) study in the performance of duty
1. in the study programme carried out by the university 3000 CZK; or
2. in other cases 2000 CZK. "
4. In Article 2 (4), the words "or, without the permission of the Ministry of Defence, shall be inserted after the words" or abroad '.
Transitional provision
The period of service of the soldier after completion of the studies initiated before the date of entry into force of this decree and the reimbursement of costs in the event of failure to comply with the agreement shall be governed by the legislation applicable at the time of commencement of the study.
Efficacy
This Decree shall take effect on 1 January 2011.
