fixing the flat-rate amount of the costs of infringement proceedings
The Ministry of Interior provides, in agreement with the Ministry of Finance pursuant to § 79 paragraph 1 of the Act of the Czech National Council No. 200 / 1990 Coll., on Infringements, hereinafter referred to as "the Act":
(1) The flat-rate amount of the costs of infringement proceedings, which the citizen is obliged to replace pursuant to § 79 (1) of the Act, is CZK 1 000.
(2) If an expert has been recruited in infringement proceedings, the lump sum referred to in paragraph 1 shall be increased by CZK 2,500; If an expert in the transport or health sector of psychiatry or toxicology has been recruited, the lump sum referred to in paragraph 1 shall be increased by CZK 5,000. If several experts have been recruited to submit an expert opinion, the flat-rate amount of the costs may not exceed CZK 10,000 after an increase under this paragraph.
The costs of the infringement proceedings initiated before the date of application of this Order shall be determined in accordance with the present Regulation.
The Order of the Ministry of Interior of the Czech Republic No. 252 / 1990 Coll., setting out the flat-rate amount of the costs of the infringement proceedings, is hereby repealed.
This Decree shall take effect on 1 September 1996.
