on the increase of paid pensions and the boundaries of low pensions, which are the only source of income
The Government of the Czech and Slovak Federal Republic orders, pursuant to § 160 paragraph 2 of Act No. 100 / 1988 Coll., on Social Security, as amended by Act No. 110 / 1990 Coll., amending and supplementing Act No. 100 / 1988 Coll., on Social Security, and Act No. 54 / 1956 Coll., on Social Insurance of Employees ("the Act '):
§ 1
Under this Regulation pensions are increased
(a) old age, invalidity, partial invalidity and service of years if the date from which they were granted falls within the period before 1 October 1988; and
(b) widows and orphans if they have been assessed from the pensions referred to in (a).
§ 2
(1) Old-age, invalidity, partial invalidity, in service of years, widower's and orphan's pensions are increased by a fixed percentage of the monthly amount of the pension due on the date of repayment in October 1990 as follows:

(2) The year in which the retirement pension is granted to an old-age, invalidity, partial invalidity and service of years means the year in which the day from which the pension was granted falls, provided that the entitlement to it lasted continuously until the date from which the increase in the pension is due.
(3) The year of the grant of the widower's and orphan's pension shall mean the year of the award of the pension from which the pension was calculated, or the day of the death of the citizen if he was not a pensioner.
(4) Pensions awarded on 30 September 1988 shall also be deemed to have been paid from a later date if they have been entitled before 1 October 1988 and have been calculated in accordance with Act No. 121 / 1975 Coll., on Social Security, if applicable
(a) old-age pensions of citizens who have not been employed continuously following the creation of a pension; or
(b) the invalidity or partial invalidity pensions of citizens who are still entitled to sickness benefits after 30 September 1988.
(5) If the pension due on the date of the repayment in October 1990 is adjusted to coincide with another pension or income from a gainful activity, the amount of the increase shall be determined on the monthly amount of the pension paid. On the first change in the amount of the pension paid, relating to the reasons for the reduction of the pension, the increase referred to in paragraph 1 shall be due from the subsequent payment of the pension.
(6) If the pension is not paid in October 1990, the amount of the increase shall be determined according to the amount of the first instalment of the pension paid after October 1990.
(7) If, after 30 September 1990, entitlement to the widow's or orphan's pension referred to in Article 1 (b) is restored, the amount of the increase shall be determined according to the amount of the pension due in October 1990.
(8) If the pension is adjusted as a single source of income, the amount of the increase shall be related to the amount of the pension before its adjustment.
(9) Widows' and orphans' pensions shall not be increased if they have been calculated from pensions raised under this Regulation.
§ 3
(1) In the case of multiple pension entitlements, the entitlement to an increase shall be assessed separately for each pension.
(2) For partial pensions awarded under an international contract, the amount of the increase shall be determined by the amount of the pension paid by the Czechoslovak payer; the amount of the compensatory allowance shall be determined taking into account the amount of the pension provided only under the Czechoslovak legislation.
(3) The increase in pension is also above the highest pension or total of pensions and above the highest pension or total of pensions and the increase in pension for helplessness; However, the amount of the pension or the total of the pensions, including the increase in the pension for helplessness, may not exceed the amount of CZK 3800 per month after the increase under this Regulation.
(4) The increase is combined with the pension to which it belongs and continues to form a whole.
§ 4
Increase in pensions that are the only source of income
The pension limits, which are the only source of income, are 1200 CZK per month under Sections 54 (1) and 68 (1) of the Act and 2000 CZK per month under Sections 54 (2) and 68 (2) of the Act.
§ 5
Increase in social income
According to Section 52 (2) of the Act, the amount of the social pension shall be up to a maximum of 1200 CZK per month for the individual and a maximum of 2000 CZK per month, if a member of the family is also dependent on such a pension.
Transitional and final provisions
§ 6
(1) The pensions referred to in Articles 2 (1) and 3 (2) shall be increased at the earliest from the payment of the pension due after the effective date of this Regulation without application.
(2) The pensions referred to in Article 2 (4) and the widow's and orphan's pensions derived therefrom shall be increased on request at the earliest from the payment of the pension due after the date of application of this Regulation.
(3) The amount of the compensatory allowance provided for in Article 3 (2) shall be refixed at the earliest from the payment of the pension due after the date of application of this Regulation.
(4) Pensions paid on the effective date of this Regulation, which have been adjusted as a single source of income, shall be increased without application from the payment of the pension due after the effective date of this Regulation.
(5) Pensions of elderly, disabled, widower and orphan children who have not yet been adjusted as a single source of income and which do not reach the level laid down in Article 4 shall be adjusted at the earliest on request from the payment of the pension due after the effective date of this Regulation.
(6) Social pensions under Section 52 (2) of the Act may be awarded or increased up to the amounts referred to in Section 5 on request at the earliest from the payment of the pension due after the date of application of this Regulation.
§ 7
This Regulation shall enter into force on 1 October 1990.
