on administrative fees
The Federal Ministry of Finance, the Ministry of Finance, the prices and wages of the Czech Socialist Republic and the Ministry of Finance, the prices and wages of the Slovak Socialist Republic shall, in agreement with the central authorities involved, provide, pursuant to Article 17 (1) of Act No. 105 / 1951 Coll., on administrative fees, as amended by the legal measure of the Bureau of the National Assembly No. 138 / 1960 Coll. ("the Act '):
Measurement and payment of the administrative fee
§ 1
(1) The public authorities (hereinafter referred to as "administrative authorities") shall charge and collect administrative fees (hereinafter referred to as "fees") for acts which are set out in the schedule of charges as charging items (hereinafter referred to as "the tariff list"), which forms an integral part of this decree as an annex.
(2) The rates of charges are determined by a fixed amount or margin or percentage of the basis of the charge.
(3) The fee shall be based on the retail price or value of the object of the action, in force at the place and at the time of execution. The payer shall communicate the retail price or the value of the article to the administrative department measuring the fee; If they do not do so, the administrative authority shall establish the price or value of the object of the action at the expense of the taxpayer.
(4) The fee base established by the percentage shall be rounded up to the whole tens of Kčs, unless otherwise specified in the tariff in each case. The fees shall be rounded down to the whole crown.
§ 2
(1) The fees set out in the fixed amount tariff are payable without measurement prior to the operation.
(2) The fees fixed in the tariff by a percentage of the retail price or the value of the subject matter shall be measured before the act is carried out and shall be payable within 15 days of the date of delivery of the payment notice, unless otherwise specified in the tariff in each case.
(3) Fees set out in the tariff by spacing and fees for actions which have been carried out, even if the fee has not been paid, (1) shall be charged after the operation and shall be payable within 15 days of the date of receipt of the payment notice, unless otherwise specified in the tariff in each case.
(4) Fees which, pursuant to Paragraph 6 (2) of this Decree, are revenue from the national committee's budget shall be paid by transfer from an account with a bank or savings bank or in cash (2) to the account of the national committee responsible. Fees under headings 12 (g), 27, 28, 29, 31, 33 and 40 of Section C of the Tariff may also be paid by stamp marks.
(5) Fees which are not the revenue of the national committee's budget shall be paid by stamp if the fee does not exceed 1000, - Kčs, with the exception of fees paid by the Czechoslovak representative offices and fees paid by foreign exchange foreigners at the border crossing points of the Czech and Slovak Federal Republic. Chargers who have accounts with a bank or savings bank may pay fees higher than 50, - Kčs may also pay by transfer from that account.
(6) Fees which are not paid by stamp marks and are not the income of the national committee's budget shall be paid by transfer from an account with a bank or savings bank or postal order to the account of the state budget of the Czechoslovak Federation or the State budget of the relevant Republic established for the respective district (district or urban) financial administration.
(7) The Federal Ministry of Finance or the Ministry of Finance, Prices and Wages of the Republics may, on a case-by-case basis, authorise the payment of fees for the account of the administrative authority charging the fee and specify the time limits within which the administrative authority is required to pay the fees to the State Budget of the Czechoslovak Federation or the State Budget of the respective Republic established for the respective district (district or urban) financial administration.
§ 3
Currency
(1) The administrative authorities shall charge and levy fees in Czechoslovak crowns, with the exception referred to in paragraphs 2 and 3.
(2) The Czechoslovak representative offices shall charge and collect fees which are determined by a percentage of the base in the currency in which the basis of the fee is expressed.
(3) Fees fixed by fixed amount or margin are charged by the Czechoslovak representative offices in the Czechoslovak crowns but collected in the currency of the State in which they have their registered office. The Czechoslovak representative office may accept payment of the fee in the currency of a State other than that in which it has its registered office; However, this currency must be recorded in the Czechoslovak State Bank's exchange sheet in the "non-trading rate - valuables' section.
(4) The conversion of Czechoslovak Crowns into foreign currency and vice versa is carried out by a non-commercial exchange rate according to the exchange rate ticket of the Czechoslovak State Bank valid at the time of the measurement of the fee.
§ 4
Exemption
(1) In addition to the authorities exempted from the fees provided for in Article 10 (1) of the Act and persons exempted to the extent specified in the tariff headings and to the exemptions laid down in the international arrangements by which the Czechoslovak Socialist Republic is bound, diplomatic representatives mandated in the Czechoslovak Socialist Republic, consuls from the profession and other persons who enjoy privileges and immunities under international law, provided that they are not Czechoslovak nationals, and that they are guaranteed by Article 3)
(2) In addition to the acts exempted to the extent specified in the tariff headings and to the exemptions enshrined in the international arrangements by which the Czechoslovak Socialist Republic is bound, the following acts are further exempted from charges:
(a) the implementation of Czechoslovak generally binding legislation on sickness, maternity and child security and social security;
(b) the implementation of Czechoslovak generally binding state defence legislation;
(c) in an application for an invention with an application for an authorial certificate or an act in an application for an industrial design application with an application for an industrial design certificate;
(d) in the case of an authorial certificate for an invention or an industrial design certificate, if requested by the author or heir.
(3) To the extent set out in tariff headings, administrative authorities shall be empowered to reduce, increase or, where appropriate, waive the fee.
§ 5
Repayment of the fee
(1) The administrative authority which has levied or collected the fee shall decide in full that the fee paid has not been paid or that the fee has not been dealt with without fault, or that the fee has been paid without having been due.
(2) The administrative authority which has levied or collected the fee shall decide on the refund of the amount for which the fee has been paid more than it has been due, or on which the fee paid has been subsequently reduced or remitted at the request of the payer. The application for a reduction or remission of the fee shall not be dealt with unless it exceeds the amount of 30 CZK.
(3) The administrative authority which has charged or collected the fee shall decide, at the request of the taxpayer, whether and what part of the fee paid will be refunded if the taxpayer is not responsible for the action for which the fee was paid. The administrative authority may reimburse no more than 65% of the amount paid for the fee. The sums recovered shall be rounded down to the whole Kčs. The application for reimbursement of the fee shall not be discussed and the fee shall not be refunded unless it exceeds the amount of 30, - CZK.
(4) The premium shall not be refunded after three years from the beginning of the calendar year following that in which the fee was paid.
Jurisdiction and budgetary determination
§ 6
(1) The fees referred to in Sections A and B of the Tariff are determined by the Ministry of Finance, Prices and Wages of the Czech Socialist Republic and by the Ministry of Finance, Prices and Wages of the Slovak Socialist Republic. The fees listed in Section C of the Tariff are determined by the Federal Ministry of Finance, the Ministry of Finance, the prices and wages of the Czech Socialist Republic and the Ministry of Finance, the prices and wages of the Slovak Socialist Republic. The fees referred to in Section D of the Tariff shall be determined by the Federal Ministry of Finance.
(2) Fees under Section A, under headings 10, 12 and 13 of Section B and under headings 25, 26, 30, 32, 34, 35, 36 and 40 of Section C of the Tariff shall constitute the revenue of the budgets of the national committees, provided that the act for which the fee is levied is carried out by the national committee, with the exception of those levied by the Czechoslovak representative offices in such cases. The fees referred to in item 12 (g) of Section B and under items 27, 28, 29, 31, 33 and 40 of Section C of the Tariff shall be the income of the National Committee which has carried out the operation, provided that they are paid to the account of the National Committee responsible; in the case of the payment by stamp marks, these fees and charges by other tariff items shall be the revenue of the national budget of the Republic concerned.
(3) Fees under the other items of Section C shall be the income of the State Budget of the relevant Republic or of the State Budget of the Czechoslovak Federation according to the jurisdiction of the administrative authority which carries out the operation.
(4) Fees by item of section D tariff is the income of the state budget of the Czechoslovak Federation, with the exception of fees paid by stamp stamps.
Supervision
§ 7
(1) As part of the exercise of the administration, the financial administration shall be convinced by supervision with the administrative authorities of the Federation and of the Republics, with the exception of the national committees on the accuracy and timeliness of the measurement and payment of fees which are the income of the state budget of the Czechoslovak Federation or of the state budget of the respective Republic.
(2) The national committees are likewise followed by fees which are the income of the national committees' budgets.
Transitional and final provisions
§ 8
Fees for acts which were initiated before 1 January 1989 shall be charged and levied at the rates set out in Decree No. 162 / 1976 Coll., on administrative charges, as amended by Decree No. 166 / 1980 Coll. and Decree No. 17 / 1986 Coll., with the exception of those mentioned in Item 13 of Section B and in Section D of the Notes to Part III of the Tariff.
§ 9
They shall be deleted:
a) Decree of the Federal Ministry of Finance, the Ministry of Finance of the Czech Socialist Republic and the Ministry of Finance of the Slovak Socialist Republic No. 162 / 1976 Coll., on administrative fees, as amended by Decree No. 166 / 1980 Coll. and Decree No. 17 / 1986 Coll.;
(b) Decree of the Ministry of Finance of the Czech Socialist Republic No 153 / 22 844 / 1987 of 23.12.1987 on exemption from administrative charges, registered in the amount of 26 / 1987 Coll.;
(c) Order No 13 of 26 June 1978 by the Minister of the Interior of the Czechoslovak Socialist Republic determining the amount of administrative fees for the issuing of permission to travel abroad, registered at the amount of 21 / 1978 Coll.
§ 10
Efficacy
This Decree shall take effect on 1 January 1989.

Notes to the section
1. The fees referred to in the items of this section shall be levied by the national committees.
2. The District National Committee may, on a case-by-case basis, reduce or waive the fee levied under this Section to prevent or mitigate hardness, or, where appropriate, for reasons of general interest.
Item 1
Schválení výměny (dohody o výměně) dvou bytů nebo dvou nebytových prostorKčs 20,–
Note:
For the approval of the exchange (exchange agreement) of each additional apartment or non-residential space, the administrative authority shall select 20, - Cds for each additional apartment.
Item 2
Povolení změny:
a) příjmení hanlivého, výstředního, směšného, zkomoleného, cizojazyčného nebo příjmení rozvedeného manžela na předešlé příjmeníKčs 20,–
b) jména nebo příjmení v ostatních případechKčs 500,–
Exemption:
1. A change in the surname resulting from a declaration by the divorced spouse to accept the previous surname again shall be exempt from the charge under this heading if this fact has been notified within 1 month of the date of the legal authority of the divorce decision.
2. A change or rectification of the name of the adopted children or a change to be made as a result of incorrect (incomplete) entries in the matrix shall be exempt from the fee under this heading.
Notes:
1. Correction of the name and surname of the person in the case of transsexuality shall be considered as a change as a result of incorrect registration in the matrix.
2. A fee shall be levied for changing the surname of the spouses and their minor children to the common surname.
3. According to point (a) of this item, a fee shall be levied for authorising the change of the surname of a child entrusted to a foster parent, to the common surname of a foster parent or to a surname agreed for their own children, provided that the guardians or foster parents are grandparents or siblings of the parents of minor children.
Item 3

Exemption:
1. The fee under this item shall be exempt from persons whose life is directly threatened and citizens severely disabled, holders of ZTP or ZTP-P licences.
(2) The fee referred to in points (a) and (b) of this heading shall be exempt from the charge by the spouses who marry the national committee responsible for the place of temporary residence at the place of work of one of them.
Notes:
1. The fee under this item shall be collected from only one of the fiancé.
2. The fee under this item is also collected from foreigners, 4) who are allowed permanent residence in the territory of the Czechoslovak Socialist Republic.
Item 4
a) Uzavření manželství mezi cizinci, kteří mají na území Československé socialistické republiky povolen jiný než trvalý pobytKčs 500,–
b) Uzavření manželství mezi československým státním občanem nebo cizincem, který má na území Československé socialistické republiky povolen trvalý pobyt, a cizincem, který má na území Československé socialistické republiky povolen jiný než trvalý pobytKčs 250,–
Note:
Where a marriage takes place before a competent national committee other than the competent national committee, the fee referred to in point (b) of this heading shall be levied by the competent (delegating) national committee which has prepared the documents for the conclusion of the marriage.
Item 5
Vydání loveckého lístku nebo prodloužení jeho platnosti:
a) pro československé státní občanyKčs 50,–
b) pro cizinceKčs 500,–
Exemption:
1. Pupils and students of secondary and higher education institutions in the fields of hunting, forestry and professional hunters shall be exempt from the fee provided for in this item if they have active hunting activities, hunting workers and persons designated as hunting guards upon submission of school or profession attestations, forest guards, if they perform this function in connection with the performance of their duties, and forest guards - pensioners, if they have performed that function in the last five years as a work obligation.
2. Foreigners who come to the Czechoslovak Socialist Republic at the invitation or with the consent of the Government of the Czechoslovak Socialist Republic, the Czech Socialist Republic or the Slovak Socialist Republic, the Federal Assembly, the Czech National Council, the Slovak National Council or the guests of the Czech or Slovak Hunting Association are exempt from the fee under this item if the invitation of these guests has been approved by the relevant ministries.
Note:
Foreigners who are allowed permanent residence in the territory of the Czechoslovak Socialist Republic shall be charged the fee referred to in point (a) of this entry.
Item 6
Vydání rybářského lístkuKčs 30,–

Exemption:
The fee provided for in this item shall exempt pupils and students of secondary and higher education institutions in the field of fisheries studies, professional fishermen in the fisheries sector, if they are engaged in the pursuit of fishing activities in their work capacity, fishing operators and their representatives, and persons designated as fisheries guards upon presentation of a school certificate or certificate of office or profession.

1. The administrative authority shall levy a fee in accordance with point (a) of this item of 50% for the decision to amend the marketing authorisation.
2. The administrative authority may raise the fee referred to in point (b) of this item up to five times the rate in the case of more than five trees.

Note to section
The fees referred to in the items of this Section shall be charged and collected by the national committees and administrative authorities of the Republic.
Item 10

If the territorial management is merged with the building procedure and a single decision is taken, the fee shall be charged in accordance with item 25 of Section C.

2. The fee referred to in point (f) of this item shall be exempt from the fee by applicants carrying out scientific research and activities in the protected territory in order to protect the territory.
Command:
The administrative authority may raise the fee referred to in point (f) of this item up to five times the rate depending on the importance of the territory and the gravity of the intervention.
Item 13

Command:
1. The administrative authority which has issued the permit to operate the playing instruments referred to in point (b) of this heading shall reduce the fee rate by 50% if the authorisation is for a period of less than 6 months.
2. The administrative authority may, where justified in view of local conditions, grant a fee reduction of 25% of that rate under point (b) of this item.
Notes:
1. The fee referred to in (a) of this item shall be paid without reference to an oral or written invitation, if the act of the national committee is carried out.
2. The fee referred to in (c) of this item shall be calculated only after the operation has been carried out, each year for the preceding year, throughout the period of validity of the authorisation issued.
3. The fee referred to in point (b) of this item shall be charged and collected in accordance with the decree in force at the time of the authorisation.
Item 14
Vydání zbrojního průkazu, prodloužení jeho platnosti, zápis každé další zbraně, speciálního expanzního přístroje nebo jejich hlavních částí do zbrojního průkazuKčs 20,–
Exemption:
1. A fee under this item shall be exempt from professional and other duty soldiers, National Security Corps members, Correctional Education Corps members, VB Auxiliary Guards, Border Guard helpers, unless they are weapons for hunting purposes.
2. The persons referred to in point 1 shall be exempt from the fee provided for in this item from entry 5 of Section A in the case of weapons used for hunting purposes.
Item 15

Exemption under heading 14 of this section and under heading 2 under heading 5 of the section And they're similar here.
Item 16

Exemption:
Organisations developing, producing or repairing weapons and ammunition shall be exempt from the fee referred to in points (b) and (c) of this item if they are shooting range set up to test weapons and ammunition.

Command:
1. The fee referred to in points (b) to (d) of this item shall be reduced by the administrative authority to 100 CZK if the holder of a motor vehicle is a citizen with a severe disability, the holders of a ZTP or ZTP-P licence, or by motor vehicles where a special adjustment is made to the control mechanisms adapted to the disabled, the holders of a ZTP or ZTP-P licence.
2. The administrative authority shall levy charges under this item of 25% of the rate in cases where the technical competence of the motor vehicle or trailer is approved after conversion.
3. Fees under this item shall not be levied if the administrative department approves the technical capacity of the motor or trailer after theft.
4. The administrative authority shall reduce the fee to 400, - Ccs, if it is a vehicle individually imported from abroad equipped with a functional controlled three-way catalyst.
Notes:
1. Under this heading, a fee shall also be levied where the administrative authority approves the technical capacity of a motor vehicle or trailer which has been permanently withdrawn from the register or was imported individually from abroad.
2. The fee includes a fee for the issue of relevant documents and registration plates for the motor vehicle or trailer.
3. The administrative fee under this item shall be reduced by the amount evidently paid for technical inspection stations for carrying out technical checks on motor vehicles and their trailers after domestic construction or imported individually from abroad.

The administrative authority may, where justified, increase the fee referred to in point (b) of this item up to a maximum of 10 times.
Notes:
1. The administrative authority shall not levy a fee for the registration of a change in the documents relating to the motor vehicle or trailer if it has already levied a fee under item 18 or 21 of this section.
The fee referred to in points (c) and (d) of this item shall be collected for each individual registration plate table.

Item 21
Writing of the change of the holder of the motor vehicle or trailer (even with the modifications in the relevant documents)

Exemption:
The fee shall be exempt from registration of the change of the holder as a result of:
- acquisition and settlement of the inheritance,
- an official order or decision of the court,
- the disappearance of shared ownership of spouses.
Notes:
1. A fee shall not be levied for the registration of a change in the names of an organisation that holds the vehicle for the purposes of the merger or division of organisations under this item.
2. The fee for recording the change of the holder shall be the acquirer of the motor or trailer.
