of 14 August 2019
amending Act No. 182 / 2006 Coll., on bankruptcy and its methods of resolution (insolvency law), as amended
Parliament has decided on this law of the Czech Republic:
Amendment of insolvency law
In Section 412a of Act No. 182 / 2006 Coll., on the bankruptcy and methods of its resolution (insolvency law), as amended by Act No. 31 / 2019 Coll., the following paragraph 6 is added:
"(6) If the claims of unsecured creditors arose from at least two thirds of their amount before the debtor's 18-year-old age, the debt relief shall be met by the payment schedule with the payment of the property if it has not been cancelled for a period of 3 years from the approval of the debt. A claim arising before 18 years of the debtor's age shall also be treated as an accessory to such a claim, a contractual fine resulting from the same contract as a claim and a claim arising from a contract concluded in the course of the creditor's business activity before the expiry of the period of 3 years from the date of 18 years of the debtor's age, where the debtor has used at least two thirds of its amount to pay the claim in accordance with the first sentence. ';
Transitional provision
In insolvency proceedings which have been initiated and in which a decision on the insolvency of the debtor has been taken after 31 May 2019, the date of entry into force of this Act shall be followed in accordance with Act No. 182 / 2006 Coll., as effective after the date of entry into force of this Act.
Efficacy
That law shall take effect on the first day of the calendar month following its publication.
