of 25 April 2006
amending Act No. 89 / 1995 Coll., on State Statistical Service, as amended, and other related laws
Parliament has decided on this law of the Czech Republic:
Amendment of the State Statistical Service Act
Act No. 89 / 1995 Coll., on the State Statistical Service, as amended by Act No. 356 / 1999 Coll., Act No. 220 / 2000 Coll., Act No. 256 / 2000 Coll., Act No. 411 / 2000 Coll., Act No. 202 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 81 / 2004 Coll., Act No. 562 / 2004 Coll. and Act No. 342 / 2005 Coll., is amended as follows:
1. in Article 2 (k), the words "accounting unit 2c)" shall be inserted after the words "organisational component of the State."
Footnote 2c reads:
"2c) Act No. 219 / 2000 Coll., on the assets of the Czech Republic and its presentation in legal relations, as amended."
2. in Article 2, the following points (m) and (n) are inserted after point (l):
"(m) the internal unit identification code of the code number used to identify it;
(n) the internal unit of the statistical unit which more precisely divides the territorial structure (local unit) or the structure by activity (activity unit) of the economic operator; the local unit and the activity unit are created according to the rules of the European Community2d) for statistical registers;
(2d) Council Regulation (EEC) No 2186 / 93 of 22 July 1993 coordinating the Community procedure for the establishment of registers of economic operators for statistical purposes. Council Regulation (EEC) No 696 / 93 of 15 March 1993 on statistical units for the purpose of statistical surveys and analysis of the Community economy. '
Points (m) and (n) shall be renumbered as points (o) and (p).
3. In Article 2, at the end of point (p), the dot is replaced by a comma and the following points (q) to (v) are added:
"(q) the place of usual residence of a stranger is the address of the place of residence which appears in his residence permit, if it is a stranger with a residence permit or with a temporary residence permit, or if it is a stranger residing in the Czech Republic on the basis of a long-stay visa granted under the special law 2e); the place of usual residence of the alien to whom asylum has been granted under the Special Law 2f), the address appearing on the asylum permit,
(r) statistical circuits of the smallest territorial unit comprising the cadastral territory and the basic residential units whose network covers the entire territory of the Czech Republic, which serve to describe the territory in detail and to create statistical zones;
(s) the basic unit of residence, a unit representing parts of the territory of the municipality with unambiguous technical and urban conditions or the catchment areas of a grouping of objects of a residential or recreational nature;
(t) a geographical technical unit a unit which is defined as a cadastral territory or part thereof, separated by the boundary of the basic territorial unit, i.e. the border of the municipality, city district or part thereof,
(u) the basic territorial unit of the territory of the municipality or of the military exit and, where the municipality is subdivided by 2g, the territory of the urban district or of the urban part;
(v) public institutions sector of the state's organisational body, local authorities, state and other non-budgetary funds, public higher education institutions, health insurance companies and other organisations included by the Czech Statistical Office in this sector.
2e) Act No. 326 / 1999 Coll., on the residence of foreigners in the Czech Republic and on the amendment of certain laws, as amended.
2f) Act No. 325 / 1999 Coll., on asylum and amending Act No. 283 / 1991 Coll., on the Police of the Czech Republic, as amended, (Act on asylum), as amended.
2g) Act No. 128 / 2000 Coll., on municipalities (municipal establishment), as amended. Act No. 131 / 2000 Coll., on the Capital City of Prague, as amended. '
4. In Article 3, the following paragraph 2 is inserted after paragraph 1, including footnote 2h:
"(2) The Czech Statistical Office is headed by the President, who is appointed and recalled by the President of the Republic on a proposal from the Government. The function of President of the Czech Statistical Office is incompatible with membership of the political party or political movement. The President of the Czech Statistical Office is responsible for the salary and other formalities relating to the performance of his duties to the same extent as the President of the Supreme Audit Office under the Special Law 2h).
2h) Paragraph 1 (e) of Act No. 236 / 1995 Coll., on the salary and other formalities connected with the performance of the duties of representatives of State authority and of certain state bodies and judges and Members of the European Parliament, as amended. '
Paragraphs 2 and 3 shall become paragraphs 3 and 4.
5. In Article 3, the words "and discussed with the ministries' shall be added at the end of the text of paragraph 3.
6. in Paragraph 4 (1) (f):
"(f) produces macroeconomic analyses and analyses of the selected characteristics of social, economic, demographic and ecological development of the Czech Republic and its individual regions,"
7. in Article 4 (1), the following point (g) is inserted after point (f):
"(g) processes projections of demographic developments,"
Points (g) to (n) shall be renumbered as points (h) to (o).
8. In Article 4, at the end of paragraph 1, the dot is replaced by a comma and the following point (p) is added:
"(p) the administration of the State in the area of the processing of election results to the local authorities, the Parliament of the Czech Republic and the European Parliament held in the Czech Republic and the processing of the results of the national referendum to the extent provided for by specific legislation."
9. in Article 4 (2), point (c) is deleted;
Point (d) shall be renumbered (c).
10. in Paragraph 9 (2), including footnotes 4b, 4c and 4d:
"(2) The Czech Statistical Office may require:
(a) individual data from the tax returns and accounts of natural and legal persons, provided that they are processed and centrally accessible in electronic form, for the purposes of compiling national accounts in accordance with the requirements of the European System of National and Regional Accounts in the Community (4b) and for the management of statistical registries (4c);
(b) from the information obtained under customs procedure (5) on the allocation of a customs-approved treatment or use, the information provided for directly by the applicable European Communities Regulation (4d);
(d) the following information:
1. the business name or name, in the case of legal persons, in the case of business natural persons, the address of the place of permanent residence and the address of the place of business, if different from the address of the place of permanent residence, and the identification of the social security payer and the contribution to the national employment policy, which is a legal person, an organisational body of the State or a self-employed person; identification means an identification number or, where applicable, a birth number for natural persons, unless they have been assigned an identification number or registered in the course of carrying out social security;
2. the number of natural persons for whom the employer is obliged to pay social security contributions and a contribution to national employment policy.
(4b) Council Regulation (EC) No 2223 / 96 of 25 June 1996 on the European system of national and regional accounts in the Community.
(c) Council Regulation (EEC) No 2186 / 93.
(4d) Council Regulation (EC) No 1172 / 95 of 22 May 1995 on statistics relating to the trading of goods by the Community and the Member States with third countries. "
11. in Article 9, the following paragraph 4 is inserted after paragraph 3, including footnote 5f:
"(4) The Czech Statistical Office uses the individual data of entities included in the public institution sector for statistical purposes related to the calculation of deficit and debt and for the compilation of quarterly and annual non-financial and financial accounts for this sector according to the requirements of the European Communities (5f).
5f) Council Regulation (EC) No 3605 / 93 of 22 November 1993 on the application of the Protocol on the excessive deficit procedure annexed to the Treaty establishing the European Communities. Council Regulation (EC) No 2223 / 96. Regulation (EC) No 1221 / 2002 of the European Parliament and of the Council of 10 June 2002 on quarterly non-financial accounts of general government. Regulation (EC) No 501 / 2004 of the European Parliament and of the Council of 10 March 2004 on quarterly financial accounts of general government. Council Regulation (EC) No 1222 / 2004 of 28 June 2004 on the compilation and transmission of data on quarterly government debt. ';
Paragraphs 4 to 6 shall be renumbered paragraphs 5 to 7.
12. in Article 9 (5), the words "to the Czech Statistical Office" shall be inserted after the words "Information provided";
13. in Paragraph 10 (2) (d), the word "individual" shall be deleted;
14. Paragraph 12, including the title, reads:
Population statistics and census, houses and flats
Statistical information on the birth of children, death, marriage, divorce and change of permanent residence is kept in the population statistics. In order to create this information, state authorities and medical institutions are required, according to the nature of their activities, to provide the Czech Statistical Office with confidential statistics on the birth number, address of the place of permanent residence, place of usual residence of a stranger and place of usual residence of a stranger who has been granted asylum under a special law, citizenship, birth characteristics of a born child, family status, order of marriage (divorce), number of minors in divorcing marriages, causes of divorce of marriage, if any, cause of death, length of life of the deceased infant, place and time of the event under consideration. '
15. in the first sentence of Article 16 (1), "and others" shall be replaced by "or."
16. In Article 17, at the end of paragraph 1, the dot is replaced by a comma and the following points (f) and (g) are added:
"(f) transmit confidential statistical data for the purposes of scientific research on the basis of a contract which provides for the fulfilment of the conditions of protection of such data and the precise use of such data in accordance with European Community law (6b), to legal persons whose principal mission is scientific research; data shall be provided in a form which does not allow the direct identification of the reporting agent that relates to the data provided;
(g) they transmit individual data to the Czech National Bank for statistical purposes if this is necessary to fulfil the obligations arising from the international treaties by which the Czech Republic or the Czech National Bank is bound.
6b) Commission Regulation (EC) No 831 / 2002 of 17 May 2002 implementing Council Regulation (EC) No 322 / 97 on Community statistics as regards access to confidential data for scientific purposes. '
17. in the first sentence of Article 17 (2), the words "if special law 7 so provides" shall be inserted after the words "the statistical purpose."

18. in Paragraph 18, the following paragraph 4 is inserted after paragraph 3:
"(4) Statistical information identified or generated by processing data obtained in population statistics may be provided and disclosed even if it relates to a single case. This information shall not include the name and surname, birth number, full date of birth or full address of the place of residence of the natural person concerned by this data. Nor can an indication relating to a single case be provided or disclosed where, taking into account the circumstances, it is possible to identify or determine which person is involved. ';
Paragraph 4 shall become paragraph 5.
19. Paragraph 19a, including the title and footnote No 8a, reads:
Statistical registers
(1) The Czech Statistical Office maintains a register of economic operators and a register of census circuits and buildings. To the extent provided for by this law, registers are a public list.
(2) For the needs of the state statistical service, especially for the preparation of statistical surveys, the Czech Statistical Office creates an agricultural register.
(3) The registers referred to in paragraphs 1 and 2 establish a interconnected system. The Czech Statistical Office can use data obtained from other public administration information systems for their management 8a).
(4) The statistical registers referred to in paragraphs 1 and 2 shall process and record changes to such data for all data kept therein.
8a) Act No. 365 / 2000 Coll., on Information Systems of Public Administration and on the amendment of certain other laws, as amended. '
20. in Article 20 (2) (c), the words "and the organisational elements of the State" shall be inserted after the words "for legal persons."
21. in Article 20 (2) (f), the words "legal person" shall be deleted;
22. in § 20 (2) (g) and (h), the words "and the organisational components of the State" shall be inserted after the words "legal entities."
23. in Article 20 (3), the second sentence is deleted;
24. In Paragraph 20, the following paragraphs 4 and 5 are inserted after paragraph 3:
"(4) From data on internal units are entered in the register of economic operators
(a) identification code;
(b) type of internal unit;
(c) name,
(d) address and territorial identification,
(e) the subject matter of the activity;
(f) date of origin;
(g) the date of extinction;
(h) size category,
(i) the number of employees;
(j) volume of sales.
(5) In addition to the information referred to in paragraph 4, if the interior unit of the accommodation is an indoor accommodation facility, further entries shall be made:
(a) the type of category and seasonal nature of the accommodation;
(b) the capacity of the accommodation facility used for the transitional accommodation of persons,
(c) the number of persons providing for the operation of the accommodation. ';
Paragraphs 4 to 6 shall be renumbered paragraphs 6 to 8.
25. Paragraph 20 (7) reads:
"(7) The data for the local unit referred to in points (a) to (j) of paragraph 2, points (a) to (h) of paragraph 4 and point (a) of paragraph 5 shall be public data and shall be made available to any person who so requests.";
26. In Article 20 (8), the first sentence is replaced by the following: "The data referred to in paragraph 2 (k) to (t), paragraph 4 on units of activity, paragraph 4 (i) and (j) on local units, and paragraph 5 (b) and (c) shall be non-public unless the special law provides otherwise."

27. Article 20a, including the title and footnotes Nos 9f, 9h, 9i and 9j, read:
Register of census circuits and buildings
(1) In the register of census circuits and buildings, the Czech Statistical Office maintains data on the census circuits, records elements of territorial identification and data on buildings located in the Czech Republic based on data obtained under special legislation9f) or under this law.
(2) The register of census circuits and buildings is a hierarchically organised system of registered objects, which captures their interconnections and changes in content, time and space.
(3) The register shall include spatial data on the direct location of the registered phenomena, which are defined according to the relevant map background 9h).
(4) The register of census circuits and buildings should include:
(a) a system of territorial elements and territorial units of registration which captures territorial, administrative, residential and statistical structures;
(b) buildings or parts thereof (entrances) with descriptive or registration numbers assigned.
(5) For the purposes of this register, they shall consist of:
(a) a system of territorial elements: area, region, district, municipality, urban district, or urban area, basic territorial unit, cadastral territory 9i), technical unit, basic residential unit, statistical district and parcela9i),
(b) system of territorial units: part of the municipality, street and other public areas.
The size categories and jurisdiction of the territory to administrative districts shall also be entered in the register of individual territorial elements and territorial units.
(6) The following information is entered in the register of census circuits and buildings:
(a) the building identification code;
(b) territorial identification of the building, address and location;
(c) month and year of completion of the building;
(d) month and year of removal of the building;
(e) the reason for the removal of the building;
(f) the type of owner;
(g) residence of the house;
(h) the number of flats for residential buildings;
(i) the installed area of the building in m2;
(j) built space of the building in m3;
(k) floor area of the building in m2;
(l) the number of floors above ground;
(m) the nature of the building;
(n) the type of vertical structure;
(o) connection to the water duct,
(p) waste connection;
(q) gas connection;
(r) the mode of heating;
s) equipment of the house by lift.
(7) For buildings where there is at least one apartment, the entries in the register of census circuits and buildings and the individual apartments are characterised by these data
(a) apartment identification code,
(b) the serial number of the apartment,
(c) the floor,
(d) apartment accommodation;
(e) the total and residential area of the apartment in m2;
(f) number of accommodation rooms;
(g) heating mode,
h) connection of the apartment to gas, water supply, hot water,
(i) apartment equipment (bathroom, shower, toilet).
(8) The Czech Statistical Office in the register of census circuits and buildings records changes in the data recorded in accordance with paragraphs 5 to 7. For this purpose, it uses data obtained from administrative sources, from regular statistical surveys under this Act and data obtained from census, houses and flats.
(9) The building identification code and the apartment identification code are used to clearly identify the building and the apartment. These identification codes are of only notable importance and are assigned by the Czech Statistical Office of each building and each apartment when they are entered in the register of census circuits and buildings.
(10) The information referred to in paragraphs 5 and 6, with the exception of point (g), shall be public and may be provided to each under the conditions laid down in specific legislation9j).
(11) The information referred to in paragraph 6 (g) and paragraph 7 are private. The Czech Statistical Office will provide them to the ministries which provide the State Statistical Service and to the other state or local authorities, provided that this authority is authorised to obtain the required data under a special law.
9f) Act No. 158 / 1999 Coll., on the census of people, houses and flats in 2001. Act No. 344 / 1992 Coll., on the cadastral property of the Czech Republic (cadastral law), as amended. Act No. 50 / 1976 Coll., on Territorial Planning and Construction Regulations (Construction Act), as amended.
9h) Government Decree No. 116 / 1995 Coll., laying down geodetic reference systems, state map works binding throughout the country and the principles of their use.
9i) Act No 344 / 1992 Coll., as amended.
9j) Act No 344 / 1992 Coll., as amended. Decree No. 162 / 2001 Coll., on the provision of data from the Czech Real Estate Register, as amended. '
28. In Article 20b, the following paragraph 4 is added:
"(4) The agricultural register is private."
29. § 20c, including the title and § 20d, are deleted.
30. In Section 21, the words "and identification code 'are deleted from the heading.
31. in Article 21 (1), the words "economic operator (hereinafter referred to as" identification number ")" shall be deleted;
32. In Article 21, the words "; this shall not apply if the economic operator is transformed by law or changes in the legal form of the company (9k) or cooperative (9k) 'are added at the end of the text of paragraph 2.
Footnote 9k:
"9k) Articles 69 (2) and 254 (4) of the Commercial Code. '
33.In Paragraph 22 (1) (d), including footnote 11c, the following is added:
"(d) legal persons registered or registered under special legislation11c) Ministry of Culture;
11c) Act No. 3 / 2002 Coll., on the Freedom of Religious Religion and the Status of Churches and Religious Companies and on the Amendment of Certain Laws (Act on Churches and Religious Societies), as amended. '
34. in Paragraph 22, the following paragraph 2 is inserted after paragraph 1:
"(2) The register court and the administrative authorities authorised to allocate the identification number referred to in paragraph 1 shall communicate to the Czech Statistical Office all facts relating to the allocation and termination of the validity of the identification number and the changes to the registered data under this Act."
Paragraphs 2 to 7 shall be renumbered paragraphs 3 to 8.
35. In Paragraph 22, the sentence "An identification number which has already been assigned to another economic operator or an identification number with a non-compliant control mark shall be considered as an incorrect identification number shall be added at the end of paragraph 3. '.
36. in Paragraph 22 (4):
"(4) The Czech Statistical Office shall provide the identification numbers for the needs of the registration courts and administrative bodies referred to in paragraph 1."
