DECLARATION
of 31 January 2022
amending Decree No 388 / 2006 Coll., on the net cost of universal service in electronic communications
According to Section 150 (2) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), as amended by Act No. 468 / 2011 Coll. and Act No. 374 / 2021 Coll., for the implementation of Section 48 (7) of the Act on Electronic Communications:
Decree No 388 / 2006 Coll., on the net cost of universal service in electronic communications, is amended as follows:
1. In Article 2, at the end of paragraph 4, the words "which an entrepreneur would have incurred in a situation where a universal service obligation should not be imposed 'are added.
2. In Article 2 (5), the words "weighted monthly 'are deleted.
3. Paragraph 4 (2) reads as follows:
"(2) The provider providing the sub-service referred to in Article 38 (2) (a) of the Act shall submit to the Authority, for the settlement period together with the documents referred to in paragraph 1, a list of newly established and operational end points used to access the Internet in a fixed place, indicating the average unit cost of setting up the network end point and the total number of network end points operated used to access the Internet."
4. In Article 4, at the end of the text of paragraph 3, the words "used for a voice communication service in a fixed place and a list of newly established and operational end points, used only for a voice communication service, indicating the average unit cost of establishing the network end point. ';
5. In Article 4, paragraphs 4 to 6 are deleted.
Paragraphs 7 to 9 shall be renumbered paragraphs 4 to 6.
6. In Article 4 (4), the text "Paragraph 38 (2) (f) 'is replaced by" Paragraph 38 (2) (c)', the word "participants' is replaced by the word" consumers' and the words "and the list of participants to whom such equipment was provided during the period preceding the year 'is replaced by the words" and the list of consumers using the special tariff provided for in Article 43 (2) (b) of the Act'.
7. In Article 4 (5), "Paragraph 38 (2) (g) (1) and (2) 'is replaced by" Paragraph 38 (2) (d) (2) and (4)' and "Participants' is replaced by" Consumers'.
8. In Article 4 (6), the words "low income 'and" disabled persons' are deleted.
Efficacy
This decree shall take effect on the first day of the calendar month following its publication.
