DECLARATION

of 12 January 2009

on the publication of the National Nature Reserve New Castle Pond and the establishment of its closer protection conditions

The Ministry of the Environment provides pursuant to § 79 (3) (c) of Act No. 114 / 1992 Coll., on the Conservation of Nature and Landscape, as amended by Act No. 218 / 2004 Coll. and Act No. 312 / 2008 Coll., ("the Act '):

§ 1

Subject matter

(1) The New Castle Pond (hereinafter referred to as the "National Nature Reservation") is announced.

(2) The object of the protection is an ornithological site with an abundance of aquatic and wetland species and a complex of aquatic, wetland and forest ecosystems, in particular saltwater meadows, reeds, natural swamps and willows, created around the New Castle pond. The protection also covers the natural habitat types and species for which another legislation1) the European site of Jestřebsko-Dokesko and which are located in the territory of the national nature reserve.

§ 2

Definition of the national nature reserve

The national nature reserve is situated in the territory of the Liberec Region in the cadastral territories of the Jestřebí near České Lípa and Zahradka near České Lípa. The national natural reserve boundaries shall be determined by a closed geometric pattern with direct sides whose vertices are determined by the coordinates of the single trigonometric network system of the cadastral2). The list of coordinates of the vertices of the geometric pattern as they follow in the pattern is given in Annex 1 to this decree. An indicative graphical representation of the territory of the national nature reserve is given in Annex 3 to this decree.

§ 3

Closer protection conditions

Only with the consent of the competent nature conservation authority can the national nature reserve

(a) to make changes to the type of land or the way in which it is used (3);

(b) establish hunting or fishing facilities.

§ 4

Protection zone

The protection zone of the national nature reserve is situated in the territory of the Liberec Region, in the cadastral territory of the Jeshřebí u České Lípa. The national nature reserve protection zone boundaries shall be determined by a separate enclosed geometric pattern with direct sides whose vertices are determined by the coordinates of the single trigonometric network system of the cadastral1). The list of coordinates of the vertices of the geometric pattern as they follow in the pattern is given in Annex 2 to this decree. The indicative graphical representation of the national nature reserve protection zone is given in Annex 3 to this Decree.

§ 5

Efficacy

This Decree shall take effect on 1 February 2009.
