on the competitive committees of popular control in organisations managed by the Czechoslovak Socialist Republic
The Government of the Czechoslovak Socialist Republic orders pursuant to § 8 (3) of Act No. 103 / 1971 Coll., on People's Control:
Establishment of folk control racing committees
(1) A People's Control Racing Commission (hereinafter referred to as the "Racing Commission") is established in enterprises, other organisations and establishments (hereinafter referred to as the "organisations"), managed by the authorities of the Czechoslovak Socialist Republic, where optimum conditions are created for this, and after the approval of the Government of the Czechoslovak Socialist Republic.
(2) When selecting the organisations in which the race committee is to be set up, it shall be assessed in particular whether the setting-up of the race committee requires an economic or other social interest and whether both cadres and other conditions for its activities are appropriate.
(1) The proposal for the establishment of a race committee is prepared by the Committee of People's Control of the Czechoslovak Socialist Republic in cooperation with the competent authorities of the Communist Party of Czechoslovakia, the Revolutionary Trade Union Movement, the Socialist Youth Union, the Head of Organisation and the relevant Committee of People's Control of the Regional and District National Committee.
(2) Proposals for consent to the establishment of racing committees are submitted to the Government of the Czechoslovak Socialist Republic by the Committee of People's Control of the Czechoslovak Socialist Republic.
(1) Upon the approval of the Government of the Czechoslovak Socialist Republic, the Committee of People's Control of the Czechoslovak Socialist Republic shall set up a race committee, which shall also appoint a chairman, Vice-President and at least five other members of the racing committee. The number of members shall be determined taking into account the size of the organisation and the complexity of the control tasks.
(2) The members of the race committee are selected from a collective of employees of the organisation or from pensioners who previously worked in the organisation. Membership of the race committee shall be incompatible with the function of the head of the organisation and its representative, as well as with the function of the staff of the expert control unit of the organisation; A member of the race committee may also not be a member of an organisation that has concluded a material liability agreement for the values entrusted.
(3) The Committee of People's Control of the Czechoslovak Socialist Republic shall, after consulting the authorities referred to in Paragraph 2 (1), withdraw a member of the race committee if he fails to fulfil his duties properly or for other serious reasons.
(4) The appointment and withdrawal of members of the race committee shall be made public in the organisation.
(1) If the conditions for the operation of the race committee cease to exist, the Committee of People's Control of the Czechoslovak Socialist Republic shall repeal it after consulting the authorities referred to in § 2 (1). The cancellation of the race committee will inform the government of the Czechoslovak Socialist Republic.
(2) If the establishment of a Committee of People's Control in the Production Unit is carried out, all rights and obligations of the Committee of People's Control of the Czechoslovak Socialist Republic which result from this Regulation shall be transferred to it in respect of the Racing Committees.
Activities of racing commissions
(1) The Racing Commission shall carry out an inspection of the economic activity and the performance of the tasks of the organisation in which it was set up. In doing so, it shall in particular:
(a) the performance of the organisation's economic plan, in particular the tasks set out in the national economic development plan;
(b) the efficiency of production, the promotion of rationalisation and cost-effectiveness of work, energy, materials and funds;
(c) compliance with the specified quality of the products or services provided by the organisation;
(d) the protection and use of assets owned by a socialist organisation;
(e) respect for labour and technological discipline;
(f) the performance of the organisation's tasks in the labour care sector.
(2) The Racing Commission shall check how the relevant services of the organisation handle complaints, notifications and initiatives of citizens and organisations and whether they implement the necessary measures to remedy them. The Racing Commission itself shall also accept complaints and notifications which it shall either refer to the organisation or investigate them directly if their seriousness so requires or if there are other reasons for doing so. It shall keep its own records of the complaints and notifications received.
(1) The racing committee shall work according to the control plan. It is based on the needs of the organisation and on the thematic control tasks established by the Committee of People's Control of the Czechoslovak Socialist Republic. It also makes use of comments and suggestions from workers and their organisations.
(2) The draft plan of control activities will be discussed by the race committee before its adoption with the competent authorities of the Communist Party of Czechoslovakia, the Revolutionary Trade Union Movement, the Socialist Youth Union and the head of the organisation.
(3) The Racing Commission shall inform the Committee of People's Control of the Czechoslovak Socialist Republic and the Collective Workers of the Organisation of its activities at least once a year.
(1) The racing committee shall proceed in the performance of the inspection and in the evaluation of the facts established, independently of the management of the organisation. It shall ensure that its findings are objective and that corrective measures are effective.
(2) The race committee shall meet as necessary but at least once a month. It is able to act if an absolute majority of its members are present. The agreement of an absolute majority of the members of the committee present shall be required for the validity of the resolution.
(1) The Committee of People's Control of the Czechoslovak Socialist Republic directs the activities of the Racing Commission and provides it with methodological assistance.
(2) The Racing Commission is responsible for its work by the Committee of People's Control of the Czechoslovak Socialist Republic.
(1) The Racing Commission transfers its control knowledge to the Communist Party of Czechoslovakia for use in the exercise of the right of control.
(2) The racing committee cooperates with the relevant competition authorities of the Revolutionary Trade Union Movement and the Socialist Youth Union, uses their knowledge for their control activities and informs them of their findings as necessary.
The Racing Commission is providing mutual assistance. They shall cooperate, as appropriate, with the popular control committees, the other control authorities and the control services of the superior authorities.
Approval of racing commissions
(1) The Racing Commission and its mandated members are entitled to all the tasks required to carry out the inspection in the organisation, in particular may require:
(a) to allow them access to all the facilities and facilities of the organisation;
(b) that the documents, materials and documents required are submitted to them within the time limits and that they are provided with true and complete oral or written information on the facts found, or an explanation of the causes of the defects found.
(2) If the members of the race committee demonstrate their special mandate to the Committee of People's Control of the Czechoslovak Socialist Republic, they must be presented with the required documents containing the facts constituting professional, economic or state secrets.
(3) The Racing Commission is entitled to add to the participation in the inspection after consultation with the competent authorities of the Communist Party of Czechoslovakia, the Revolutionary Trade Union Movement, the Socialist Youth Union and the head of the organization to the collaborators from both the employees of the organization and pensioners who previously worked in the organization; In carrying out the inspection activities, the co-workers shall be authorised to the members of the racing committee, within the scope of the mandate given by the racing committee.
(1) The Racing Commission is entitled to remedy
(a) to draw attention to the organisation's leaders to the shortcomings identified and to encourage them to be removed;
(b) require the management organisation to ensure, without delay, the removal of detected defects and their causes, unless this has been done following a warning under the previous provision and if it is suspected that an offence, offence or offence has been committed in order to notify the competent authorities,
(c) in the event of a breach of professional or technological discipline or of damage to property held in socialist property, initiate the management organisation or, where appropriate, of a superior body to draw the consequences of the relevant rules against guilty persons.
(2) The authorisation referred to in paragraph 1 shall also be the responsibility of the chairman of the race committee and the authorisation referred to in paragraph 1 (a) to the authorised members of the race committee.
Furthermore, the Racing Commission shall be authorised to:
(a) participate in control actions carried out in the organisation as decided by its manager, as well as in periodic reviews of the management and evaluation of the economic performance of the organisation;
(b) require the head of the organisation to ensure that serious defects are investigated, beyond the possibilities of the race committee, and to inform the racing committee of the results and the measures taken;
(c) propose to the Committee of People's Inspections of the Czechoslovak Socialist Republic the suspension of the implementation of an illegal decision or an illegal activity and if there is a risk of damage, whether it is an economic decision or an economic activity;
(d) request, where necessary, the support of the Committee of People's Control of the Czechoslovak Socialist Republic, or, after consultation with it, a superior authority or other competent state authority and propose to it to carry out a deeper inspection in the organisation.
Common and final provisions
The organisation shall carry out administrative work on a timely and free-of-charge basis for the racing committee, create the necessary conditions for its action and also pay the necessary costs in kind for its activities.
If the employees of the organisation fail to comply with the obligation imposed on them by § 11 of this Regulation and § 14 (1) and (2) or the obligation to report pursuant to § 14 (3) of Act No. 103 / 1971 Coll., on People's Control, the Racing Commission may initiate the Committee of People's Control of the Czechoslovak Socialist Republic to impose an order fine under § 15 of Act No. 103 / 1971 Coll., on People's Control.
This Regulation shall enter into force on the day of its publication.
