of 12 June 2025
amending Act No 285 / 2002 Coll., on the Donation, Collection and Transplantation of Tissue and Organs and amending certain laws (Transplant Act), as amended, and Act No 296 / 2008 Coll., on the Quality and Safety of Human Tissue and Cell for Human Use and on the Amendment of Related Acts (Human Tissue and Cell Act), as amended
Parliament has decided on this law of the Czech Republic:
Change of transplant law
Act No. 285 / 2002 Coll., on the donation, collection and transplantation of tissues and organs and on the amendment of certain laws (Transplant Act), as amended by Act No. 228 / 2005 Coll., Act No. 129 / 2008 Coll., Act No. 296 / 2008 Coll., Act No. 41 / 2009 Coll., Act No. 281 / 2009 Coll., Act No. 375 / 2011 Coll., Act No. 44 / 2013 Coll., Act No. 100 / 2017 Coll., Act No. 183 / 2017 Coll., Act No. 202 / 2017 Coll., Act No. 97 / 2019 Coll., Act No. 277 / 2019 Coll., Act No. 609 / 2020 Coll. and Act No. 261 / 2021 Coll., is amended as follows:
1. In Section 28b, the word "institution 'is deleted.
2. In Paragraph 28b (1), the words "organ donors' are replaced by the words" donors, with the exception of a sex cell donor 'and the words "organ collection' are replaced by the words" collection '.
3. in Article 28b (2) (a), the words "organ collection" shall be replaced by the words "collection" and the words "organ collection" shall be replaced by "collection."
4. in Article 28b (2) (b), the words "the transplant centre which it has carried out" shall be replaced by the words "the health service provider which it has carried out."
5. in Article 28b (2) (b), the words "by taking the authority" shall be replaced by the words "by";
6. In Paragraph 28b (3), the words "the transplant centre which it has carried out 'are replaced by the words" the health service provider which it has carried out'.
7. In Paragraph 28b (3), the words "procurement 'are replaced by the words" procurement'.
8. In Article 28b (3), the words "The Transplant Centre and the Health Service Provider are required 'are replaced by the words" The Health Service Provider is obliged'.
9. in Article 28b (4), the words "organ collection" are replaced by the words "organ collection."
10. in Article 28b (6), the words "by taking the institution" shall be replaced by "by";
Transitional provision
Reimbursement of expenses and lost earnings pursuant to Article 28b of Act No. 285 / 2002 Coll., as effective from the date of entry into force of this Act, is also due to a living donor, provided that at the time of entry into force of this Act the living donor was already incapacitated. In that case, it shall be entitled to full compensation from the date on which the invalidity takes place.
Amendment to the Human Tissue and Cell Act
In Article 7 (1) of Act No. 296 / 2008 Coll., on ensuring the quality and safety of human tissues and cells intended for human use and amending related laws (Human Tissue and Cell Act), as amended by Act No. 375 / 2011 Coll. and Act No. 136 / 2017 Coll., at the end of the text under point (b), the words "and, in the absence of a donor of sex cells, the difference between the loss of earnings and the compensation received for wages, wages and / or rewards and the sick from sickness insurance, which gave him temporary incapacity for collection of tissues or cells and the provision of health services which he has requested, pursuant to Article 28b of the Transplant law 'are added.
EFFECTIVE
That law shall take effect on the first day of the calendar month following its publication.
