DECLARATION
of 14 July 2023
amending Decree No. 346 / 2015 Coll., on the procedure for determining the amount of compensation for pain and for making it difficult for the social use of soldiers, as amended by Decree No. 303 / 2016 Coll.
According to § 119 (2) of Act No. 221 / 1999 Coll., on professional soldiers, as amended by Act No. 332 / 2014 Coll.:
Decree No. 346 / 2015 Coll., on the procedure for determining the amount of compensation for pain and for making it difficult for the social use of soldiers, as amended by Decree No. 303 / 2016 Coll., is amended as follows:
1. Paragraph 4 (3) reads as follows:
"(3) Point evaluation of pain in connection with bone fracture or bone surgery in other systems or organs shall be assessed as an open wound according to Annex 1 to this Decree. Pain associated with each subsequent operation shall be assessed as newly created pain. '
2. Paragraph 4 (4) is deleted.
3. In Section 5, at the end of paragraph 2, the words "simple deduction 'shall be added.
4. Paragraph 7 (2) reads as follows:
"(2) The value of the point shall be 1% of the average gross monthly nominal wage for the converted number of employees in the national economy obtained according to the published data of the Czech Statistical Office for the first to third quarters of the calendar year preceding the calendar year in which the obligation to carry out the assessment of pain and difficulties in social application arose. '
5. In Annex No 2, at the end of Chapter II, the following entry 2.11 is added:
"2.11. Chronic lumbar spine disease caused by long-term overburdening of heavy physical work associated with temporary incapacity for this diagnosis of a total duration of at least 12 months over the last 3 years, the severity of which has been assessed
1. in a clinical neurological examination in the evaluation of 7 parameters, which are palpative pain in the lumbar segment, Thomayer's symptom, Lasègue's symptom, allegation of reflexes L2 / 4 or L5 / S2, motor deficiency in the relevant myoton, sensitive deficiency in the relevant dermatom and EMG's evidence of axonal lesions in the relevant nerve root, and based on this examination, abnormalities have been detected in a person under 50 years of age at least 4 parameters, aged 50 to 60 years of age at least 5 parameters and over 60 years of age at least 6 parameters, and
2. in the radiological examination for the assessment of morphological changes in segments L3 / 4, L4 / 5 and L5 / S1, where in each of these 3 segments 5 parameters are evaluated, which are the reduction of the intervertebral disc, the protrusion of the intervertebral disc, the Modics of the degree II or III of the vertebral body, the shift of the vertebral body and the arthrosis of the intervertebral joints, and based on this examination, an abnormality was detected in a person under 50 years of at least 5 parameters, at age of 50 to 60 years of at least 6 parameters and over 60 years of at least 7 parameters of the overall 15 parameters evaluated.

6. In Annex No 4, at the end of Chapter II, the following entry 2.11 is added:

Efficacy
This decree shall take effect on the 15th day following its publication.
