of 20 April 2004
laying down fuel requirements for the operation of road vehicles and the method of monitoring and monitoring their quality
The Ministry of Industry and Trade provides pursuant to § 91 (2) of Act No. 56 / 2001 Coll., on the Terms and Conditions of Operation of Vehicles on the Road and on the Amendment to Act No. 168 / 1999 Coll., on Insurance of Liability for Damage Caused by the Operation of a Vehicle and on the Amendment of Certain Related Acts (Act on Insurance of Liability from the Operation of a Vehicle), as amended by Act No. 307 / 1999 Coll., ("the Act ') to implement § 77 (2) to (5) of the Act:
§ 1
Subject matter
This decree lays down, in accordance with the law of the European Communities (1), the requirements on the quality of fuel for the operation of vehicles on the road and the method of monitoring and monitoring the quality of fuel.
§ 2
Definition of terms
For the purposes of this decree:
(a) motor gasoline
1. mineral oils intended for the propulsion of combustion positive ignition engines falling within CN codes 2) 2710 11 41, 2710 11 45 and 2710 11 49,
2. mineral oils with a bioethyl alcohol content not exceeding 5 per cent by volume intended for the propulsion of combustion positive ignition engines listed under the Combined Nomenclature codes (2) 2710 11 41, 2710 11 45 and 2710 11 49,
3. mineral oils with a bioethyltercbutyl ether content of not more than 15 per cent vol intended for the propulsion of combustion positive ignition engines listed under the Combined Nomenclature codes (2) 2710 11 41, 2710 11 45 and 2710 11 49,
4. mineral oils containing both bioethyl alcohol and bioethyl tercbutyl ether, so that the total oxygen content does not exceed 2,7 per cent by weight, for the propulsion of combustion positive ignition engines listed under the Combined Nomenclature codes (2) 2710 11 41, 2710 11 45 and 2710 11 49,
5. mineral oils referred to in points 1 to 4 containing other oxygen compounds so that the total oxygen content does not exceed 2,7 per cent by weight for the propulsion of combustion positive ignition engines listed under the Combined Nomenclature codes (2) 2710 11 41, 2710 11 45 and 2710 11 49,
(b) diesel fuel
1. gas oils for the propulsion of compression-ignition internal combustion engines referred to in Combined Nomenclature code (2) 2710 19 41,
2. medium oils intended for the propulsion of compression-ignition internal combustion engines referred to in Combined Nomenclature code 2) 2710 19 29,
3. gas oils containing not more than 5 per cent by volume of fatty acid methyl esters intended for the propulsion of combustion compression ignition engines listed under Combined Nomenclature code (2) 2710 19 41,
4. medium oils containing not more than 5 per cent by volume of fatty acid methyl esters, for the propulsion of combustion compression-ignition engines referred to in Combined Nomenclature code (2) 2710 19 29,
(c) biofuel
1. bioethyl alcohol - ethyl alcohol produced from biomass (3) or biorenewable parts of waste, intended as an additive for motor gasoline, which is of a quality which complies with the relevant Czech technical standard and is listed under the Combined Nomenclature code (2) 2207 20 00; it is a renewable energy source,
2. Bio-ethyltercbutyl ether - ethyltercbutyl ether produced on the basis of bioethyl alcohol, used as an ingredient in motor gasoline, and listed under Combined Nomenclature code 2) 2909 19 00. The proportion of bioethyltercbutyl ether considered biofuel shall be 47 per cent vol.; it is a renewable energy source,
3. biodiesel - fatty acid methyl esters produced from vegetable or animal oil having the characteristics of diesel, intended for the propulsion of combustion compression-ignition engines listed under Combined Nomenclature code (2) 3824 90 99, such as rape oil methyl ester; it is a renewable energy source,
(d) mixed diesel fuel containing more than 30 per cent by weight of rapeseed oil methyl ester intended for the propulsion of compression-ignition engines under Combined Nomenclature code (2) 3824 90 99,
(e) liquefied petroleum gases, gases intended for the propulsion of combustion positive ignition engines listed under the Combined Nomenclature codes (2) 2711 12 19, 2711 12 97, 2711 13 91 and 2711 13 97,
(f) compressed natural gas gas intended for the propulsion of combustion positive ignition engines under Combined Nomenclature code (2) 2711 21 00,
(g) petroleum constituents of the selected petroleum products used for the production of fuel for combustion diesel engines;
(h) motor petrol with a very low sulphur content of motor petrol [point (a)] which has a maximum sulphur content of 10 mg / kg;
(i) diesel fuel with a very low sulphur content of diesel fuel [point (b)] which has a maximum sulphur content of 10 mg / kg.
§ 3
Biofuels, renewable energy
Biofuels may be available on the market as:
(a) pure biofuels in accordance with the relevant quality standards;
(b) biofuels mixed with petroleum constituents in accordance with the relevant quality standards; or
(c) liquids derived from biofuels such as bio-ethyltercbutyl ether.
§ 4
Fuel quality
(2) By 1 January 2005 at the latest, motor petrol and very low-sulphur petrol on the market must meet, in addition to the requirements laid down by the relevant Czech technical standard, 4) the quality indicators set out in Annex 3 to this Decree. As from 1 January 2009, no motor gasoline shall have a sulphur content greater than 10 mg / kg.
(4) By 1 January 2005 at the latest, diesel and diesel with a very low sulphur content on the market must meet, in addition to the requirements laid down in the relevant Czech technical standard, 5) the quality indicators set out in Annex 4 to this Decree. From 1 January 2009 no diesel shall have a sulphur content greater than 10 mg / kg.
(5) Motor diesel for the Arctic climate on the market does not need to meet the requirements of Annexes 2 and 4 to this Decree at the value of the cetane number, but must meet the requirements of the relevant Czech technical standard. 5)
(6) The required quality is met if the bioethyl alcohol intended as an additive in motor gasoline corresponds to the relevant Czech technical standard. 6) The separate use of bioethyl alcohol is possible when this biofuel is prescribed by the engine manufacturer.
(7) The required quality is met if biodiesel complies with the relevant Czech technical standard. 7) The use of biodiesel is only possible if the fuel is prescribed by the engine manufacturer.
(8) The required quality is met if the mixed diesel corresponds to the relevant Czech technical standard. 8) The use of mixed diesel fuel is only possible if the fuel is prescribed by the engine manufacturer.
(9) The required quality is met if the liquefied petroleum gases (LPG) correspond to the relevant Czech technical standard. 9)
(10) The required quality is met if the compressed natural gas (CNG) corresponds to the relevant Czech technical standard. 10)
§ 5
Method of monitoring quality fuel indicators
(1) Monitoring of quality fuel indicators is carried out by analysis of samples taken. Sampling shall be carried out at all storage, storage and sales points and may be carried out with the consent of fuel users directly.
(2) Sampling and comparison of test results for individual fuels must conform to the relevant Czech technical standard. 11)
(3) A report shall be drawn up each sampling which shall include:
(a) the registration number of the report registered by the Czech Trade Inspection Office ("the inspection"),
(b) the name of the person checked:
1. if the natural person, name and surname, business name, place of residence or place of business are involved (if any);
2. if there is a legal person, a business firm, a registered office and an identification number (if any),
(c) the date, time and place of actual sampling;
(d) the identification of the dispenser or storage tank from which the sample was taken;
(e) type of fuel with determination according to the relevant Czech technical standards, 12)
(f) the seal number, the marking of the sample and the quantity thereof;
(g) the name, the number of the service card and the signature of the official of the inspection responsible for carrying out the inspection tasks, hereinafter referred to as "the inspector," and, where sampling is carried out by an authorised expert, his name and signature;
(h) the names of the other persons invited to take the sample and their signatures.
(4) The Protocol shall be drawn up in duplicate, which shall be signed by the inspector, the inspected person, authorised by the competent sampling officer and other persons admitted. A copy of the Protocol shall be retained by inspection. The second copy of the report shall be received by the person checked.
(5) The minimum number of fuel samples per year for the assessment of their quality is set out in Annex 5 to this Decree.
(6) Fuel quality monitoring shall be carried out only by test methods of analysis established by the relevant Czech technical standards.
(7) Quality monitoring shall in particular monitor:
(a) for motor gasoline:
1. octane number by research method,
2. the octane number by engine method,
3. density at 15 ° C,
4. the vapour pressure determined by the DVPE method (Dry Vapour Pressure Equivalent - "Dry vapour equivalent at pressure") - only during the summer and winter periods (from 1.5 to 30.9 and from 1.11 to 31.3),
5. distillation:
- evaporated quantity at 70 ° C,
- evaporated quantity at 100 ° C,
- evaporated quantity at 150 ° C,
- end of distillation,
6. hydrocarbon composition:
- olefins,
- aromatics,
- benzene,
7. oxygen content,
8. Oxygen content:
- methyl alcohol,
- ethyl alcohol,
- isopropyl alcohol,
- tert-butyl alcohol,
- isobutyl alcohol,
- ethers containing 5 or more carbon atoms in the molecule,
- of which ethyl-tert-butyl ether,
- other oxygen compounds,
9. Sulphur content,
10. lead content,
11. potassium content (only for gasoline with an octane number of min. 91 determined by the research method and with additive against excessive wear of valve saddles added by the manufacturer),
(b) for diesel fuel:
1. cetane number,
2. cetane index;
3. density at 15 ° C,
4. distillation:
- evaporated quantity at 250 ° C,
- evaporated quantity at 350 ° C,
- 95% (V / V) distils at max. ° C,
5. polycyclic aromatic hydrocarbons;
6. sulphur content,
7. filtering - only during the transitional and winter periods (from 1.10 to 14.4),
8. Paraffin elimination temperature - only in winter (from 16.11 to 28.2.),
9. flash point,
10. ester content,
(c) for biodiesel:
1. the ester content,
2. density at 15 ° C,
3. cetane number - each fifth sample taken,
4. filtering - only during the transitional and winter periods (from 1.10 to 14.4),
5. acidity number,
6. corrosive action on copper,
7. sulphur content,
8. Water content,
9. Sulphate ash content,
10. phosphorus content,
11. free and bound glycerol content,
12. alkaline metal content (sodium and potassium),
13th point of ignition,
(d) for mixed diesel,
1. cetane number,
2. cetane index;
3. density at 15 ° C,
4. distillation:
- evaporated quantity at 250 ° C,
- evaporated quantity at 350 ° C,
- 95% (V / V) distils at max. ° C,
5. sulphur content,
6. filtering - only during the transitional and winter periods (1.10 to 14.4),
7. paraffin excretion temperature - only in winter (from 16.11 to 28.2.),
8. flash point,
9. Ester content,
(e) for LPG:
1. octane number by engine method - calculation from composition determined by chromatographic analysis,
2. sulphur content,
3. the content of dienes,
4. corrosive action on copper,
5. determination of hydrogen sulphide,
(f) for CNG:
1. methane content.
§ 6
Dosage of additive
For vehicles with engines designed for the use of leaded motor gasoline, additives by which the potassium salt is alkylated sulfoamber acid are used. The additive is dosed in such a way that the potassium concentration in one litre of gasoline is between 5 mg and 26 mg of potassium.
§ 7
Fuel quality monitoring
(1) The results of the monitoring of the quality fuel indicators referred to in paragraphs 1 to 9 of Section 4 for the preceding calendar month are sent to the Ministry of Industry and Trade on the 15th day of the following month in the monitoring reports. The model of the monitoring summary is set out in Annex 6 to this Decree.
(2) The supporting documents for drawing up the annual monitoring report on the quality of fuel referred to in paragraphs 1 to 9 of Section 4 for the preceding calendar year are sent to the Ministry of Industry and Trade by 31 March of the relevant calendar year at the latest. These materials shall be processed separately for each type of fuel on the basis of its specification. For motor gasoline, the specification is determined by the octane number using the research method and the maximum permissible sulphur content. For diesel, biodiesel, mixed diesel and LPG, the specification is determined by the maximum permissible sulphur content. The model for drawing up the annual monitoring summary is set out in Annexes 7 to 11 to this Decree.
(3) The Ministry of Industry and Trade is the contact authority in relation to the European Union authorities for regular reports on the monitoring of the quality of motor petrol and diesel fuels in the Czech Republic, which always sends information to the European Commission on the outcome of the monitoring of the quality of those fuels by 30 June.
§ 8
Repeal
The following shall be deleted:
1. Decree No. 227 / 2001 Coll., laying down fuel requirements for the operation of vehicles on the road and the method of monitoring and monitoring their quality.
2. Decree No. 48 / 2003 Coll., amending Decree No. 227 / 2001 Coll., laying down fuel requirements for the operation of vehicles on the road and the method of monitoring and monitoring their quality.
§ 9
Efficacy
(1) This decree shall take effect on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union.
(2) Paragraph 4 (1) and (3) and Annexes 1 and 2 shall expire on 31 December 2004.

(1) The methods of testing must be those specified in EN 228 (EN 228: 1999). The Czech Republic, as a Member State of the European Union, may take over the analytical methods specified in the standard replacing EN 228: 1999, provided that it can be shown that the accuracy and accuracy of this method is at least the same as the accuracy of the superseded analytical method.
(2) The values given in the specification are "true values." When setting their limit values, the terms CSN EN ISO 4259 "Petroleum products - Determination and use of conformity data in relation to test methods' were applied, minimum values were set, minimum difference 2R above zero was taken into account. (R = reproducibility). The results of each measurement are interpreted on the basis of the criteria described in EN ISO 4259 (ISO 4259: 1995).
(3) Unleaded Normal petrol may be placed on the market with a minimum octane number 81 as determined by the engine method and a minimum octane number 91 as determined by the research method.
(4) The summer period starts on 1 May and ends on 30 September.
Note: In Member States of the European Union with Arctic or severe winter conditions, the summer period shall begin on 1 June at the latest and shall not end before 31 August.
(5) Other monoalcohols and ethers with an end of distillation not higher than that provided for in EN 228: 1999.
(6) Sulphur content for motor petrol with a very low sulphur content from 1 January 2005 and from 1 January 2009 for all motor petrol.
