amending Government Regulation No 74 / 2017 Coll., laying down certain conditions for granting aid for the supply of fruit, vegetables, milk and school products and amending certain related government regulations, as amended
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Government Regulation No. 74 / 2017 Coll., laying down certain conditions for the grant of aid for the supply of fruit, vegetables, milk and school products and amending certain related Government Regulations, as amended by Government Regulation No. 128 / 2018 Coll. and Government Regulation No. 190 / 2019 Coll., are amended as follows:
1. In footnote 1, at the end of the third and fourth sentences, the words "as amended 'shall be added.
2. in Article 2 (1) (a), "cut" is replaced by "cut."
3. in Article 2 (1) (b), the reference to footnote 17 shall be inserted after the word "extrusion."
Footnote 17 reads:
"(17) Decree No. 157 / 2003 Coll., laying down the requirements for fresh fruit and fresh vegetables, processed fruit and processed vegetables, dry nuts, mushrooms, potatoes and their products, as well as other labelling methods, as amended."
4. In Paragraph 2 (1), at the end of point (c), the comma is replaced by "a '.
5. In Paragraph 2 (1), the word "a 'is deleted at the end of point (d).
6. In Article 2 (2) (c), the words "actions and printed 'are replaced by" actions or printed'.
7. In Article 2 (4), the words "points (a) to (d) 'are deleted.
8. Paragraph 2 (5) is deleted.
9. In Section 3, the words "and for the monitoring, evaluation or promotion of a school project 'shall be inserted after the words" under Section 2'.
10. in Article 5 (1) (c), "cut" is replaced by "cut."
11. in Article 5 (1) (j), "100" is replaced by "80."
12. in Article 5 (1) of the final part of the provision, the words "may not exceed the amounts set out in Annexes 1 to 3" shall be replaced by the words "is laid down in Annexes 1 and 2" and the words "by organic products" shall be inserted after the word "differentiation."
13. in Paragraph 6 (1):
"(1) The application for approval of an aid applicant (" the application for approval ') may be submitted by the person supplying the products pursuant to Article 5 (2) (c) of Commission Delegated Regulation (EU) 2017 / 40 ("the applicant'). '.
14. in Article 6 (3), the words "to implement accompanying educational measures" shall be inserted after the words "the applicant's undertaking";
15. in Article 6, paragraphs 4 and 5 are deleted;
Paragraphs 6 to 8 shall be renumbered paragraphs 4 to 6.
16. in Article 6 (4) of the introductory part of the provision and in Article 7 (5), "(b) to (e)" shall be replaced by "(b) to (d)."
17. in Article 6 (5), "6" is replaced by "4."
18. in Paragraph 6 (6), "7" is replaced by "5."
19. in Article 7 (3), "October" is replaced by "May," "competent" is replaced by "next" and "December" is replaced by "August."
20. Paragraph 7 (4) reads:
"(4) Where an approved applicant intends to change the range of products supplied referred to in § 2 (1) (b) to (d) or to modify the composition of the product delivered referred to in § 2 (1) (b) to (d), he shall submit an application to the Fund on the form issued by him; the information referred to in Article 6 (4) and (5) must be included in the application. ';
21. Paragraph 7 (6) reads:
"(6) Where an approved applicant is a contracting authority pursuant to Article 4 (2) of the Public Procurement Act, the Fund shall, before the start of the performance of the public procurement contract, submit documentation for the selection process of the contractor under the Public Procurement Act. ';
22. in Article 7, paragraph 7 shall be deleted;
23. in Paragraph 8 (1), the words "in schools" are replaced by the words "involved in a school project."
24. in Article 9 (1), the words "directly supplied or controlled" are replaced by the words "delivered."
25. in Article 9 (3) (a), the words "including the price of these products" shall be deleted;
26. in Paragraph 9 (4) of the introductory part of the provision, the text "(a)" shall be deleted.
27. in Article 9 (4) (a), "products" is replaced by "products"; the data are submitted in electronic form; and ';
28. in Paragraph 9 (4), at the end of point (b), the word "a" shall be replaced by a dot and point (c) shall be deleted;
29. in Article 9, paragraphs 5, 8 and 9 are deleted;
Paragraphs 6 and 7 shall become paragraphs 5 and 6.
30. In Article 9 (5), the words "directly supplied or controlled" shall be replaced by the words "supplied," the words "and a copy of the marketing authorisation of a person engaged in organic farming and" deleted, "the words" deliveries of products "shall be replaced by the words" documents, "the words" they "shall be replaced by the words" them, "and at the end of the paragraph the words" the document referred to in the first sentence may be replaced by electronic verification of the relevant information by the Fund. "
31st Paragraph 9 (6) reads as follows:
"(6) Aid shall be granted to the approved applicant pursuant to Article 6 (1) for the products referred to in Article 2 (1), equal to the amounts set out in Annexes 1 and 2 to this Regulation."
32. in Article 10 (2) (b), the words "inventory of invoices relating" shall be replaced by the words "invoices relating" and the word "paid" shall be replaced by "paid."
33. in Article 10 (2) (d), the words "pursuant to Article 6 (5)" shall be deleted;
34. Annexes 1 and 2 shall read as follows:

35. Annex 3 is deleted.
Transitional provisions
1. Government Regulation No 74 / 2017 Coll., as effective before the date of entry into force of this Regulation, shall apply to the application for aid for products for the school year 2020 / 2021.
2. The application for aid for accompanying educational measures for the school year 2020 / 2021 shall be subject to Government Regulation No 74 / 2017 Coll., as effective before the date of entry into force of this Regulation.
3. An applicant approved by the State Agricultural Intervention Fund pursuant to Article 6 of Government Regulation No 74 / 2017 Coll., as effective before the date of entry into force of this Regulation, shall be deemed to be an applicant approved under Article 6 of Government Regulation No 74 / 2017 Coll., as effective from the date of entry into force of this Regulation.
4. The approved applicant shall deliver for the school year 2021 / 2022 a plan of accompanying educational measures pursuant to Article 7 (3) of Decree No 74 / 2017 Coll., as effective from the date of entry into force of this Regulation, to the State Agricultural Intervention Fund until 31 October 2021.
5. For the school year 2021 / 2022, the State Agricultural Intervention Fund shall, in accordance with Article 7 (3) of Decree No. 74 / 2017 Coll., as effective from the date of entry into force of this Regulation, notify the applicant by 31 December 2021 whether the accompanying educational measures are eligible.
Efficacy
This Regulation shall be binding in its entirety and directly applicable in all Member States.
