Decree on the establishment of conditions for the operation of international airports in terms of border control

of 13 July 2016
laying down conditions for the operation of international airports with regard to border control
The Ministry of Interior provides pursuant to § 5 (7) of Act No. 191 / 2016 Coll., on the Protection of State Borders of the Czech Republic and on the amendment of related laws (Act on the Protection of State Borders):
§ 1
Subject matter
This decree regulates, following the directly applicable European Union Regulation (1), the conditions which must be met by an international airport at which at least 5 000 persons in a calendar year are checked out at external years.
§ 2
Airport non-Schengen zone
For the purposes of this Decree, the Neschem Airport Zone shall mean the area at an international airport intended for the movement of passengers at external flights before the entry border inspection is carried out and after the exit border control is carried out, except for the area of movement.
§ 3
Separation of passengers at external flights
(1) The non-Schengen area of the airport is separated from the other areas of the airport by a construction or construction barrier which prevents unauthorised entry of persons or the transfer of objects.
(2) Operational measures are taken at the international airport to separate passengers on external flights from other passengers on the moving surface.
§ 4
Transit point for border inspection
(1) The International Airport shall be equipped with a border inspection centre (hereinafter referred to as "terminal"), at least:
(a) one for carrying out entry border checks on persons enjoying the right of free movement under Union law;
(b) one for carrying out entry border checks on all persons;
(c) one for carrying out exit border checks on persons enjoying the right of free movement under Union law; and
(d) one for carrying out the exit border inspection of all persons.
(2) The check-in centres shall be marked with tables corresponding to the models set out in the Schengen Borders Code.
(3) The ramp must meet the following technical conditions:
(a) the front part of the check-in station is directed perpendicular to the current of incoming passengers;
(b) the floor area of the check-in workshop shall be raised by at least 20 cm above the floor level of the passenger compartment;
(c) it is not possible to view the inner premises of the handling office from the outside except its front part;
(d) the internal organisation of the clearance centre allows for the location of computer and document control techniques;
e) the check-in facility is connected to structured data cabling,
(f) it is possible to install a fingerprint reader and facial imaging device in the front part of the ramp;
(g) the check-in station is lockable.
(4) Outside of the check-in station is located
(a) a barrier which allows the passage of passengers around the ramp and which is controlled from within the ramp, and
(b) a mirror which enables passengers to be monitored by passing through the ramp.
(5) The point (a) of Article 5 (1) shall not be more than 100 metres from the nearest point (a) of the point of entry border inspection centre. The point (b) of Article 5 (1) shall not be more than 100 metres from the point (b) of Article 5 (1).
§ 5
Workplaces for the implementation of further border control operations
(1) International airports shall be equipped with a place of work for the conduct of further operations related to border control, at least:
(a) one for the implementation of further operations related to entry border control; and
(b) one for the implementation of further operations related to exit border control.
(2) The workplaces for carrying out further operations related to border control must comply with the following technical conditions:
(a) it is possible to monitor the flows of passengers from the workplace before the check-in point;
(b) it is not possible to view the inside of the workplace from the outside;
(c) the workplace's internal premises allow for the location of computer equipment, document inspection techniques and other equipment needed;
d) the workplace is connected to structured data cabling,
(e) the workplace includes a separate space intended for conducting interviews, searches and issuing visas at borders;
(g) the workstation is lockable.
§ 6
Room for foreigners denied entry to the Czech Republic
(1) The international airport is equipped with rooms in the Neschese zone of the airport, where foreigners may be located, who have been denied entry to the territory and who will be transported abroad under the Act on the residence of foreigners in the Czech Republic.
(2) The room has a separate part for men and a separate part for women.
(3) Each separate part shall be equipped with at least two beds, a table and two chairs.
(4) From the room there is access to running drinking and hot water, shower and toilet.
(5) If necessary, a cot is available.
(6) The room complies with the technical requirements laid down in the legislation governing technical requirements for construction (2).
§ 7
Efficacy
This Decision shall enter into force on 1 August 2016, with the exception of Article 6, which shall take effect on 1 February 2017.
