DECLARATION
of 24 August 2015
on the extent of the processing of information to the public, the notification of a major accident and the final report of the occurrence and impact of a major accident
According to Article 54 (1) of Act No. 224 / 2015 Coll., on the prevention of major accidents caused by selected hazardous chemicals or chemical mixtures and amending Act No. 634 / 2004 Coll., on administrative fees, as amended, (Act on the Prevention of Major Accidents) ("the Act '), for the implementation of Sections 35 (6) and 36 (5) of the Act:
Subject matter
This decree implements the relevant European UnionRegulation (1) and provides for
(a) details of the content of the information on major accident hazards, including possible domino effects, on preventive safety measures and on the desired behaviour of the population in the event of a major accident (hereinafter referred to as "information") and the extent to which such information is processed for group A and category B objects;
(b) the manner in which information processed for an object classified in Group B to the public is provided; and
(c) details of the content of the notification of the occurrence of a major accident and of the final report on the occurrence and impact of the major accident and how they are processed.
Details of information content
(Paragraph 35 (6) of the Law)
(1) The details of the content of the information processed for the objects listed in Group A or Group B are set out in Annex 1 to this Decree.
(2) Information for objects classified in Group A is processed to the extent specified in Part A of Annex 1 to this Decree.
(3) The information for the objects listed in Group B is processed to the extent set out in Part B of Annex 1 to this Decree.
Method of providing information processed for an object listed in Group B to the public in the emergency planning zone
(Paragraph 35 (6) of the Law)
(1) The public in the emergency planning zone shall provide the Regional Authority with information processed for an object listed in Group B to the extent specified in Part B of Annex 1 to this Decree in paper form. The regional authority may deliver this information, instead of providing it in paper form, to entrepreneurs who have their registered office or premises in the emergency planning zone by means of a data box if these entrepreneurs have it made available.
(2) Where an object listed in Group B for which the information has been processed has also been designated by the Regional Authority pursuant to Article 7 (1) of the Act, the Regional Authority shall deliver the information processed for that object to the extent set out in Part B of Annex 1 to this Regulation by means of a data box also to the operators of all buildings or facilities visited by the public, in particular school and health facilities and social services facilities, and to the neighbouring buildings located in the emergency planning zone; If these operators do not have the data box available, the Regional Authority shall provide them with this information in paper form.
Details of the content of the notification of a major accident and how it is processed
[Paragraph 36 (5) (a) of the Law]
A major accident report shall be processed by completing the form set out in Annex 2 to this Regulation.
Details of the content of the final report on the occurrence and impact of the major accident and the way in which it is processed
[K § 36 (5) (b) of the Act]
(1) The final report on the occurrence and impact of a major accident shall be drawn up by completing the form set out in Annex 3 to this Regulation.
(2) When completing the final report on the occurrence and impact of a major accident, the codes set out in Annex 4 to this Regulation shall be used and followed in accordance with the instructions set out in Annex 5 to this Regulation.
Transitional provision
In the event of a major accident occurring before the date of entry into force of this Order, the report on the occurrence of a major accident and the final report on the occurrence and impact of a major accident shall be processed to the extent and in the manner laid down in Decree No. 255 / 2006 Coll., as effective before the date of entry into force of this Order.
Efficacy
This Decree shall take effect on 1 October 2015.

Details of content of information processed for objects included in the group A or Group B
The extent to which information is processed for group A objects
Information processed for objects included in the group And it contains the following information:
1. Identification of the object and details of its classification.
2. Identification of the Regional Authority, including the cooperating information providers.
3. A simple description of the activities carried out in the operator's premises.
4. List of hazardous substances which may endanger the surrounding population, in accordance with the list set out in the proposal for classification under Section 5 (4) (b) of the Act, including a description of their hazardous properties and the anticipated consequences of identified major accident scenarios, including possible domino effects, on human and animal life and health, the environment and property.
5. Information on how to warn persons in the event of a major accident, information on the desired behaviour of persons in the event of a major accident and information on where such information can be obtained.
6. Information on the date of the last inspection in the building or information on where it is possible to detect this information and where it is possible to obtain more detailed information about this check on request.
7. Details of where other relevant information may be obtained under the Environmental Information Law 2).
The extent to which information is processed for B-group objects
Information processed for objects included in the group B contains the information in part And this annex and the following particulars:
1. Description of the major accident risk source, including the possible consequences of a major accident on lives, human and animal health and the environment, and a summary of the information on the main types of major accident scenarios and protective measures to prevent them.
2. Information on cooperation with the components of the integrated rescue system and confirmation that the operator is obliged to take appropriate measures within the facility, in particular to cooperate with the components of the integrated rescue system in order to manage and minimise the consequences of major accidents.
3. Suitable information from an external emergency plan that describes how to deal with the consequences of a major accident outside the facility. The information shall also include a call for compliance with the instructions and orders of the components of the integrated rescue system during the accident.
4. Where applicable, information on whether there is a possibility of a major accident with consequences beyond the borders of the State under the Convention on the Effects of Industrial Accidents Crossing States (3).
