DECLARATION
of 2 July 2025
amending Decree No 377 / 2013 Coll., on the storage and use of fertilisers, as amended
The Ministry of Agriculture provides pursuant to Article 9 (10) of Act No. 156 / 1998 Coll., on fertilisers, soil aids, plant bio-stimulants and substrates and on agrochemical testing of agricultural soils (Fertilizer Act), as amended by Act No. 9 / 2009 Coll., Act No. 61 / 2017 Coll. and Act No. 299 / 2021 Coll.:
Decree No. 377 / 2013 Coll., on the storage and use of fertilisers, as amended by Decree No. 131 / 2014 Coll., Decree No. 229 / 2017 Coll. and Decree No. 392 / 2021 Coll., is amended as follows:
1. In Article 5, the following paragraph 5 is added:
"(5) The solid organic fertiliser compost is stored outside agricultural land only in places suitable for its storage approved in the emergency plan under the Water Act. The storage facility shall be secured against leakage of liquid substances. ';
2. In Article 6, the following sentence is added at the end of paragraph 1: "On agricultural land, solid manure may only be stored in places suitable for their storage, on the basis of information obtained from land use records based on user relations conducted under the Act on Agriculture (6), provided that the user of defective substances is included and treated at any time with a total quantity of at least 2 tonnes of solid manure. If the user of the defective substances is not included in the land use register according to the user relations conducted under the Agriculture Act, solid manure may only be stored on agricultural land in places suitable for their storage under the Government's regulation on the establishment of vulnerable areas and action programme7). '
footnotes 6 and 7 are as follows:

3. footnote 4 shall read:
"(4) Government Decree No. 73 / 2023 Coll., on the establishment of cross-compliance rules for payments to farmers, as amended."
4. In Paragraph 7 (3), "48 'is replaced by" 24'.
5. In Article 7 (7) and (8), the text "dry matter. ha-1 'is replaced by" dry matter per ha'.
6. In Article 7 (8), at the end of the second sentence, the words "; this shall not apply to livestock manure from bovine animals and organic fertilisers produced only from by by-products or by-products resulting from the cultivation of cultural plants or from livestock manure from bovine animals where the maximum application dose is 15 tonnes of dry matter per ha over 3 years'.
7. footnote 5 reads:
"5) Decree No. 309 / 2021 Coll., on collection and chemical and biological analyses of fertiliser samples. ';
8. In Annex No 2, at the end of the text in point (d), the words "where the parts of the soil blocks are not part of the land use register according to user relations under the Agriculture Act 'are added.
9. In Annex No 2 (g), the words "variety, utility Directive 3) 'are deleted.
10. in Annex 2 (h) and (i), the comma after the reference to footnote 3 and the reference to footnote 4 shall be deleted;
11. in Annex No 2 (j), footnote 3 is deleted;
12. In Annex No 2, at the end of the text in points (k) to (m), the reference to footnote 3 is deleted and the words "where arable crops are cultivated 'are added.
13. in Annex 2 (q), the words "- in the case of grazing or residence on agricultural land, feces and urine, including animal species," shall be deleted;
14. in Annex 2, the following point (r) is inserted after point (q):
"(r) the species of animals in respect of grazing livestock (4),"
Points (r) to (v) shall be renumbered s) to (w).
15. in Annex No 2 to Explanatory Notes 3 and 4:
"3) In the case of cultivation of more than one crop on the same area within the growing (marketing) year, data shall also be kept on the date of sowing and the date of harvest or processing.
(4) In the case of livestock grazing, the data referred to in (q), (s), (u) to (w) shall not be provided. "
16. In Annex 3, Part A, in the table of the rows "Fugate of digestor 'and" Engine of digestor or rigid digestat', the following text is added:

18. In Annex 3, Part B, the following row is added at the end of the table:

22. Annex 7 reads as follows:
"Annex No 7
Method and form of electronic transmission of records
1. Data shall be transmitted in electronic form in the form of an automated data output. The Ministry's electronic application allows the transmission of automated data output via a web service or by manual upload of this output. The Ministry shall publish a detailed technical description of the data transmitted via the website.
2. The structure of the data output contains
(a) identification of the data transmitted
I. unique entity identifier - identification number (length of 8 characters),
II. identification of the start of the period for which data are transmitted (date in DD.MM.YYYY format); and
III. Identification of end of period for which data are transmitted (date in DD.MM format. YYYY),
(b) data phrase identifying cultivated crops containing:
I. the unique identifier of the parcel on which the crop is grown;
II. abbreviated code of the part of the soil block (according to designation in the land use register according to user relations under the Agriculture Act),
III square part of the soil block (according to the designation in the land use register according to user relations according to the Agriculture Act),
IV. Area of land (figure to two decimal places), in case the area changes during the period of area of land, the sub-area shall be given at the beginning and end of the period of validity of the sub-area,
V. data on crops grown on land containing:
1. a unique identifier for the cultivation of the crop concerned,
2. the number identifier of the cultivated crop according to the crop code list published by the Ministry in a way that allows remote access in an electronic application on the Ministry's website;
3. Information on whether the cultivated crop is multiannual,
4. information on the marketing year in which the crop is grown, in the absence of a multiannual crop;
5. date of sowing or planting (if applicable) (date in DD.MM.YYYY format), and
6. Date of end of crop cultivation (date in DD.MM format. YYYY),
(c) the data phrase containing the crop crop data
I. the unique cultivation identifier referred to in point (b) to which the harvest declaration relates,
II. number identifier of the main product according to the crop code list published by the Ministry in a way that allows remote access in an electronic application on the Ministry's website,
III. Information on the average yield of the main product per unit of area expressed in tonnes per hectare (figure to three decimal places),
IV. Information on the dry matter content of the main product as a percentage of the whole number (if the dry matter content is not stated, then the value of the dry matter content referred to in Annex 6 to this Decree shall be taken over for the purposes of calculating the nutrient balance),
V. by-product code identifier according to the product code list published by the Ministry in a way that allows remote access in an electronic application on the Ministry's website,
VI. Information on the average yield of the by-product per unit of area expressed as tonne per hectare (figure to three decimal places); and
VII. information on the dry matter content of the by-product as a percentage of the whole number (if the dry matter content is not indicated, then the value of the dry matter content referred to in Annex 6 to this Decree shall be taken for the purposes of calculating the nutrient balance),
(d) data theorem identifying the individual application of fertilisers, soil improvers, plant biostimulants, substrates and treated sludge containing:
I. the unique cultivation identifier referred to in point (b), to which the fertiliser is used,
II. date of use of fertiliser (date in DD.MM format. YYYY),
date of fertiliser repair (date in DD.MM format. YYYY),
IV. The target crop number identifier according to the crop code list published by the Ministry in a way that allows remote access in an electronic application on the Ministry's website,
V. surface area of the fertiliser (figure to two decimal places),
VI. Numeric fertiliser identifier according to the fertiliser register published by the Ministry in a way that allows remote access in an electronic application on the Ministry's website (optional),
VII. fertiliser name (text corresponding to fertiliser name),
VIII. information on the amount of fertiliser used (figure to three decimal places),
IX. unit of measurement of fertiliser used (t, kg, l),
X. information on nitrogen intake (N) in kg / ha shall be provided only if the fertiliser identifier according to the fertiliser register is not provided (figure to three decimal places),
XI. information on phosphorus intake (P) 1) in kg / ha shall be provided only if the fertiliser identifier according to the fertiliser register is not provided (figure to two decimal places),
XII. information on potassium intake (K) 1) in kg / ha shall be provided only if the fertiliser identifier according to the fertiliser register is not provided (figure to two decimal places),
XIII. information on magnesium intake (Mg) 1) in kg / ha shall be reported only if the fertiliser identifier according to the fertiliser register is not provided (figure to two decimal places),
XIV. information on calcium intake (Ca) 1) in kg / ha shall be provided only if the fertiliser identifier according to the fertiliser register is not provided (figure to two decimal places),
XV. information on the sulphur intake (S) 1) in kg / ha shall be reported only if the fertiliser identifier according to the fertiliser register is not provided (figure to two decimal places),
XVI. Indication whether the fertiliser has been used to support straw decomposition (in the format referred to in point A, for YES and N for NO),
XVII. data on the use of treated sludge per 100% dry matter; and
XVIII. data on the use of soil aid, plant biostimulants and substrates,
(e) the data phrase identifying the grazing livestock containing:
I. the unique identifier of the parcel referred to in point (b) to which the grazing figure refers, and the grazing record may be linked simultaneously to several parcels;
II. date of start of grazing,
III. End date of grazing,
IV. information on the species of livestock, according to the code list of animal species published by the Ministry in a way that allows remote access in an electronic application on the Ministry's website,
V. the average number of grazing livestock units,
VI. Number of grazing hours - not to be reported if animals are grazing all day; and
VII. area area for which grazing of animals has been carried out during the period concerned.
Explanatory note:
(1) In case the nutrient content of the fertiliser in oxide or carbonate form is indicated, the nutrient intake in the form of elements shall be determined by the following conversion: P = P2O5 x 0,436, K = K2O x 0,830, Ca = CaO x 0,715, Ca = CaCO3 x 0,400, Mg = MgO x 0,603, Mg = MgCO3 x 0,288, S = SO42- x 0,333. '
Final provision
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Efficacy
This Decree shall take effect on 15 July 2025, with the exception of Article I (2) and (4), which shall take effect on 1 January 2026.
