DECLARATION
of 26 June 2012
amending Decree No. 162 / 2005 Coll., on determining the quality parameters of universal service and its limit values
According to Section 150 (2) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), as amended by Act No. 110 / 2007 Coll. and Act No. 153 / 2010 Coll., for the implementation of Section 47 (5) of the Act:
Decree No. 162 / 2005 Coll., on determining the quality parameters of universal service and its limit values, is amended as follows:
1. Paragraph 1, including footnote 1, reads as follows:
This decree regulates the quality parameters of universal service and its limit values under European Union law.
1) Directive 2002 / 22 / EC of the European Parliament and of the Council on universal service and user rights relating to electronic communications networks and services (Universal Service Directive). Directive 2009 / 136 / EC of the European Parliament and of the Council amending Directive 2002 / 22 / EC on universal service and user rights relating to electronic communications networks and services, Directive 2002 / 58 / EC on the processing of personal data and the protection of privacy in the electronic communications sector and Regulation (EC) No 2006 / 2004 on cooperation between national authorities responsible for the enforcement of consumer protection laws. ';

Definition of terms
For the purposes of this Decree, the following definitions shall apply: the connection point means the main switchboard. ';
3. in Article 3 (1) (a) to (c):
'(a) the period during which the connection to the public communications network is established in a fixed place;
(b) frequency of circuit failures;
(c) the time during which the failure is removed; ';
4. in Article 3 (1) (h):
"(h) the alert rate for public telephone machines or other similar technical means enabling access to a publicly available telephone service (hereinafter referred to as the" public telephone machine ").";
5. Paragraph 3 (2) reads as follows:
"(2) The period during which a connection is set up in a fixed place to a public communications network shall be from the date on which the user applied for the connection until the end point of the network becomes operational in a fixed place; the operation of the connection at a fixed location shall also be considered as the transfer of the rights of use to another participant at the end of the network of the current trailer. ';
6. In Paragraph 3 (3), the words "relating to a local connection is the ratio of number 'are replaced by the words" number of trailers' and the words "to the average number of local connections' are replaced by the words" relating to 100 connections'.
7. In Article 3 (4), the words "the time when the fault is removed 'are replaced by the words" the time when the fault is removed'.
8. In Article 3 (7), the words "publicly available 'shall be inserted after the words" price accounting'.

Efficacy
This Decree shall take effect on 1 July 2012.
