GOVERNMENT REGULATION
of 28 June 2010
on a derogation from the employment relationship of employees with a regular place of work abroad
The Government orders pursuant to § 346 of Act No. 262 / 2006 Coll., Labour Code, as amended by Act No. 362 / 2007 Coll.:
This Regulation implements the relevant provisions of the European Union1) and regulates for staff with a regular place of work abroad (hereinafter referred to as "staff abroad")
(a) the negotiation of a fixed-term employment contract for the period of secondment to work abroad;
(b) extension of a fixed-term employment relationship for the period of secondment to work abroad; and
(c) divergent distribution of working time abroad in relation to working days.
The duration of employment for a specified period (2) with the natural person whose regular place of workis to be abroad may be negotiated for the period of secondment to work abroad, but not more than 5 years; this period can be contractually extended, but not more than 5 years in total.
Employees abroad may be ordered by the employer to perform work on a day that is a holiday in the Czech Republic, according to the Act on public holidays, on other holidays, on significant days and on working calm3); in this case it is provided for 1 day, which is a holiday in the Czech Republic, 1 day of work on the day which is a holiday in the relevant state.
This Regulation shall enter into force on 1 January 2011.
