The Constitutional Court decided on 28 April 2005 in plenary composed of JUDr. Stanislav Balík, JUDr. František Duchoň, JUDr. Vojen Güttler, JUDr. Ivan Janů, JUDr. Jiří Mucha, JUDr. Jiří Nykodým, JUDr. Pavel Rychetský, JUDr. Eliška Wagner, JUDr. Miloslav Excellent and JUDr. Michaela Židlická on the proposal of the Minister of Interior for the abolition of the generally binding Decree of the Municipality of Jindřichovice under Smrk. No. 5 / 2003, adopted by the Municipality of Jindřichovice under Smrk.
as follows:
I. The proceedings for the annulment of the generally binding orders of the municipality of Jindřichovice under Smrkem No 3 / 2003 and No 5 / 2003 are hereby terminated.
II. General binding order of the municipality of Jindřichovice pod Smrkem no. 1 / 2004, adopted by the council of the municipality of Jindřichovice pod Smrkem on 12 March 2004, is deleted from the date of publication of this finding in the Collection of Laws.
III. The rest is rejected.
