laying down fuel requirements for the operation of road vehicles and the method of monitoring and monitoring their quality
The Ministry of Industry and Trade provides pursuant to § 91 (2) of Act No. 56 / 2001 Coll., on the Terms and Conditions of Operation of Vehicles on the Road and on the Amendment to Act No. 168 / 1999 Coll., on Insurance of Liability for Damage Caused by the Operation of a Vehicle and on the Amendment of Certain Related Acts (Act on Insurance of Liability from the Operation of a Vehicle), as amended by Act No. 307 / 1999 Coll., ("the Act ') to implement § 77 (2) to (5) of the Act:
§ 1
Subject matter
This decree lays down, in accordance with the law of the European Communities (1), the requirements on the quality of fuel for the operation of vehicles on the road and the method of monitoring and monitoring the quality of fuel.
§ 2
Definition of terms
For the purposes of this decree:
(a) mineral engine gasoline oil intended for the propulsion of combustion positive ignition engines listed in subheadings (2) 2710 11 41, 2710 11 45 and 2710 11 49;
(b) diesel fuel gas oil for the propulsion of compression-ignition engines referred to in tariff subheading 2) 2710 19 41 and medium oil for the propulsion of compression-ignition engines referred to in subheading 2) 2710 19 29,
(c) biofuel of rapeseed oil methyl esters intended for the propulsion of combustion compression-ignition engines covered by tariff subheading 2) 3824 90 99,
(d) mixed fuel biofuel mixture with petroleum components containing more than 30% by weight of biofuels intended for the propulsion of combustion compression ignition engines, as specified in tariff subheading 2) 3824 90 99,
(e) liquefied petroleum gases, gases intended for the propulsion of combustion positive-ignition engines listed in subheadings 2) 2711 12 19, 2711 12 97, 2711 13 91 and 2711 13 97 (LPG),
(f) compressed natural gas intended for the propulsion of combustion positive ignition engines referred to in tariff subheading 2) 2711 21 00 (CNG),
(g) the petroleum components of the selected petroleum products used to produce fuel for combustion diesel engines.
§ 3
Fuel quality
(1) The required quality is met if the engine gasoline complies with the relevant Czech technical standard. 3) From 1 January 2003 they must also comply with the limit values for quality indicators set out in Annex 1 to this Decree and from 1 January 2005 also with the limit values for quality indicators set out in Annex 3 to this Decree.
(2) The required quality is met if diesel fuel complies with the relevant Czech technical standard. 4) From 1 January 2003 they must also comply with the limit values for quality indicators set out in Annex 2 to this Decree and from 1 January 2005 also with the limit values for quality indicators set out in Annex 4 to this Decree.
(3) The required quality is met if biofuel complies with the relevant Czech technical standard. 5) The use of biofuels is possible only with the agreement of the manufacturer of the engine.
(4) The required quality is met if the mixed fuel corresponds to the relevant Czech technical standard. 6) From 1 January 2003 they must also comply with the limit values for quality indicators set out in Annex 2 to this Decree and from 1 January 2005 also with the limit values for quality indicators set out in Annex 4 to this Decree. The use of a biofuel mixture with oil components with a biofuel content of more than 5% by weight is only possible with the approval of the engine manufacturer.
(5) The required quality is met if LPG complies with the relevant Czech technical standard. 7)
(6) The required quality is met if CNG complies with the relevant Czech technical standard. 8)
§ 4
Method of monitoring quality fuel indicators
(1) Monitoring of quality fuel indicators is carried out by analysis of samples taken. Sampling shall be carried out at all production, storage and sales points.
(2) Sampling and comparison of test results for individual fuels must conform to the relevant Czech technical standard. 9)
(3) A report shall be drawn up each sampling, which shall include:
(a) the registration number of the report registered by the Czech Trade Inspection Office ("the inspection"),
(b) identification of the person checked
1. if it is a natural person, name and surname (hereinafter referred to as "first name") or, where applicable, business name, identification number, place of permanent or authorised residence,
2. if there is a legal person, business name, registered office and identification number,
(c) the date, time and place of sampling;
(d) the identification of the dispenser or storage tank from which the sample was taken;
e) type of fuel with determination according to the relevant Czech technical standards, 3), 4), 5), 6), 7), 8)
(f) the seal number, the marking of the sample and the quantity thereof;
(g) the name, number of the service card and signature of the inspector and the name and signature of the authorised expert responsible for sampling;
(h) the names of the other persons invited to take the sample and their signatures.
(4) The Protocol shall be drawn up in three copies, which shall be signed by the inspector, the inspected person, authorised by the competent sampling officer and other persons admitted. A copy of the Protocol shall be retained by inspection. The second copy of the report shall be received by the person checked. The third copy shall be attached to the sample taken as part of it.
(5) The minimum number of fuel samples per year for the assessment of their quality is set out in Annex 5.
(6) The quality monitoring of the fuel used shall be carried out by methods established by the relevant Czech technical standards. From 1 January 2003, the monitoring of the quality of motor petrol shall also be carried out by the methods set out in Annex 1 to this Decree and from 1 January 2005 by the methods set out in Annex 3 to this Decree. From 1 January 2003, the monitoring of the quality of diesel fuel shall also be carried out by the methods set out in Annex 2 to this Decree and from 1 January 2005 by the methods set out in Annex 4 to this Decree.
(7) Quality monitoring
(a) for motor gasoline:
1. octane number by research method,
2. Lead content,
3. sulphur content,
4. benzene content,
5. vapour pressure according to Reid,
6. distillation,
7. aromatic hydrocarbon content,
(b) for diesel fuel:
1. cetane number,
2. cetane index;
3. sulphur content,
4. distillation,
5. density,
6th flash point,
7. paraffin elimination temperature,
(c) for mixed fuel:
1. sulphur content,
2. distillation,
3. density,
4th flash point,
5. paraffin excretion temperature,
6. biofuel content,
7. cetane index,
(d) for biofuels:
1. density,
2. viscosity,
3. paraffin elimination temperature,
4. acidity number,
5th ester number,
6. water content,
7. phosphorus content,
(e) for liquefied petroleum gases:
1. composition detected by chromatographic analysis,
2. sulphur content,
3. the content of dienes,
4. corrosive action on copper.
§ 5
Dosage of additives
For vehicles with engines designed for the use of leaded motor gasoline, an additive is used, which is the potassium salt of alkylated sulfoamber acid. The additive is dosed in such a way that 1 litre of gasoline contains at least 5 mg and a maximum of 26 mg of potassium.
§ 6
Fuel quality monitoring
The results of the monitoring of the quality indicators for each type of fuel in the previous month shall be sent by the inspection to the Ministry of Industry and Trade on the 15th day of the following month in the monitoring surveys. The model of the monitoring summary is set out in Annex 6 to this Decree.
§ 7
Efficacy
This Decree shall enter into force on 1 July 2001, with the exception of Annexes 1 to 4. Annex No 1 and Annex No 2 to this Decree shall become effective on 1 January 2003 and shall expire on 31 December 2004. Annex 3 and Annex 4 to this Decree shall take effect on 1 January 2005.
