THE LAW
of 3 September 1997
on foundations and foundations and amending and supplementing certain related laws (Law on foundations and foundations)
Parliament has decided on this law of the Czech Republic:
IMPLEMENTATION OF THE CIVIL COURT OF JUSTICE
Act No. 99 / 1963 Coll., Civil Code, as amended by Act No. 36 / 1967 Coll., Act No. 158 / 1969 Coll., Act No. 49 / 1973 Coll., Act No. 20 / 1975 Coll., Act No. 133 / 1982 Coll., Act No. 180 / 1990 Coll., Act No. 328 / 1991 Coll., Act No. 519 / 1991 Coll., Act No. 263 / 1992 Coll., Act No. 142 / 1996 Coll., Act No. 24 / 1993 Coll., Act No. 171 / 1993 Coll., Act No. 160 / 1995 Coll., Act No. 238 / 1995 Coll., Act No. 152 / 1995 Coll., Act No. 216 / 1994 Coll., Act No. 84 / 1995 Coll., Act No. 118 / 1995 Coll.
In Paragraph 9 (2) (j), the dot at the end is replaced by a comma and the following point (k) is added:
"(k) in proceedings concerning the cancellation and liquidation of the Foundation or the Foundation or the Foundation Fund, the appointment of the liquidator of the Foundation or the Foundation and the appointment of new members of the Board of Directors of the Foundation or the Foundation Fund. (1a)

IMPLEMENTATION OF THE CZECH NATIONAL COUNCIL LAW No 549 / 1991 Sb., ON COURT CHARGES, VERIFICATION OF LATER RULES
Act No. 549 / 1991 Coll., on Judicial Charges, as amended by Act No. 271 / 1992 Coll., Act No. 273 / 1994 Coll., Act No. 36 / 1995 Coll., Act No. 118 / 1995 Coll., Act No. 160 / 1995 Coll., Act No. 151 / 1997 Coll. and Act No. 209 / 1997 Coll., is added as follows:
In Article 11 (2) (k), the dot at the end is replaced by a comma and the following points (l) and (m) are added:
"(l) the Foundation or the Foundation Fund in matters relating to the Foundation Register;
(m) public utility companies in matters relating to the register of public utility companies. "
ADAPTATION OF THE CZECH NATIONAL COUNCIL LAW No 586 / 1992 Sb., ON TAXES FROM REVENUE, IN RESPECT OF LATER RULES
Act No. 586 / 1992 Coll., on Income Taxes, as amended by Act No. 35 / 1993 Coll., Act No. 96 / 1993 Coll., Act No. 157 / 1993 Coll., Act No. 196 / 1993 Coll., Act No. 323 / 1993 Coll., Act No. 42 / 1994 Coll., Act No. 85 / 1994 Coll., Act No. 114 / 1994 Coll., Act No. 248 / 1995 Coll., Act No. 316 / 1996 Coll., Act No. 18 / 1997 Coll., Act No. 151 / 1997 Coll., Act No. 209 / 1997 Coll., Act No. 210 / 1997 Coll., is supplemented as follows:
1. In Article 18 (7), the following is inserted after the word "Foundation," "Foundation Funds,"
2. in Paragraph 19 (1) (p), the dot at the end is replaced by a comma and the following point (r) is added:
"(r) income arising from the lease of real estate which is part of the assets of the foundation and which is entered in the fund register, income from the lease of works of art which are part of the assets of the foundation and which are entered in the fund register, interest and dividend income arising from securities which are part of the assets of the foundation and which are entered in the fund register, on condition that they are deposited in a separate account with the bank, income arising from copyright and patent rights which are part of the assets of the foundation and entered in the fund register; the exemption does not apply to revenue used by the Foundation in breach of a special law. 57).

AMENDMENT OF LAW No 563 / 1991 SB., ON ACCOUNTING, VERIFICATION OF LAW No 117 / 1994 SB.
Act No. 563 / 1991 Coll., on Accounting, as amended by Act No. 117 / 1994 Coll., is amended as follows:
In Paragraph 9 (1) (d), the words "association of legal persons and the word" foundation 'are replaced by the words "foundation funds'.

This Act shall take effect on 1 January 1998.
