DECLARATION
of 26 June 2012
amending Decree No. 327 / 2006 Coll., laying down the characteristics of adequate connection requirements in a fixed place to the public telephone network and access in a fixed place to a publicly available telephone service and the conditions for access to the Internet within the universal service
The Ministry of Industry and Trade provides pursuant to Section 150 (2) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), as amended by Act No. 110 / 2007 Coll. and Act No. 153 / 2010 Coll., ("the Act '), for the implementation of Section 40 (7) of the Act:
Decree No. 327 / 2006 Coll., laying down the characteristics of adequate connection requirements in a fixed place to the public telephone network and access in a fixed place to a publicly available telephone service and the conditions for access to the Internet within the universal service, is amended as follows:
1. In the title of the decree, the words "public telephone network 'are replaced by the words" public communications network'.
2. Paragraph 1, including the title and footnote 1, reads as follows:
Characteristics of the appropriate connection requirement in a fixed place to the public communications network
(1) An adequate requirement for connection at a fixed point to a public communications network within the universal service (hereinafter referred to as the "connection") is a requirement for the establishment of a single local connection circuit (1) (hereinafter referred to as the "connection circuit"), ending at the end of the network point of the place of residence, if the user is a non-commercial natural person, or at the place of business, if the user is a legal person. The universal service provider, to which an obligation under Paragraph 38 (2) (a) of the Act has been imposed, establishes this circuit through a public communications network operated by it or another operator's public communications network.
(2) A reasonable requirement under paragraph 1 shall not be the requirement of a user to whom a trailer circuit has already been established. This does not apply to connection in a fixed location for disabled persons under Section 43 (4) of the Act.
(3) Furthermore, the proportionate requirement referred to in paragraph 1 shall not be a requirement for connection in a fixed location with difficult availability or a fixed location in which the setting-up of the connection would entail costs significantly above the normal level, provided that a signal of at least one public mobile telephone network is available at that location. Signal availability means the level of received signal at a fixed point of the user that is not worse than the reference level specified in ETSI EN 300 910 V8.5.1

3. In Paragraph 2 (1), the words "subscriber connections' are replaced by the words" trailer circuit 'and the words "directly or indirectly' are inserted after the words" implement '.
4. In Article 3 (1), the words "Participating connection 'are replaced by the words" Connection circuit'.
Efficacy
This Decree shall take effect on 1 July 2012.
