DECLARATION
of 16 April 2004
amending Decree No 287 / 2002 Coll., adjusting certain details of the service of members of the Police of the Czech Republic, as amended by Decree No 472 / 2002 Coll.
The Ministry of Interior provides pursuant to § 58 (2) of Act No. 186 / 1992 Coll., on the service relationship of members of the Police of the Czech Republic:
Decree No. 287 / 2002 Coll., adjusting certain details of the service of members of the Police of the Czech Republic, as amended by Decree No. 472 / 2002 Coll., is amended as follows:
1. In Paragraph 38 (1), the words "in the territory of the Czech Republic or of the State of the European Union 'are deleted.
2. In Paragraph 38, the following paragraph 3 is added:
"(3) If the place of permanent residence of the family or any other prearranged place of residence of the family approved by the official at the request of the police officer is outside the territory of the Czech Republic, the police officer shall be entitled to reimbursement of travel expenses for visiting the family as referred to in paragraph 1 to the place of crossing the national border of the Czech Republic. In the case of air transport, the police officer shall be entitled to reimbursement of travel expenses for visiting the family to the point of crossing the national border of the Czech Republic at an amount equivalent to the price of a ticket for a long-distance road or rail means of transport, which shall be determined by the service official."
3. In Article 43 (2), the words "in the territory of the Czech Republic or of the State of the European Union 'are deleted.
4. In Article 43, the following paragraph 3 is added:
"(3) If the place of residence of the family is outside the territory of the Czech Republic, the police officer shall be entitled to reimbursement of travel expenses for visiting the family in accordance with paragraph 2, but not more than the amount corresponding to travel expenses to the last place of employment in the Czech Republic."
5. In Article 81, the words "except for parts of the texts defining the place of residence of the family in the territory of the European Union in Sections 38 (1) and 43 (2), which become effective on the date of entry into force of the Treaty of Accession of the Czech Republic to the European Union 'are deleted.
Efficacy
(1) This decree shall take effect on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union.
(2) This decree expires on the date of the entry into force of Act No. 361 / 2003 Coll., on the service ratio of members of the Security Corps.
