DECLARATION
of 28 August 2015
determining the scope of the security measures for the physical protection of an object included in the group A or Group B
According to Article 54 (2) of Act No. 224 / 2015 Coll., on the prevention of major accidents caused by selected hazardous chemicals or chemical mixtures and amending Act No. 634 / 2004 Coll., on Administrative Charges, as amended, (Act on the Prevention of Major Accidents) ("the Act ') for the implementation of Article 21 (5) of the Act:
Preliminary provisions
This decree provides:
(a) requirements for the extent of analysis of the possibilities of unauthorised activities and for any attack on an object;
(b) the category and nature of the arrangements;
(c) physical surveillance requirements;
(d) the categories and definitions of technical means; and
(e) how to determine the scope of the security measures taken in the building.
Requirements for the extent of analysis of the possibilities of unauthorized activities and for any attack on the object
[Paragraph 21 (5) (a) of the Law]
Analysis of the possibilities of unauthorized activities and possible attack on an object shall include at least an assessment
(a) the activity of the operator;
(b) the operator's internal rules;
(c) operator's organisational and personnel structures;
(d) the operator's technical and technological equipment;
e) building solution of the building or equipment,
(f) the scope and structure of the supply and customer relations; and
(g) threats arising from the social situation and its development and from emergencies.
Category and nature of the arrangements
[Paragraph 21 (5) (b) of the Law]
(1) The arrangements are, according to their nature, permanent or complementary.
(2) The arrangements shall include at least:
(a) the definition of the part of the object or establishment or territory where the physical protection requirements apply;
(b) the entry and exit arrangements of persons, goods and means of transport on working and out-of-work time, including the identification of entrances and entrances and the exclusion of persons and goods which could clearly endanger the health and life of persons, cause damage to property or the environment or endanger the safety of the premises;
(c) the method of proving the right to enter and enter vehicles which allows them to be clearly identified;
(d) the definition of objects or equipment or parts thereof to which only authorised persons are permitted to enter;
(e) the means of keeping and keeping records of the introduction and removal of goods, the entry and exit of vehicles, the entry and exit of persons and the means of checking them;
(f) the procedure for receiving, storing, dispensing and moving items and the way in which they are protected against theft, damage and deterioration;
(g) operating mode ensuring continuity and safety of emergency operations; and
(h) the mode of handling keys, magnetic track or chip identification cards and other means used to control lock mechanisms.
(3) The supplementary arrangements include emergency measures and procedures, in particular:
(a) limitation of entrances to premises and installations for a specified period for a defined circle of persons;
(b) temporary blocking of specified passages;
(c) requiring an increased identity of persons;
(d) periodic checks of objects; and
(e) the availability of security personnel.
Physical surveillance requirements
[Paragraph 21 (5) (c) of the Law]
Physical surveillance shall include at least:
(a) the means of ensuring the security of the premises or equipment, in particular by contracted security services or by its own staff;
(b) the manner in which physical surveillance is carried out, in particular at a fixed post, by patrol or by combination;
(c) the scope of the surveillance of the object or equipment, in particular the whole or part of the object or equipment; and
(d) the physical surveillance procedure in the event of an emergency at the premises or facilities.
Categories of technical means and their definitions
[Paragraph 21 (5) (d) of the Law]
(1) The technical means are mechanical means of defence and electronic tracking and alarm devices.
(2) Mechanical means of defence include, in particular, fencing, grates, blinds or locks to such an extent and with such technical parameters as to create a system of barriers which, by design and mechanical resistance, will meet the safety functions laid down by Czech technical standards.
(3) Electronic tracking and alarm devices include, in particular, camera and access systems, electrical fire alarm systems, alarm protection and distress systems, equipment for the detection of hazardous gases and vapours, equipment limiting the extent of leakage of dangerous substances, special technical measures against tampering or a rapid shutdown system of an object or device to such an extent as to provide protection for persons and objects that allow timely and effective action in a disturbed object or device.
Method of determining the extent of the security measures taken in the object
[Paragraph 21 (5) (e) of the Law]
The security measures provided for in Sections 3 to 5 shall be carried out on the basis of the results of an analysis of the possibilities of unauthorised activities and an attack on objects or equipment to such an extent as to ensure effective protection of the object from unauthorised activities and from attack.
Efficacy
This Decree shall take effect on 1 October 2015.
