laying down the procedure for the establishment and removal of an emergency in heating
The Ministry of Industry and Trade provides pursuant to § 98 (7) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the amendment of certain laws, hereinafter referred to as "the Act ', for the implementation of § 88 (4) of the Act:
Scope, manner and conditions of restrictions or interruptions
(1) The extent and manner of the restriction of supply in the event of the occurrence or in the event of an emergency, is determined by the holder of a licence for the production of heat energy or for the distribution of heat energy (hereinafter referred to as the "licence holder") in the form of regulatory degrees.
(2) The inclusion of sampling points in the regulatory stages shall take into account the urgency of the heat supply, in particular in terms of health, food, education, economic mobilization entities or other entities, in accordance with crisis plans. The inclusion of the sampling points in the regulatory stages shall be carried out after consultation with the relevant regional crisis authorities.
Removal of emergency consequences
The procedure for the removal of the consequences of an emergency and the restoration of supply shall be governed by the arrangements drawn up by the licence holder in emergency plans. Emergency plans shall be processed for systems above 10 MW.
Emergency plan
(1) The accident plan of the holder of the licence for the production or distribution of heat energy contains:
(a) description and arrangement of heat energy sources and distribution facilities;
(b) the powers and responsibilities of the staff of the licence holder in charge of the management at each stage of the procedure;
(c) a description of typical and anticipated working arrangements in emergency situations;
(d) a plan to limit the heat collection from sources and distribution of heat energy for each sampling point;
(e) the procedure for reducing consumption;
(f) the procedure for the renewal of supplies;
(g) the means of notification of an emergency declaration to the employees of the licence holder, to the customers and to the relevant crisis authorities and to the competent public authorities in the territory.
(2) Emergency plans shall be deposited with the holder of the licence for the production and distribution of heat energy and shall be provided in written or electronic form to the operational centre of the integrated rescue system and to the processor of the crisis plan.
Repeal
Decree No. 155 / 1996 Coll., on dealing with emergency in heating is hereby repealed.
Efficacy
This Decree shall take effect on 1 January 2002.
