THE LAW
of 14 September 1999
amending certain laws in connection with the adoption of the Law on Occupational Soldiers
Parliament has decided on this law of the Czech Republic:
Act No. 582 / 1991 Coll., on the Organisation and Implementation of Social Security, as amended by Act No. 590 / 1992 Coll., Act No. 37 / 1993 Coll., Act No. 160 / 1993 Coll., Act No. 307 / 1993 Coll., Act No. 241 / 1994 Coll., Act No. 118 / 1995 Coll., Act No. 160 / 1995 Coll., Act No. 134 / 1997 Coll., Act No. 306 / 1997 Coll. and Act No. 93 / 1998 Coll., is amended as follows:
1. In Article 9, at the end of paragraph 2, the dot is replaced by a comma and the following point (c) is added:
"(c) is a member of the armed forces who has fulfilled the conditions for entitlement to a service allowance under a special legislation. 73)
73) § 132 et seq. of Act No. 221 / 1999 Coll., on Professional Soldiers. '
2. In Section 112, "§ 108 and 109 'is replaced by" § 109';
In Paragraph 4 (1) (o) of Act No. 586 / 1992 Coll., on Income Taxes, including footnote 3, the following is added:
"(o) service and housing allowances for professional soldiers and claims related to the termination of service of members of the security corps and services and members of the customs administration of the Czech Republic, under special legislation, 3)
3) For example Act No. 221 / 1999 Coll., on professional soldiers, Act No. 186 / 1992 Coll., on the service relationship of members of the Police of the Czech Republic, as amended, Act No. 154 / 1994 Coll., on the Security Information Service, as amended by Act No. 160 / 1995 Coll. '
In Article 11 (3) of Act No. 48 / 1997 Coll., on Public Health Insurance and on the amendment and addition of certain related laws, the last sentence is replaced by the sentence which, including footnotes No 22a) and No 22b) reads: "For soldiers in active service, 22a) Except for soldiers in reserve called for military training, and for pupils in military schools, 22b) who prepare for the service of an occupational soldier and are not in active service, the Ministry of Defence will pay through the Military Health Insurance
(a) the difference between the amount of medical care paid or prescribed by the doctor or health care institution referred to in the second and third sentences, which is partly covered by public health insurance under this law, and the amount of remuneration granted by the Military Health Insurance Agency; This does not apply to the payment of dental products,
(b) preventive care provided in excess of the preventive care covered by the health insurance provided for in Section 29 to the extent provided for by the Ministry of Defence Decree.
22a) § 16 (2) and (3) of Act No. 218 / 1999 Coll., on the scope of the defence obligation and on the military administrative offices (the Defence Act).
22b) § 166 of Act No. 221 / 1999 Coll., on Professional Soldiers. '
Act No. 280 / 1992 Coll., on departmental, branch, corporate and other health insurance companies, as amended by Act No. 10 / 1993 Coll., Act No. 15 / 1993 Coll., Act No. 60 / 1995 Coll., Act No. 149 / 1996 Coll., Act No. 48 / 1997 Coll., Act No. 93 / 1998 Coll. and Act No. 127 / 1998 Coll., is amended as follows:
1. In Article 8, the following paragraph 3 is added, including footnote 5b:
"(3) The military health insurance company provides for the payment of health care paid by the Ministry of Defence under special legislation. 5b)
5b) Paragraph 11 (3) of Act No. 48 / 1997 Coll., on Public Health Insurance and on the amendment and addition of certain related laws, as amended by Act No. 225 / 1999 Coll. '
2. In Article 16, the following paragraphs 2 and 3 are inserted after paragraph 1, including footnote 16a:
"(2) The Military Health Insurance Corporation shall establish and manage, in addition to the funds referred to in paragraph 1, a fund for the payment of health care paid by the Ministry of Defence under specific legislation. 16a)
(3) A military health insurance company may create a fund for the payment of preventive care provided in addition to preventive care covered by health insurance for active duty soldiers and students of military schools.
16a) § 11 (3) of Act No. 48 / 1997 Coll., as amended by Act No. 225 / 1999 Coll. '
Paragraphs 2 to 5 shall be renumbered paragraphs 4 to 7.
3. In Article 16 (6), the following sentence is added at the end: "The Ministry of Finance shall, after consulting the Ministry of Health and the Ministry of Defence, lay down detailed conditions for the creation and use of the funds referred to in paragraphs 2 and 3. '.
Article I of Act No. 74 / 1990 Coll., laying down a new version of the military oath and the official oath of members of the National Security Corps and of the Correctional Education Corps, regulates the name of the Czechoslovak Army, regulates the proper leave of soldiers in the basic service and amends Act No. 40 / 1974 Coll., on the National Security Corps, is hereby repealed.
Article I of Act No. 77 / 1992 Coll., amending Act No. 76 / 1959 Coll., on certain service ratios of soldiers, as amended, and Act No. 100 / 1970 Coll., on the service ratio of members of the National Security Corps, as amended, is hereby repealed.
Article XII of Act No. 160 / 1995 Coll., amending and supplementing certain laws in connection with the adoption of the Pension Insurance Act, is hereby repealed.
This Law shall enter into force on 1 December 1999.
