DECLARATION
Ministry of Interior and Environment of the Czech Socialist Republic
of 14 December 1988
on national archives and archives of national committees
The Ministry of Interior and Environment of the Czech Socialist Republic provides, pursuant to § 31 paragraph 1 (g) of the Act of the Czech National Council No. 97 / 1974 Coll., on archiving ("the Act"):
State archives
(1) The state central archive in Prague is managed directly by the Ministry of Interior and Environment of the Czech Socialist Republic (hereinafter the "Ministry"). 1) The administration of national regional archives, which are set up for all regions and perform the function of expert body of the Ministry of Regional Archives, 2) is entrusted to the Regional Administration of the National Security Corps as regards the State Regional Archive in Prague Sjód to the National Security Council of Prague and the Central Bohemian Region. 3)
(2) The State Regional Archives are entrusted with the function of a specialised body of the Minister4) for corporate archives. For the company archives established in the territory of the capital city of Prague, this function is entrusted to the State Regional Archives in Prague, which also oversees the decommissioning (shredding) of documents resulting from the activities of the organisations which have set up these archives; 5) these mandates do not apply to the organisations of the National Committee of the Capital City of Prague and the company archives set up there.
(3) The function of the Ministry of Regional and Business Archives' expert body lies in the methodological management of these archives and in the supervision of their activities in the shredding process, in the taking up, recording, ensuring their protection and making them available and using them in general, as well as in the discussion of the work plans of those archives and in the monitoring of their implementation.
(4) The working plans of the State Archives are approved by the Ministry, to which reports of their implementation are also submitted.
Archives of national committees
(1) National committees are required to ensure the conditions for the operation of archives administered by them. (6)
(2) The archive of the capital city of Prague, which acts as a national regional archive for the territory of the capital city of Prague, 7) is entrusted with the function of the professional body of the Ministry of Business Archives set up by the organizations of the National Committee of the capital of Prague.
(3) The work plans of the archives of the national committees, which include the tasks assigned by the Ministry, are approved by the national committees. Regional archives and archives of the cities of Brno, Ostrava and Plzeň shall submit plans as well as reports on their implementation to the national regional archives for information; The archive of the capital Prague presents its plans and reports on their implementation to the Ministry.
(4) The scope and level of the scientific research activity of this archive in the field of archiving and related scientific disciplines and the importance and quantity of archival activities that the archive takes care of are crucial for the recognition of the constitution8). If the conditions laid down by law and by this decree for the granting of the status of the Institute are waived, the Ministry shall withdraw its consent and the National Committee shall withdraw its designation as the Institute.
Common provisions
(1) The management within the meaning of this Decree is to ensure the operation of national archives and archives of national committees on the basis of cadre, personnel, financial, material technical and investment.
(2) Where territorial changes or changes to the territorial competence of national committees affect a significant proportion of national archives and archives of national committees, the Ministry shall decide on a further way of ensuring effective management of the archives after the national committees concerned have expressed their views.
(3) The designation of the national regional archives is supplemented by the name of the archiva.9) The archives of the national committees shall use a name derived from the title of the seat of the national committee, supplemented by the title of the seat of the archive. 10)
(1) The Director of the State Archives and the Director of the National Committee Archives shall direct the activities of the subordinate staff of the archive and shall be responsible for the proper storage, clarity and processing of the archives. He shall in particular:
(a) to ensure the supervision and use of the disposal (shredding) of documents, taking over, recording, making available and protecting archives;
(b) to provide additional tasks for archives from scientific research activities in the field of archiving and related sciences;
(c) ensure the establishment of annual and long-term plans for archival activities and ensure that all tasks arising from the plan are carried out.
(2) The Director of the State Regional Archive and the Director of the Archive of the City of Prague also provide the tasks arising from the provisions of Sections 1 (3) and 2 (2) respectively; the Director of the Archive of the National Committee also provides for the performance of professional archival and scientific tasks or other tasks, 11) imposed by the National Committee (§ 2 (3)).
Authorised officials of the Ministry and of State Archives shall be entitled to enter the archives of the National Committees in the performance of professional archival supervision as well as to enter the files of organisations where the State Archives oversee the decommissioning (shredding) of documents. They shall also be authorised, as well as authorised personnel of the archives of the national committees, to enter the files of organisations in which they supervise the elimination (shredding) of documents by the archives of the national committees. 12)
The organizational order of the National Central Archive in Prague is issued by the Ministry; the organizational order of the State Regional Archives is issued by the Regional Administration of the National Security Corps in Prague, after consulting the Ministry on the basis of the model organizational order of the State Regional Archive issued by the Ministry. The rules of organisation of the archives of the National Committee shall be issued by the National Committee which manages it.
Final provisions
The Directives of the Ministry of Interior of the Czech Republic No 12 / 1975 Ú. v. ČSR, on State Archives and the Directives of the Ministry of Interior of the Czech Republic No 13 / 1975 Ú. v. ČSR, on the archives of national committees are repealed.
This decree shall take effect on the day of its publication.
