DECLARATION
of 14 July 2017
amending Decree No. 368 / 1999 Coll., laying down the formalities and number of photographs required under the Act on the residence of foreigners, as amended
The Ministry of Interior provides pursuant to § 182 paragraph 1 (a) of Act No. 326 / 1999 Coll., on the residence of foreigners in the Czech Republic and on the amendment of certain laws, as amended by Act No. 222 / 2017 Coll.:
Decree No. 368 / 1999 Coll., laying down the formalities and number of photographs required under the Act on the residence of foreigners, as amended by Decree No. 363 / 2001 Coll., Decree No. 198 / 2004 Coll., Decree No. 164 / 2006 Coll. and Decree No. 416 / 2006 Coll., is amended as follows:
1. In Paragraph 1, the following sentence is added at the end of paragraph 3: "The person depicted shall be in the photograph without glasses with dark glasses, except for the blind, and without headgear, except where the person uses it for health or religious reasons. The glasses of the person in the photograph shall not cover the eyes and create reflections; the headgear shall not cover the facial part in a way that makes it impossible or difficult to identify a person and to create shadows on the face. ';
2. Paragraph 2, including the title and footnotes 1 and 2, reads as follows:

(a) one photograph for the application for:
1. issuing a visa for stay over 90 days;
2. the issue of a long-term or permanent residence permit;
3. extension of long-term residence permits;
4. issue of a residence permit in the event of a change in the form of a licence holder;
5. the issue of a residence permit by replacement for a lost, destroyed, stolen or damaged card;
6. the issue of a residence permit by a stranger who has been authorised to reside permanently on the territory before the age of 15;
7. the issuing of the travel document; or
8. Issue of a temporary residence certificate,
(b) two photographs for the application for
1. issuing a temporary residence permit for a member of the family of a citizen of the European Union, a citizen of a State which is bound by an international treaty negotiated with the European Union (1), which implies a right of free movement equivalent to that of a citizen of the European Union, or a citizen of a State which is bound by the Agreement on the European Economic Spaces2), which is not itself a citizen of that State,
2. Issue of a permanent residence permit, if it is a citizen of the European Union, a citizen of a State which is bound by an international treaty negotiated with the European Union (1), which implies a right of free movement equivalent to that of a citizen of the European Union, a citizen of a State which is bound by the Agreement on the European Economic Area (2), or a family member of a citizen of that State,
3. the issue of a residence card, a residence permit for foreigners or a permanent residence permit, where their validity cannot be extended, or where the form of the holder of such document is changed, if it is a citizen of the European Union, a citizen of a State which is bound by an international agreement negotiated with the European Union (1), from which the right of free movement is established equivalent to that of the citizens of the European Union, a citizen of a State bound by the Agreement on the European Economic Spaces2), or a family member of a citizen of that State; or
4. the issue of a residence card, a residence permit for foreigners or a permanent residence permit, a replacement for a document lost, destroyed, stolen or damaged, if it is a citizen of the European Union, a citizen of a State which is bound by an international agreement negotiated with the European Union (1), showing him the right to free movement equivalent to that of the citizens of the European Union, a citizen of a State bound by the Agreement on the European Economic Spaces2), or a family member of a citizen of that State.
1) For example, the Agreement between the European Community and its Member States, of the one part, and the Swiss Confederation, of the other part, on the free movement of persons.
(2) Annexes V and VIII to the Agreement on the European Economic Area and Decision of the EEA Joint Committee No 158 / 2007 of 7 December 2007 amending Annex V (Free movement of workers) and Annex VIII (Right of establishment) to the EEA Agreement. ';
Efficacy
This decree shall take effect on the 15th day following its publication.
