on certain details of the implementation of the common market organisations under the system of import and export licences and advance fixing certificates for agricultural products
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll.:
§ 1
Subject matter
This Regulation provides for certain details of the implementation of the common market organisations under the system of import and export licences (hereinafter referred to as "licences') and advance fixing certificates for agricultural products (hereinafter referred to as" certificates'), the adaptation of which is directly binding by the European Community1) (hereinafter referred to as "European Communities') to the Member States of the European Union.
§ 2
Request
(1) Licence applications or certificates (hereinafter referred to as "the application") under the rules of the European Community2 shall be submitted to the State Agricultural Intervention Fund (hereinafter referred to as "the Fund") in writing or in a way that allows remote access. The application shall be submitted in the Czech language.
(2) The request referred to in paragraph 1 shall be made using the form issued by the Fund.
(3) The particulars of the licence form and, where appropriate, the certificate to be completed by the Fund shall be completed in the Czech language.
§ 3
Execution of records and certificates of copy No 1 of the licence and certificate
(1) Entry into copy No 1 of the licence or copy No 1 of the certificate shall be made by the party concerned or the customs office responsible (3).
(2) The record and confirmation of copy No 1 of the certificate for agricultural products not listed in Annex 1 to the Treaty establishing the European Community shall be carried out by the Fond4).
§ 4
Additional proof to release the guarantee
Additional proof for the release of the guarantee provided for the purposes of the issue of a licence or certificate, where applicable, in the cases provided for by European Community rules (5) is the control copy T5.6)
§ 5
Registration of importers
(1) An importer wishing to benefit from a reduced duty rate under a tariff quota for imports of certain agricultural products in accordance with European Community rules (7) shall apply to the Fund for registration.
(2) The importer referred to in paragraph 1 shall add to the application for registration:
(a) a document certifying that he is an entrepreneur under special legislation, 8)
(b) a copy of the document confirming the allocation of the tax identification number.
§ 6
Efficacy
This Regulation shall enter into force on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union.
