laying down rules on the allocation of heat energy supply costs to individual sampling points
According to Section 98 (7) of Act No. 458 / 2000 Coll., the Ministry of Industry and Trade provides for the implementation of Section 76 (3) (e) of the Act in respect of the conditions of business and the performance of state administration in the energy sector and the amendment of certain laws, hereinafter referred to as "the Act":
Distribution of heat energy supply costs
(1) The cost of the supply of heat energy is charged by the holder of the production or distribution licence to the customer for each point of demand agreed in the heat supply contract.
(2) The collector shall be a natural or legal person and, where appropriate, more than one person, where their heat collection equipment is technologically connected and is part of a single unit of account.
(3) The unit of account in which the heat energy costs between final consumers are to be accounted for consists of an object or part of it or, where appropriate, objects or parts thereof which have one common, technologically connected heat collection device.
(4) The heat energy supplied shall be charged according to the method of connection at the delivery sampling point and the purpose of its use in the heat sampling device.
(a) separately for heating;
(b) separately for the preparation of hot commercial water;
(c) separately for purposes other than heating and hot water preparation;
(d) jointly for the purposes referred to in (a) to (c).
(5) Where persons who own objects or parts thereof which have one common, technologically connected demand heat installation agree with each other and subsequently agree with the supplier on the method of discharging the costs that fall into each object or part of it, the supplier shall account for the supply of heat energy to each person becoming its customer, the common collection point of supply for all such customers being a common clearing point. If these persons do not agree with each other, the supplier shall charge the cost of supplying heat energy to individual objects or parts of them in proportion to the floor area.
Allocation of the costs of preparing and supplying hot commercial water to individual sampling points when measuring heat energy together for several units of account
(1) The accounting point for the supply of hot commercial water shall be the joint preparation centre for several sampling points.
(2) The costs of preparing and supplying hot commercial water at the point of account include payments made to ensure delivery to all points of demand at the prices agreed in the contract under the applicable price regulations.
(3) The cost of heat energy for the preparation of hot water for use in the joint preparation plant is divided into essential and consumer components. The basic component is 30%, consumption 70% of costs.
(4) The base component shall be divided into units of account by floor area of each unit of account.
(5) The consumption component of the heat energy costs for the preparation of hot commercial water and the cost of the supply of drinking water for the preparation of hot commercial water and its sizing shall be distributed in proportion to the sum of the water meters in the units of account; if the measurement of hot utility water collection at the entry into the unit of account is installed, the measurement shall be used.
(6) The method of transmission and verification of the data referred to in paragraphs 4 and 5 shall be agreed between the customers and the supplier in the heat energy supply contract.
(7) If the water-meters data referred to in paragraph 5 are known only for certain units of account, the consumption component of the costs that falls on the set of units of account with known measurement data and on the set of units of account without known measurement data shall be calculated in accordance with the formulae set out in the Annex. The consumption component of the set of units of account with known measurement data shall be divided into each unit of account referred to in paragraph 5 and the consumption component of the set of units of account where the measurement data is not known shall be divided into individual units of account by floor area.
(8) When installed at the point of sampling for the supply of hot commercial water at the entrance to all units of account, the quantity of heat collected in hot commercial water as well as the quantity of hot commercial water taken in accordance with metrological regulations, the supplier shall charge the supply to customers according to this measurement at the agreed price at the point of measurement.
(9) If the results of the measurements are unreliable on the basis of its evaluation, the consumption component of the costs shall be divided by floor area. Such measurement results shall be considered unreliable for these purposes when the sum of the measurement data from all the units of account referred to in paragraph 5 differs from that of the measuring equipment in common hot water preparation by more than 15%, provided that the measuring equipment in common preparation is measured to an accuracy specified by the special Regulation (1).
Repeal
Decree No. 245 / 1995 Coll., laying down the rules for heating and supply of hot water, including the breakdown of costs for buildings and between final consumers, and Decree No. 85 / 1998 Coll., amending and supplementing Decree No. 245 / 1995 Coll., are hereby repealed.
Efficacy
This Decree shall take effect on 1 January 2002.

Calculation of consumption components of hot water supply (TUV) from its joint preparation for units of account
The consumption components of the costs that fall on the units of account where the consumption of hot commercial water is measured and where the consumption of hot commercial water is not measured or where the measurement data is not known shall be calculated according to the formulae:
Sm = Sc. K / (K + 1)
Sn = Sc - Sm
K = Mm / Mn
Mn = Mc - Mm
Meaning of designation:
Mc.... the quantity of TUV delivered, measured in the joint preparation room of the TUV determined by the measuring instrument in trade,
Mm... the amount of TUV collected by measuring consumption in the units of account for the same period of time as Mc,
Mn... the quantity of TUV collected that falls on units of account where no measurement or consumption is unknown,
Sc, Sm, Sn... cost consumables corresponding to Mc, Mm, Mn.
