GOVERNMENT REGULATION
of 13 August 1997
on the amount and manner of the disposal of radioactive waste agents into a nuclear account
The Government orders pursuant to § 27 (5) of Act No. 18 / 1997 Coll., on the Peaceful Use of Nuclear Energy and Ionizing Radiation (Atomic Act) and on the amendment and addition of certain laws:
From the sources of radioactive waste from nuclear power plants
(1) The basis of the contribution from the producers of radioactive waste operating nuclear power plants is the average annual generation of electricity measured at generator terminals, calculated by the average of the electricity actually produced over the last five calendar years preceding the calendar year for which the contribution is made.
(2) The rate of the levy shall be CZK 50 per megawatt hour from the base of the levy referred to in paragraph 1.
(3) The declaration of contribution shall be submitted by the producer of radioactive waste to the Radioactive Waste Management Board (hereinafter referred to as the Administration) no later than 15 January of the year for which the contribution is made (hereinafter referred to as the relevant period) on a form issued by the Administration.
(4) Payment shall be made in instalments due no later than the end of each calendar month at the latest at the rate corresponding to one twelfth of the annual contribution for the relevant period.
Departure from other radioactive waste agents
Other agents of radioactive waste are considered to be the source of small amounts of radioactive waste (1) and will pay a contribution to the nuclear account through the Administration in the form of reimbursement of the costs of storing radioactive waste on a one-off basis, after taking over their radioactive waste by the Administration.
Receipts
(1) A person requesting authorisation from the State Nuclear Safety Authority (hereinafter referred to as "the Authority") under the provisions of the Act, 2) where radioactive waste is to be generated, is required to register with the Administration as a future producer of radioactive waste.
(2) When carrying out the registration obligation referred to in paragraph 1, the following particulars shall be entered on the form issued by the Administration:
(a) the name and surname, birth number, permanent residence, place of business, identification number, activity details from which, in the case of an authorisation by the Office, radioactive waste would be generated and the expected type and quantity of such waste, if it is a natural person; or
(b) the name and legal form, the registered office, the identification number, the name, surname and permanent residence of persons having the status of statutory authority, the activity from which, in the event of an authorisation by the Office, radioactive waste would result and the type and quantity envisaged, if any, of the legal person.
(3) The Administration shall examine the information provided by the person requesting registration, invite it to be completed within a specified time limit, and shall then assign it a registration number which that person is obliged to give in all cases in contact with the Administration.
(4) The Administration shall keep a register of the payee's contributions in which it registers, if it is the natural person, name and surname, birth number, permanent residence, legal person, business name of the payer's contribution and its registered office, together with an identification number, an assigned registration number, the contract number between the originator and the Administrator, (3) the amount of the contribution, the amount of the payments for the period in question, the date on which the individual contributions are credited, or, where applicable, payments to the nuclear account and their amount.
(5) The record of the payer's contributions must be kept for the entire duration of his obligation to transfer funds to a nuclear account and archived for at least five years after the end of that obligation.
Transitional and final provisions
(1) The obligation to register and submit a declaration of contribution under this Regulation also arises for the agents of radioactive waste already operating nuclear power plants on the date of entry into force of this Regulation, on the first day of the month following that in which this Regulation becomes effective. The payment for the calendar year during which this Regulation becomes effective shall be calculated at the rate set out in Article 1, less the proportion corresponding to the number of months from the beginning of the year to the end of the month in which this Regulation becomes effective. In this case, the amount of each instalment shall be equal to the contribution and the number of months remaining until the end of the relevant period, starting from the month following the month in which this Regulation became effective.
(2) Similarly, the procedure laid down in paragraph 1 shall be followed where the person liable to pay the levy arises or ceases to pay during the period concerned.
Efficacy
This Regulation shall enter into force on the day of its publication.
