DECLARATION
of 13 July 2011
on the establishment of protection zones of the 1st degree of natural mineral water sources taken by drilling BJ 321 (spring of St. Joseph) and BJ 331 (spring of Jaroslav) in the cadastral territory of Luhačovice and the definition of specific protective measures
According to § 46 (3) (b) of Act No. 164 / 2001 Coll., on Natural Medical Resources, Natural Mineral Water Resources, Natural Spa and Spa Areas and on the amendment of certain related laws (Spa Act):
Establishment of protection zones
(K § 21 (1) and § 22 of the spa law)
(1) In order to protect the natural medical source of mineral water of St. Joseph, which is struck by a drill BJ 321 on land parcel No 810 / 2 of the cadastral territory of Luhačovice, Zlín district, Zlín region (hereinafter referred to as "the source of St. Joseph"), a protection zone of the first degree is established.
(2) In order to protect the natural medical source of mineral water Jaroslav, which is contained in the BJ 331 well on the building parcel No 1544 / 3 of the cadastral territory of Luhačovice, Zlín district, Zlínský county (hereinafter "the source of Jaroslav"), the protection zone of the first degree, which is at the same time a zone of physical protection of the source, is established.

(1) The protection zone of the 1st stage of the source of St. Joseph is the immediate surroundings of the source of St. Joseph and it is defined by the plots of land No 810 / 2 and 815 / 3 and the building lot No 1519 of the cadastral territory of Luhačovice.
(2) The first tier protection zone of Jaroslav's source consists of the immediate vicinity of Jaroslav's source and is situated on the construction areas 1544 / 3 and 1544 / 2 and land areas 816 / 5 and 816 / 8 of Luhačovice's cadastral territory.

The definition of the protection zone of the first stage of the source of St. Joseph is graphically marked in a copy of the cadastral map in the scale 1: 1 000, which is Annex 1 to this decree, and the definition of the protection zone of the first stage of the source of Jaroslav is graphically marked in a copy of the cadastral map in the scale 1: 1 000, which is Annex 2 to this decree. The definition of first-degree protection zones in copies of cadastral maps is available at the Ministry of Health, the City Office in Luhačovice and the Regional Office of the Zlín Region.
Definition of specific safeguard measures
(K § 22 of the spa law)
(1) Parking of motor vehicles outside the designated parking lot with reinforced surfaces and equipped with sewerage with oil separator is prohibited in the first stage of the protection zone of St. Joseph's source.
(2) In the protection zone I of the source of St. Joseph's must be prevented from flushing surface water from adjacent local communication located on parcel No 815 / 1 in the cadastral territory of Luhačovice into the valley floods by adjusting the perimeter with the curb.
(3) In the protection zone I. of the source of St. Joseph, parking of vehicles on the unpaved and uncleaned area north of the building of the church on the plots of land No 810 / 2, 815 / 1 and 815 / 3 in the cadastral territory of Luhačovice must be avoided by setting up the roadblocks and a continuous belt of bushes.
Transitional provision
The measures referred to in Article 4 (2) and (3) must be built for reasons of protection in the first instance within 1 year of the date of entry into force of this Decree at the expense of the source user.
Efficacy
This Decree shall take effect on the first day of the second calendar month following its publication.
