DECLARATION
of 2 July 2024
amending Decree No. 264 / 2020 Coll., on the Energy Performance of Buildings
The Ministry of Industry and Trade provides pursuant to § 14 (4) of Act No. 406 / 2000 Coll., on Energy Management, as amended by Act No. 165 / 2012 Coll., Act No. 318 / 2012 Coll., Act No. 310 / 2013 Coll. and Act No. 103 / 2015 Coll., for implementation of § 7 (7) and § 7a (6) of Act No. 406 / 2000 Coll., on Energy Management, as amended ("Act '):
Decree No. 264 / 2020 Coll., on the Energy Performance of Buildings, is amended as follows:
1. In Paragraph 2 (g), the words "work or 'are replaced by the words" work'.
2. In Article 2 (j), the words "its amount is calculated using primary energy factors from non-renewable energy sources' are deleted.
3. in Article 2 (k) and (l):
"(k) the technology of an installation whose energy consumption is not included in the total energy delivered to the evaluated building and is not part of the technical systems of the building;
(l) waste heat from thermal energy technology, which is produced as a by-product of the transformation and final consumption of energy in connection with the operation of the technology and which can be used as an energiser for partial energy supplied if the production of that heat energy has not been included in the total energy supplied to the evaluated building; ';
4. In Article 2, at the end of point (m), the dot is replaced by a comma and the following points (n) to (q) are added:
"(n) an interconnected set of buildings, technical systems of buildings, technologies and energy generation and management facilities located on land or land adjacent to each other; individual plots of land may be separated from each other by, for example, infrastructure, special purpose roads, watercourses or railways; the external borders of the land or sets of land form the boundaries of the site,
(o) a building zone or part thereof with similar characteristics of the indoor environment, the use regime and the composition of the technical system of the building according to the Czech technical standard governing the calculation of heating and cooling needs (2);
(p) the system boundary of the construction surface of the building, which continuously covers the volume of the whole part of the building in application of the rules of the Czech technical standard governing the energy performance of the building 8),
(q) electricity generation for the own consumption of electricity production under the Energy Act located on the site and intended for the production of electricity for consumption on the site. '
5. In Article 3 (2), the words "technical construction 'shall be inserted after the words" present'.
6. In Article 3, the following paragraph 8 is added:
"(8) Where electricity from the production of the own-account electricity placed on the premises is also supplied to the evaluated building, the electricity thus supplied may also be taken into account in the calculation of the energy performance indicators of the assessed building; In such cases, the energy performance calculation rules set out in Annex 6 to this Decree shall apply for the calculation of the energy performance values of the assessed building. ';
7. In Article 4 (1), the word "Delivered 'is replaced by" Value delivered', the words "values' are inserted after the word" Calculation ', the words "calculation method with interval' are replaced by the words" in time interval ("calculation step ')' and the words" performed with interval 'are replaced by the words "step'.
8. Paragraph 4 (2) reads as follows:
"(2) The total value of the energy supplied shall be determined by the sum of the values of the sub-energy supplied; the calculation of the total energy delivered shall also include the determination of the total energy delivered by individual energisers. ';
9. In Article 4 (3) to (8), the words "sub-delivered 'are replaced by" Value of sub-delivered'.
10. in Paragraph 4 (9) of the introductory part of the provision, the word "values" shall be inserted after the words "When calculating."
11. in Article 4 (9) (a), the word "energy" shall be inserted after the word "part."
12. In footnote 8, "Part B 'is deleted.

Calculation of primary energy from non-renewable energy sources
(1) The value of primary energy from non-renewable energy sources for the rated building is calculated as the sum of the product of the values of the energy supplied determined in accordance with Section 4, in the breakdown by energy-carriers and the relevant primary energy factors from non-renewable energy sources listed in Annex 3 to this Decree.
(2) When calculating the value of primary energy from non-renewable energy sources of the evaluated building, account may be taken of:
(a) energy produced for its use in the rated building by technical systems located within the system boundary of the rated building, on the rated building, on the land immediately adjacent to the building, on the premises or on ancillary buildings of the type of shelter for parking, fencing, supporting walls or reinforced areas serving the rated building;
(b) the electricity produced by the technical systems referred to in (a) up to its use
1. in the evaluated building,
2. outside the rated building by supplying it to the electricity system; or
3. outside the rated building by its delivery to the premises in accordance with Annex 6 to this Decree;
(c) heat and cold produced in the local heat and cold supply system, provided that the evaluated building is connected to it; in this case, the calculation shall be carried out in accordance with the methodology set out in Annex 5 to this Decree;
(d) heat and cold produced by the technical systems referred to in (a) and supplied to the heat supply system, up to a maximum of the value of the total energy delivered in the evaluated building.
(3) Electricity produced by the technical systems referred to in paragraph 2 (a) shall be included in the calculation of the value of primary energy from non-renewable energy sources of the evaluated building only for one building or, if the electricity supplied pursuant to Paragraph 3 (8) for several buildings is taken into account, in accordance with the rules set out in Annex 6 to this Decree.
(4) The energy referred to in paragraph 2 (b) shall be counted at each step of the calculation.
(5) Primary energy from non-renewable energy sources for the reference building is calculated
(a) multiplying the calculated values of energy consumption and auxiliary energy for each technical system by the primary energy factors of non-renewable energy sources by the types of consumption listed in Table 4 of Annex 1 to this Decree; and
(b) by reducing the value of primary energy from non-renewable energy sources determined in accordance with point (a) by the value given in Table 5 of Annex 1 to this Decree. ';
14. in Paragraph 9 (2) of the introductory part of the provision, the word "licence" shall be inserted after the word "Protocol."
15. Paragraph 9 (7) reads:
"(7) If there are only residential zones in the rated building, the cooling sub-energy classification class shall not be determined. In other cases, partial energy delivered for cooling shall not be considered for cooling in the residential areas of the assessed building when determining the classification class. ';
16. In Article 9, the following paragraph 8 is added:
"(8) Where energy from an area referred to in Article 3 (8) is taken into account, the protocol for the certification of the balance of primary energy from non-renewable energy sources shall include the area processed in accordance with Annex 7 to this Decree in the form of an annex to the Protocol. ';
17. In Annex 1, in the text section above Table 1, the following paragraphs 8 and 9 are added:
"(8) The power consumption of the SFPah fan for a specific working point at each step of calculating the energy performance of the building to determine the energy consumption of its operation shall be calculated using the formula:

(9) The ratio of the transported volume to the rated fan capacity r shall be calculated as:

The balance, set is the average volume of air transported behind the calculation step (hour) for a given fan in m3 / hour.
Weight, max is the nominal volume of air transported for the fan in m3 / h.
SFPah ratio, set / SFPah, max is limited by interval < 0; 1 >. '
18. In Annex 1, the heading above Table 1 reads: "Table 1: Parameters and values of the reference building '.
19. In Annex 1, Table 1, in the first row, the headings "Parameter '," Markings', "Units' and" Reference value 'are marked in bold.

27. In Annex No 1, Table 1, the parameters and values of the reference building in the fourth column headed "Reference value 'in the third row of the parameter headed" Moisture adjustment' is replaced by "20 '.
28. In Annex No 1, Table 1, the parameters and values of the reference building in the first column marked "Parameter 'in the fifth and sixth rows below the internal heading" Lighting of the interior of the building' at the end of the parameter, the words "in the monthly calculation step 'are added.

"If the design documentation for the construction of the new building does not include a lighting system project or its technical specifications, the input lighting parameters of the interior of the building shall be considered to be identical to those of the reference building and in accordance with the parameters of typical use. ';
44. In Annex 5 Methodology for the evaluation of the energy performance of the building, Part D. Sub-supplied energy, Chapter D.1 In the sentence, the first words "ČSN 730331-1 Part B.3 'are replaced by" ČSN 730331'.
45. In Annex 5 Methodology for the evaluation of the energy performance of the building, Part D. Sub-supplied energy, Chapter D.1 The residential areas of points 2 and 3 are as follows:
'2. In the case of the use of multiple heat sources in one zone, the share of the supplied energy covered by the relevant supplementary heat source shall be set at a maximum value according to Table A.1 of the standard ČSN 730331-1, except for the use of supplementary hot water heating or heating against hot water heating or heating by a bivalent heat pump, for which the ratio can also be calculated in the hourly calculation step on the basis of the power curves of the heat pump used.
3. The number of persons is determined according to ČSN 730331 and rounded to integers. A maximum of 5 persons shall be counted per housing unit. ';
46. In Annex No. 5 Methodology for evaluating the energy performance of the building, Part D. Subsupplied energy at the end of Chapter D.1 the following point 4 is added:
"4. When the installed technical ventilation system is regulated to a higher ventilation intensity than that of the ČSN 730331, the calculation shall take into account the value corresponding to the actual or proposed regulation of the ventilation system. ';
47. In Annex 5 Methodology for the evaluation of the energy performance of the building, Part D. Sub-supplied energy, Chapter D.2 Other than residential zones, the first unmarked paragraph of the text shall read:
"For non-residential zones, an individual typical usage profile shall be created which takes into account the design time profile of the building use, the design occupancy of the building, the size and manner of regulation of the technical equipment of the building, or other marginal conditions defined by the project. Individual typical usage profile can be created by adjusting the input values of typical usage profiles according to ČSN 730331."
48. In Annex 5 Methodology for the evaluation of the energy performance of the building, Part D. Sub-supplied energy, Chapter D.2 In the second paragraph of the text, other than residential zones, the words "and at the same time the project documentation 'are not available and the words" ČSN 730331-1, Annex B' are replaced by "ČSN 730331 '.
49. In Annex 5 Methodology for the evaluation of the energy performance of the building, Part D. Sub-supplied energy, Chapter D.2 In point 1, other than residential zones, the words "In case of modification of the profile of typical use of the building referred to in ČSN 730331-1, Annex B is replaced by the words" Input, "after the words" Interior, "the words" Quality, "and the words" Quality. 57. In Annex 5, the methodology for assessing the energy performance of the building part E. The calculation of the energy performance of buildings located in areas with a local heating and cold supply system is:
"E. Calculation of the energy performance of buildings with local heating and cold supply systems
1. Where heat or cold is supplied to the rated building from a source which is not located in the rated building and which is not part of the thermal energy supply system under the Energy Act, it is the supply of heat or cold through the local heat and cold supply system (hereinafter referred to as the "local system ').
2. The total energy delivered shall include losses in the production and distribution of heat or cold in the local system. It is based primarily on the annual energy efficiency of the local system as a whole (e.g. the average annual efficiency of heat, cold and electricity production and the average annual efficiency of the distribution system - distribution outside the building) or on the total annual fuel consumption of resources outside the rated building and the annual energy consumption on the feet of connected buildings and technological processes of the system. If this information cannot be ascertained (e.g. on the basis of a local survey or project documentation), an energy specialist may base his own calculations.
3. Where both the local system and the cogeneration plant which supplies heat energy to several buildings are included, the value of heat produced in that installation shall be included in the calculation of the value of primary energy from non-renewable energy sources of the rated building up to a maximum of the total heat supplied in the rated building. The chosen method of including the heat produced from the cogeneration plant shall be applied to all buildings connected to the local system in a uniform manner and the sum of the heat supplied to all buildings from the cogeneration plant shall not exceed the amount of heat produced from that installation.
4. Where both the local system and the cogeneration plant which supplies electricity to several buildings are part of the local system, Sections 3 (8) and 9 (8) of this Decree shall apply mutatis mutandis.
5. The calculation of the share of used electricity and heat for the rated building shall be documented in the energy performance certificate of the building. ';
58. The following Annexes 6 and 7 are inserted after Annex 5:
"Annex No 6
Rules for counting the production of electricity for own consumption on the premises into the energy performance of buildings on the premises
1. The calculation of the energy performance indicators of the assessed building and reference building shall be carried out in accordance with Sections 3 to 5 and Annex 5 to this Decree. In addition to those rules, the rules set out below shall be taken into account.
2. The captive electricity production to be taken into account in the calculation of the energy performance indicators of the evaluated building must be located in the same area as the evaluated building.
3. The total energy delivered and primary energy from non-renewable energy sources shall also include losses in the production and distribution or transport of electricity produced.
4. The calculation of losses shall be based on the annual energy efficiency of the supply of electricity on the site as a whole provided by the operator. If this information cannot be ascertained, the energy specialist may come from his own calculations.
5. The calculation of the primary energy balance from non-renewable energy sources of the building is carried out with connection to buildings and power plants located on the premises. Data on these buildings and power plants shall be included in the balance of primary energy from non-renewable energy sources of the site to the extent specified in Annex 7 to this Decree.
6. In order to be included in the balance of primary energy from non-renewable energy sources of the site, the rated building or power plant for self-consumption shall be:
(a) identical to the owner of the site, other buildings and the production of electricity for own consumption included in the balance of primary energy from non-renewable energy sources of the site; or
(b) the owner of at least 30% of the owner of the site, other buildings and the generation of electricity for own consumption included in the primary energy balance of the site's non-renewable energy sources; or
(c) the owner of at least 30% of the capital or voting rights of the owner of the site, other buildings and the generation of electricity for own consumption included in the balance of primary energy from non-renewable energy sources of the site.
7. The electricity produced by the production of electricity for own consumption located on the site may be included in the calculation of the primary energy balance from non-renewable energy sources of several buildings located on the site. The allocation of the shares of the electricity produced from the captive electricity plant to individual buildings for the purpose of calculating the primary energy balance of these buildings' non-renewable energy sources shall take place regardless of the actual flows of electricity. The sum of the allocated electricity values for the calculation of the primary energy balance from the non-renewable energy sources of these buildings shall not exceed the total average annual production of electricity for own consumption from the own-consumption production of electricity placed on the premises and the building under assessment.
8. In the value of the primary energy from the non-renewable energy sources of the evaluated building, the electricity produced by the generation electricity for own consumption placed on the site may be included in the total annual energy supplied to the evaluated building.
