on the details of the granting of state authorisation for the construction of a power plant
The Ministry of Industry and Trade (hereinafter referred to as "the Ministry '), pursuant to § 98 (7) of Act No. 458 / 2000 Coll., on the terms of business and on the exercise of state administration in the energy sector and on the amendment of certain laws (hereinafter referred to as" the Act'), provides for the implementation of § 35 (4) of the Act:
Subject matter
This Decree sets out the details of the granting of State authorisation for the construction of an electricity plant, which are the elements of the applications for the grant, amendment, extension and revocation of the State authorisation for the construction of an electricity plant, including the design of applications, and the details of the conditions for examining such applications.
Application for State authorisation for the construction of a power plant
(1) The application for State authorisation for the construction of a power plant shall be submitted to the Ministry on the prescribed form for each power plant separately.
(2) The model of the application form for State authorisation for the construction of a power plant, including details of the conditions for completing the application, is set out in Annex 1.
Request for extension of State authorisation for the construction of a power plant
(1) An application for an extension of the State authorisation for the construction of a power plant shall be submitted to the Ministry on the prescribed form for each power plant separately.
(2) The model of the application form for extension of the State authorisation for the construction of a power plant, including details of the conditions for completing the application, is set out in Annex 2.
Request for revocation of state authorisation for the construction of a power plant
(1) The request to cancel the State authorisation for the construction of a power plant shall be submitted to the Ministry on the prescribed form for each power plant separately.
(2) The model of the application form for revocation of the State authorisation for the construction of a power plant, including details of the conditions for completing the application, is set out in Annex 3.
Notification of amendments
Changes to the data specified in the application for State authorisation for the construction of a power plant or other relevant data relating to the granted State authorisation shall be notified to the Ministry on the prescribed form, the model of which is set out in Annex 4. The amended data should be demonstrated.
Assessment of applications
When examining applications under Sections 2 to 4, account shall always be taken of:
(a) compliance with the State Energy Concept;
(b) to comply with the territorial energy concept, unless the territorial energy concept is processed for expression by a local or territorial competent authority of the state administration and self-government;
(c) the level of environmental protection, including air protection;
(d) the type and use of domestic primary energy sources;
(e) to compare the capacity of the electricity plant and the possibilities for the collection (disposal) of energy produced;
(f) the technical level and cost-effectiveness of the proposed electricity plant and its comparison with existing electricity plants;
(g) the impact of the electricity plant on the reliability and safety of the operation of the electricity system;
(h) the effectiveness and effectiveness of the proposed construction including the financing of the construction and the financial capacity of the applicant to carry out such construction;
(i) the accuracy, the veracity and the completeness of the documents submitted.
Final provisions
The forms of applications, the models of which appear in the Annexes to this Order, may be obtained at the Ministry or at the Regional Inspectorate of the State Energy Inspection. The forms shall also be published on the Ministry's website.
Efficacy
This decree shall take effect on the day of its publication.
