DECLARATION
of 15 October 2014
amending Decree No. 246 / 2001 Coll., laying down conditions for fire safety and performance of state fire control (Fire Prevention Order)
According to Section 101 (a) of Act No. 133 / 1985 Coll., on Fire Protection, as amended by Act No. 203 / 1994 Coll. and Act No. 237 / 2000 Coll., ("the Act '), the Ministry of Interior provides for the implementation of Section 6b of the Act:
Decree No. 246 / 2001 Coll., on the establishment of conditions of fire safety and performance of state fire control (Fire Prevention Order) is amended as follows:
1. In Article 2, at the end of paragraph 4, the dot is replaced by a comma and the following point (h) is added:
"(h) equipment to prevent fire or explosion."
2. In Article 4, at the end of paragraph 3, the dot is replaced by a comma and the following point (h) is added:
"(h) fire and evacuation elevators."
3. Paragraph 5 (6) reads as follows:
"(6) Where the conditions of the zoning decision provide for the submission of documentation for the implementation of the construction pursuant to a special legislation (12) (hereinafter referred to as" implementing documents "), the requirements set out in Section 10 (2) shall be met. '
4. in § 5 (7), § 6 (1), § 7 (2) and (4), § 8 (1) of the final part of the provision, § 10 (1) and in § 41 (2) (n) (6), the word "more detailed" shall be replaced by "implementing."
5. Paragraph 7 (1) reads as follows:
"(1) Prior to the entry into service of the fire safety equipment, except manually operated fire doors and fire closures of openings, systems and elements ensuring that the fire resistance of construction structures or the reduction of flammable materials, fire bulkheads and gaskets is increased, the person referred to in Section 6 (2) shall ensure that functional tests are carried out and, in the event of a collision of two or more interacting fire-fighting safety equipment, coordination functional tests. The functional tests shall verify that the performance of the fire safety equipment complies with the design and technical requirements for its fire safety function. The coordination functional tests shall verify that the fire safety function of the system as a whole complies with the design and technical requirements. ';
6. In the first sentence of Article 7 (3), the words "or coordination functional test 'shall be inserted after the words" functional test'.
7. In Article 7 (4), the words "and in the manner laid down 'are replaced by the words" established'.
8. In Article 7 (8), the word "written 'shall be inserted at the beginning of point (f) and the words" pursuant to Article 10 (2)' shall be replaced by the words "on the operation of the fire safety equipment '.
9. In the first sentence of Article 9 (2), the words "and in the manner laid down 'are replaced by the words" established'.
10. in Article 9 (8), the word "written" shall be inserted at the beginning of point (e) and the words "under Article 10 (2)" shall be replaced by the words "on the performance of the operational check."
11. The heading of Section 10 reads:
"Common requirements for the design and installation of fire safety equipment and fire extinguishers'.
12. in Paragraph 10 (1), the comma after the word "documentation" shall be replaced by "a," the words "and the check of operation" and the words "carrying out checks," shall be deleted;
13. In Article 10 (2), the words "and in writing confirm that it has complied with the conditions laid down by law, regulatory requirements and accompanying documentation of a manufacturer of a particular type of fire-fighting equipment or extinguisher 'are replaced by" and the conditions laid down in paragraph 1 are confirmed in writing'.
14. In Paragraph 10 (4), the comma after the word "planning 'is replaced by" a' and the words "and operational checks' are deleted.
15. In Article 17, the following paragraph 7 is added:
"(7) For the purposes of integrating the activities carried out into categories according to the degree of fire hazard:
(a) building for the assembly of more than one person - building with a space intended for the assembly of at least 200 persons, in which one person accounts for a floor plan area of less than 4 m2;
(b) construction for trade - construction which contains a total sales area of more than 2 000 m2;
(c) construction for persons with reduced mobility - construction or part of it intended for use
1. persons with a severe defect in the carrier or movement system, with severe auditory impairment, with severe visual impairment or with severe or deep mental retardation;
2. pregnant women or persons accompanying a child under the age of three; or
3. persons who have significantly reduced mobility or orientation in connection with the provision of health care;
(d) building of an accommodation facility - a building or part thereof, where temporary accommodation with a capacity of more than 20 beds is provided to natural persons. "
16. in Paragraph 18 (a), "underground bulk" is replaced by "e.g. underground bulk."
17. in Paragraph 18 (b), "production" is replaced by "e.g. production."
18. in Paragraph 18 (f), the words "to accommodate persons with reduced capacity" shall be replaced by the words "for persons with reduced capacity."
19. footnotes 25, 26, 27 and 28 are deleted, including the footnotes.
20. In Section 41, in the introductory wording of paragraph 2, the words "Fire safety solution, which is an integral part of the documentation for the issue of a building permit, shall be replaced by" Fire safety solutions or similar document, which is an integral part of the documentation or project documentation under a specific regulation, shall be replaced by "Fire safety solutions or similar document."
21. the words "and measures" shall be inserted after the words "fire safety."
22. in Paragraph 45, paragraphs 3 and 4 are deleted;
23. in Paragraph 51 (b):
"(b) documentation processed in connection with the inspection;"
24. In Annex 3, point 13, the words "State control 'are replaced by the words" Fire Protection and Control Act'.
Efficacy
This Decree shall take effect on 1 November 2014.
