on the procedure for the service evaluation of soldiers in reserve in service and its aspects
According to § 13 (2) of Act No. 45 / 2016 Coll., the Ministry of Defence provides:
§ 1
The staff evaluation shall include an assessment of the performance of the duties, the professional and psychological competence of the soldier in reserve in the service and its medical fitness and physical fitness. The service evaluation shall be carried out on a form the model of which is set out in the Annex to this Order. The staff evaluation shall be carried out in particular:
(a) prior to the assignment of a soldier in reserve to another post;
(b) prior to the appointment of a soldier in reserve on duty to a higher rank;
(c) on termination of service in the operational deployment of a soldier in reserve in the service; or
(d) prior to the issue of a further decision on the inclusion of a soldier in the service as an active backup.
§ 2
(1) The staff evaluation shall be based in particular on:
(a) an evaluation of the results of the training and the performance of other tasks of the unit in which the soldier is seconded to the service, in the event that he or she has participated or has participated in them personally;
(b) an assessment of the results of a soldier in the service in preparation or in the performance of specific tasks for the evaluation period, in particular the evaluation at the end of the basic preparation, the evaluation of the performance of the duties in the operational deployment, the evaluation at the end of career or professional courses.
(2) The supporting documents referred to in paragraph 1 shall be made known by the service authority which processes the service evaluation (hereinafter referred to as the "assessor") of the rated soldier in reserve in the service orally in the assessment of the individual tasks, or in writing where the soldier has expressed his opposition to the content of the oral assessment.
§ 3
(1) The staff evaluation always contains a conclusion which summarises the skills of the soldier in the service, performance of duties and tasks and recommendations for the next period.
(2) The professional evaluation to be carried out pursuant to § 2 (1) (a), (b) and (e) always contains, at the end, the opinion of the evaluator on the ability of the soldier in reserve in the service for the proposed measure.
(3) The evaluator shall without undue delay inform the rated soldier in the service with the service evaluation during the interview. If the findings of the interview result in the need to modify the professional evaluations, the evaluator shall carry it out on the spot. An ex-military in reserve on duty shall have the right to record his comments on the service evaluation. However, it is always required to confirm in writing that it has been informed of the service evaluation.
(4) In the event that the soldier expressed his disapproval of his / her content in his / her service evaluations, the assessor shall submit, without undue delay, the service evaluation and the supporting documents on which he / she was based to his / her nearest superior.
§ 4
Efficacy
This decree shall take effect on the 15th day following its publication.
