Ministry of Foreign Affairs
The Ministry of Foreign Affairs announces that on 11 March 1993 the Agreement between the Ministry of Transport of the Czech Republic and the Ministry of Transport, Communications and Public Works of the Slovak Republic on cooperation in the fields of inland navigation, maritime navigation, road transport and infrastructure was signed in Bratislava.
The Agreement entered into force on 11 March 1993 pursuant to Article 16 thereof.
The Czech version of the Agreement is hereby published at the same time.
AGREEMENT
between the Ministry of Transport of the Czech Republic and the Ministry of Transport, Communications and Public Works of the Slovak Republic on cooperation in the fields of inland navigation, maritime navigation, road transport and infrastructure
The Ministry of Transport of the Czech Republic and the Ministry of Transport, Communications and Public Works of the Slovak Republic (hereinafter referred to as the "Contracting Parties') agreed, on the basis of Article 6 of the Agreement between the Government of the Czech Republic and the Government of the Slovak Republic on cooperation in transport and communications of 23 November 1992:
Inland navigation
Inland navigation shall be governed by the laws of the State of the Contracting Party on whose inland waterways it takes place.
The Parties will cooperate in preparatory work on the construction of waterways connecting the territories of the Czech Republic and the Slovak Republic.
The licences of crew members and the relevant charter, issued by the authorities of one Contracting Party, shall be recognised by the authorities of the other Contracting Party.
Seagoing
The Ministry of Transport of the Czech Republic will provide effective assistance to the Ministry of Transport, Communications and Public Works of the Slovak Republic in ensuring the performance of the state administration in maritime navigation and in the establishment of the maritime office of the Slovak Republic.
Road transport
For the purposes of this Agreement, regular public passenger transport means the regular provision of bus transport services on a designated road route between the territories of the States of the Contracting Parties at which passengers board and perform at predetermined stops.
Applications for authorisation shall be submitted to the other Contracting Party through a Contracting Party in the territory of which the applicant has his registered office or residence.
The Contracting Parties shall ensure that the application for authorisation of scheduled public transport of persons includes the following information:
(a) the name and address of the carrier;
(b) the required period of validity of the authorisation;
(c) driving and rest periods for drivers;
(d) timetable;
(e) the exact route of the line (stops for boarding and leaving passengers, border crossings),
(f) length of the route in km;
(g) the maximum number of seats on the bus;
(h) transport and tariff conditions.
By 30 June 1993, the Contracting Parties shall mutually recognise their decisions on the type-approval of a vehicle type.
The Contracting Parties shall ensure the recognition in the territory of their State of decisions approving the technical competence of a vehicle issued by the competent authorities of the other Contracting Party by 30 June 1993.
The Contracting Parties shall ensure, in the territory of their States, the recognition of the relevant documents relating to vehicles which have been granted roadworthiness within the meaning of the provisions of Articles 6 and 7 which are issued by the manufacturer or his authorised representative or by the competent authority of the other Contracting Party.
The Contracting Parties shall ensure, in the territory of their States, the recognition of decisions approving the technical competence of equipment and components of vehicles issued by the competent authorities of the other Contracting Party until 30 June 1993.
The Contracting Parties shall ensure the recognition of decisions to permit the construction or conversion of a vehicle issued by the competent authority of the other Contracting Party until 30 June 1993.
The Contracting Parties shall ensure that the results of the roadworthiness tests of vehicles registered in the territory of a State of one Contracting Party are recognised, provided that they have been carried out before 28 February 1993 in the territory of the State of the other Contracting Party by the competent authorities of the State.
Ground communication
The Contracting Parties will cooperate in the classification of roads connecting the territories of the Czech Republic and the Slovak Republic into individual classes (especially "E" class roads), their marking and traffic census.
The Contracting Parties shall ensure that the competent authorities of the State are informed of changes and restrictions on road traffic connecting the territories of the Czech Republic and the Slovak Republic. If necessary, the Contracting Parties shall agree on a road route to the territory of their State.
The Contracting Parties shall coordinate the adaptation and maintenance of roads to border crossing points and the maintenance and repair of common border bridges.
Final provisions
This Agreement shall be negotiated for an indefinite period.
Each Contracting Party may terminate it in writing at any time. The period of notice shall be six calendar months and shall begin from the first day of the month following receipt of the statement to the other Contracting Party.
This Agreement shall enter into force on the date of signature.
Done at Bratislava, 11 March 1993.
This Agreement is drawn up in two copies, each in the Czech and Slovak languages, the two texts being equally authentic.
