amending Government Regulation No 63 / 2023 Coll., laying down conditions for the implementation of measures for the afforestation of agricultural land, as amended by Government Regulation No 44 / 2024 Coll., and Government Regulation No 72 / 2023 Coll., laying down conditions for the implementation of forest-environmental payment measures
The Government orders pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., Act No. 291 / 2009 Coll., Act No. 179 / 2014 Coll. and Act No. 382 / 2022 Coll., and § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Amendment of the Government Regulation on the conditions for implementing measures for afforestation of agricultural land
Government Decree No. 63 / 2023 Coll., laying down the conditions for the implementation of measures for afforestation of agricultural land, as amended by Government Decree No. 44 / 2024 Coll., is amended as follows:
1. In Paragraph 2 (3), the word "maximum 'is deleted.
2. in Article 5 (2) (g), the words "the Institute for the Economic Treatment of Forests" shall be replaced by the words "the National Forestry Institute";
3. in Article 5 (2) (l), the words "the amendment decision 'are replaced by the words" the authorisation of the amendment';
4. in Article 5 (2) (l), the word "territory (3)" shall be replaced by the words "territory under construction law."
footnote 3 is deleted.
5. Paragraph 7 (2) reads as follows:
"(2) An application for a reduction in the allocated area referred to in paragraph 1 shall be submitted by the applicant to the Fund as part of the application for a change of classification no later than 15 May of the relevant calendar year, together with the submission of the single application. ';
6. In Paragraph 7 (6), the sentence "Reducing the area of the soil block by up to 0,05 ha shall not be considered as a reduction in the area included shall be added at the end. '
7. Paragraph 7 (7) reads as follows:
"(7) During the period of the period of implementation of the multiannual conditions, an additional area may not be included in the area already classified under Section 6. For a new afforested area, the applicant must submit a declaration pursuant to § 4, an application for aid for the setting-up of forestry under § 5 and an application for inclusion under § 6. The implementation of multiannual conditions shall be assessed separately for a new wooded area for a new period of implementation of multiannual conditions. An increase in the area of soil block parts by a sub-area of up to 0,1 ha shall not be considered as an increase in the area covered. ';
8. In Paragraph 9 (3), "4 'is replaced by" 5'.
9. in Paragraph 10 (1) (b), "4 metres" is replaced by "5 metres."
10. In footnote 7, "Act No 183 / 2006 Coll. 'is replaced by" Act No 283 / 2021 Coll.';
Transitional provision
1. The procedure for the application initiated under Government Regulation No. 63 / 2023 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No. 63 / 2023 Coll., as effective before the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for implementing forest-environmental payment measures
Government Decree No. 72 / 2023 Coll., laying down the conditions for the implementation of forest-environmental payment measures, as amended by Government Decree No. 44 / 2024 Coll. and Government Decree No. 40 / 2025 Coll., is amended as follows:
In Article 5 (6), the words "the Institute for the Economic Treatment of Forests' are replaced by the words" the National Forest Institute '.
Efficacy
This Regulation shall take effect on 1 March 2026.
