of 10 March 1965
on the protection and the time, manner and conditions of hunting of certain species of game
The Ministry of Agriculture, Forestry and Water Management provides in an agreement with the Ministry of Education and Culture and after consulting the Czechoslovak Hunting Association pursuant to § 26 and § 30 (2) of Act No. 23 / 1962 Coll., on hunting:
Defending and hunting time
§ 1
Defence
(1) The following species of game are defended throughout the year:
(a) throughout the territory of the country, mountain camels, mountain goat, oatherless goat, European moose, mountain whiting, horseradish bear, river otter, large drop, silverfish and tetrash hens, wild chick, wild turkey, dill, wild dove, squid, all kinds of ducks (except for the species referred to in § 2 (1) (22), bernek, alfalfa, alfalfa (with the exception of § 3 (4)), sawdust, seaweed, understanding, eagles, sea bass and with the exception of § 3 (2) and (3), owls, oves, oatines, wood cane, seagulls, seagulls, seagulls and gfish;
(b) only in the Czech regions (with the exception of § 2 (1) No 10), wild cat, forest crane - faucet, cormorant (with the exception of § 3 (3));
(c) only in Slovakia, a squirrel and in a chase outside the separate and recognised pheasant pheasant hens.
(2) The following species of game are not protected:
(a) throughout the national territory, wild boar (except bachy and piglets), wild rabbit, wolf, wild fox, black raccoon, dark skew, pale skid, blue weasel, mussel rope, colt weasel, hawk, crab, crow (black and grey), black scabbardfish, blue scabbardfish and sea bass;
b) only in Slovakia a feature of the island and a great cormorant.
§ 2
Fishing time
(1) For the following species of game, the fishing period shall be as follows:
1. deer, deer and goat from 1 September to 31 December,
2. Sika deer, deer deer and deer goat from 1 October to 15 December,
3. Herring, deer, deer, deer, from 1 October to 15 December;
4. spotted, tanned and tanned from 1 October to 31 December;
5. muflon, muflonka and muflonče from 1 October to 31 December,
6. deer from 1 June to 15 September,
7th deer and deer from 1 September to 31 December,
8. Wild boar from 1 August to 31 December, wild boar - piglets from 1 August to 15 February,
9th field hare from 1 November to 31 December,
The 10th feature of the island of North Moravian Region from 15 December to the end of February,
11th badger from 1 August to 30 November,
12. kunas (forest and rock) from 1 December to the end of February,
13th wild cat in Slovakia from 1 October to end February,
14. musk ondatra from 1 October to 15 April (§ 12),
15th squirrel in Czech regions from 1 January to 31 January,
16th wild turkey - rooster from 16 March to 15 May,
17. Deaf grouse - rooster, female grouse - rooster from 16 March to 15 May,
18th forest crane - faucet in Slovakia from 16 September to 15 October,
19th pheasant - cock from 1 November to 31 December,
20th pheasant hens from 1 December to 31 December in Czech regions - Slovakia only in independent and recognised pheasants,
21st partridge from 16 August to 30 September (§ 4 (4)),
22. wild duck, cedar, blue and pollack from 16 August to 30 November,
23 geese from 1 October to 31 December,
24th black lyme from 1 August to 30 November,
25. Wooden meadow from 16 March to 15 April,
26. becasin from 1 August to 30 November,
27th Pot from 1 August to 15 October,
28. garden dove from 1 August to end February,
29th seaweed from 1 November to 31 March,
30. Field raven from 1 November to the end of February; his chicks from 1 May to 31 May.
(2) If the first day of the determination of the fishing time is closest to the day following the day of work, the fishing time shall begin on that day of work.
(3) The provisions of the preceding paragraphs shall not apply to branches, but only to the species of game for which the branch has been established.
§ 3
(1) In state-reserved hunts, hares or pheasants may be hunted from 16 October; in other hunts, only fee hunts agreed for foreigners may be performed on a rabbit or pheasants from 16 October.
(2) All year round, it is allowed to fish in separate and recognised pheasants of the horse of the forest and of the rock, badgers, hedgehogs, horse of the forest, horse of the wild, and wild cat from 16 May to 15 July.
(3) The catches may be taken from 16 August to 31 October on dredging ponds and on extracts, and for the whole year of ash and cormorant. On the other management ponds, sprat and cormorant may be fished from 1 August to 30 November. A laughing seagull may be fished on large duck ponds throughout the year unless a natural reserve is established on such ponds.
(4) The Regional National Committee may, after consulting the Czechoslovak Hunting Union and the Regional Centre for Monument Care and Nature Protection, authorise, at the request of the user of the hunt, the selection of one or more pups from one or more nests of bream, if there are more than one in these nests. The user of the chase shall retain only one of the holes selected from the nests if he has not yet one; otherwise it is obliged to offer the selected reserves to buy an organisation responsible for catching and buying live game.
Fishing methods and conditions and restrictions
§ 4
General principles
(1) Fishing for game of use (both shoot and catch) may be carried out only to the extent that its tribal status is not compromised. For the purpose of this Regulation, the following definitions apply: If a shooting and game capture is planned at the same time in the chase (with the exception of the provisions of Section 5 (3)), the intended catch must be met in particular. If a particular type of game is prohibited in a district, only its intended catch shall be taken, with the agreement of the District National Committee, for reasons of gender control.
(2) With the exception of wild boar, it shall be prohibited to fish for game subject to hunting planning, the breeding, capture and removal of which has not been planned in the chase.
(3) The cloven-hoofed game with the exception of wild boar is allowed to shoot only with a bullet; The wild pig may also be shot with a shotgun with a single shot.
(4) Field partridge is prohibited. *)
(5) It shall be prohibited to fish for game from motor vehicles.
§ 5
Small game blast
(1) The removal of hares, pheasants and ducks may only be carried out on common hunts involving at least three shooters.
(2) Hare may be fished on the same area only once a year; no more than twice a year may be fished on continuous forest areas of a minimum size of 200 ha.
(3) In hunts intended to catch hares into gillnets, the shooting shall not be planned and carried out at the time of the hunt prior to the intended catch.
(4) The pheasant discharge may be carried out on the same area no more than three times a year. The hunting of pheasant hens is prohibited in hunts where pheasant animals have been newly introduced in the last two years. The release of pheasant hens shall only be carried out in hunts where a shooting plan of at least 100 pieces of pheasant game is approved and where the condition of the hens exceeds the intended sex ratio; no more than 20% of the intended shot of the pheasant game shall be fired on the pheasant hens. The total number of fowls and fowls shot shall not exceed the approved hunting and hunting plan.
(5) Ducks may also be shot on the move, not earlier than one hour before sunrise and not later than one hour after sunset; At least three shooters shall participate in this shooting together and shall use at least one hunting fit dog. In the Czech regions, duck hunting is allowed three times a week, on Wednesday, Saturday and Sunday.
(6) Shootout by shovelling using the dog is forbidden.
Common Hunts
§ 6
(1) The number of hunts in each chase shall be proportionate to the hunting surface, the actual state of the game and the shooting plan; the number of shooters and hounds involved in each hunt must also be proportionate to the hunting area on which the hunt takes place, the number of treatments and the number of centrifuges (number of shooting animals for each hunt).
(2) In order to ensure the necessary tribal status of game for further breeding, one fifth of the total hunting area shall be left as a chamber of game on which no hunt shall be conducted. This part must be integrated and show normal game restocking to which the hunt takes place.
(3) Chases may only be held on Saturdays and working days. In exceptional cases (e.g. for reasons of safety closer to large cities where the hunting activities are attended for recreational purposes), the district national committee may also authorise hunts on a weekday basis. In the hunts in which tax hunts have been negotiated for foreigners, in state-reserved hunts and in hunts in which a state organisation exercises the right of hunting for its own account, hunting can be held on a weekday basis.
§ 7
(1) The Thessaloniki operator is obliged to report to the Regional National Committee and the Regional Committee of the Czechoslovak Hunting Association every hunt (including shooting ducks on the move) no later than 5 days in advance, indicating the number of shooters, the prelimar of the shooting and the name and size of the part of the hunt on which the hunt will take place.
(2) Before the hunt, the employer is obliged to check whether all the shooters have valid hunting tickets, whether the weapons are properly registered and their serial numbers match. If someone finds that his hunting ticket is invalid or the gun or gun number of that weapon does not agree with the entry in the hunting ticket, he shall be obliged to ask him to leave the hunt and to notify the public safety authority of the case. He is also obliged to take care of the proper arrangement of the hunt under the guidance of a reliable and experienced hunter (leader of the hunt), who will draw particular attention to ensuring that safety rules are respected when using hunting weapons.
(3) Persons under the age of 18 may participate as shooters only in common school hunting. Persons under 15 years of age may not participate in common hunting activities as hunters.
(4) For the first three shooters and for each additional 5 shooters, one hunting dog must be available for use in each joint hunt.
(5) Each but not less than the end of the load and the hunt for all caught game, properly carried out.
(6) The following day after the hunt, a search warrant must be made using hunting-fit dogs. In the event of a search, only a hunting gun can be used by a hunting operator and a hunting guard established for the chase in which the search is carried out.
§ 8
Food supply
In order to ensure the supply of venison resulting from the delivery contract, the hunting operator is obliged to report to the shopping organisation the hunt five days in advance. Otherwise, the hunting operator is obliged to ensure that game is handed over in a healthy state; in so doing, pheasants must be delivered within 24 hours and hares within two days of the catch.
§ 9
Intellectual confidant
(1) The Regional National Committee provides for the proposal of the Regional Committee of the Czechoslovak Hunting Association from among the experienced members of the Czechoslovak Hunting Association for hunting confidants, which is responsible for monitoring the implementation of the hunting and hunting plan. The authorisation of a hunter's confidant shall not replace a hunting permit.
(2) In particular, hunting experts shall assist in the organisation of hunting activities and shall ensure that the spring tribal status of game is not disturbed and that all caught animals are on display and on display. On the course and outcome of the hunt, the hunting confidant shall draw up a record which he shall submit to the Regional National Committee and through the unity of the Czechoslovak Hunting Association to the Regional Committee of this Association.
§ 10
Exemptions for certain organisations
The provisions of § 4 (1), § 5 (2) to (5), § 6 (1) and (3), § 7 (1), § 8 and § 9 do not apply to hunts in which the exercise of hunting rights was reserved pursuant to § 18 (1) of Act No. 23 / 1962 Coll., to hunts of animal research institutes and hunts of organisations within the field of the Ministry of National Defence.
§ 11
Animal capture
(1) The District National Committee may, in hunting cases having exceptionally high animal populations, authorise the user to hunt after consultation with the District Committee of the Czechoslovak Hunting Association to catch an adequate number of game outside the originally established catch plan. a copy of the permit shall be sent to the Ministry of Agriculture, Forestry and Water.
(2) In cases where a planned game capture cannot be carried out for animal health reasons, the district national committee shall, after consultation with the Czechoslovak Hunting Union district committee, amend the schedule of the game capture plan to individual hunts so that the catch plan in the county is met. If it is not possible to change the schedule of the catch plan in the county, it shall, at the request of the district national committee, amend the schedule in the county national committee after consulting the Regional Committee of the Czechoslovak Hunting Union. An amendment to the plan for catching game must be made in time and notified to the Ministry of Agriculture, Forestry and Water.
§ 12
Musk fishing
It's forbidden to shoot musk ondatra. It is not allowed to hold musk musk musk mussels in captivity and transport them alive.
§ 13
Shootout
(1) Shock of breeding deer, i.e. promising young deer of the first age class (2-4 years) and breeding crown deer of the second age class (5-8 years) and III age class (9 years and older) shall be prohibited. Of the crown deer in the 2nd and 3rd ages, deer with short and weak antlers or with short privileges in the crown are not considered breeding. From the crown deer in the 3rd grade age, deer with one-sided crown and deer over 12 years of age are not considered breeding. However, if the number of deer with weak antlers and short prerogatives in the third age class exceeds the number of deer with or without a crown, with or without a single crown, in the third age class, the district national committee shall determine by recording in the plan of breeding cloven-hoofed game how many crown deer of over 12 years of age can be shot in the chase.
(2) Fishing for cloven-hoofed game other than wild boar shall be prohibited. At the request of the hunting operator, the county national committee may, after consulting the district committee of the Czechoslovak Hunting Association, authorise the hunting of deer deer and deer deer by one group of no more than 5 shooters and 2 hounds on the same day and in the same chase using the same hunt as the eligible dog. The result of the pressure must be reported to the district national committee within 3 days.
(3) In the case of Sika deer and Virginian deer, only the shoot-out of penetrating pieces may be carried out.
(4) The Czechoslovak Hunting Union carries out annual breeding shows of trophies. The hunting operator is obliged to submit all trophies of game caught together with the upper and lower jaws to the district committee of the Czechoslovak Hunting Association, whose perimeter is situated.
§ 14
Shots fired
Only the crow, the maggot, the cauliflower, the falcon, the hawk and the krahul may be fished on the balconies.
§ 15
Captives
(1) The Czechoslovak Hunting Union shall keep a record of stocks held in captivity. The breeders are obliged to report to the Czechoslovak Hunting Association all the owls they hold in captivity. The Czechoslovak Hunting Union gives them a record sheet and metal rings; without such registration sheets and metal rings, the breeding of eggs in captivity is not permitted.
(2) The death or other loss of a captive stock is required by the breeder to report to the Czechoslovak Hunting Association.
(3) The sale and purchase of captive breeders may only be carried out by an organisation responsible for ensuring the capture, purchase, assembly and disposal of the game (CSM).
§ 16
In agreement with the Ministry of Education and Culture, the Ministry of Agriculture, Forestry and Water may allow derogations from the provisions of Sections 1 and 2 of this Decree for a transitional period for certain types of game and for certain areas.
§ 17
Decree of the Ministry of Agriculture, Forestry and Water No 25 / 1962 Coll., on the defence and on the time, manner and conditions of hunting of certain species of game is hereby repealed.
§ 18
This decree shall take effect on 1 April 1965.
