Government Regulation
of 17 April 1953
on the adjustment of pensions from retirement provision and the provision of persons hostile to the democratic people.
The Government of the Czechoslovak Republic orders, with the agreement of the President of the Republic, pursuant to § 6 paragraph 3 and § 9 paragraph 5 of Act No. 102 / 1951 Coll., on the Rebuilding of National Insurance, and pursuant to § 42 paragraph 1 of Act No. 241 / 1948 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan):
Persons who have been sentenced to the loss of civil rights because they have committed a crime of hostility to the people's democratic order, the payment of pension benefits is suspended for the period for which the loss of those rights lasts (Section 44 (3) of the Act); However, uninsured members of the family shall be supported for that period up to the amount of half of the sentenced person's pension, in the case of education in full.
(1) On the basis of the resolution of the Council of the District National Committee, old-age (invalidity) pensions and widows' pensions will be reduced accordingly, depending on the circumstances of the case, for up to 700, - CZK monthly (social pension)
(a) prominent representatives of and widows from the former political and economic establishment;
(b) to those who were eager to serve the former capitalist order, and to the widows after them, if these persons show a hostile attitude towards the popular democratic order.
(2) In cases of special justification, the pension may be withdrawn entirely if the maintenance of the pensioner and his family members is otherwise taken care of and the Council of the Regional National Committee has decided to resign.
(3) The local competence of national committees shall be governed by the residence of the pensioner.
(1) The reduction (suspension, withdrawal) of pension payments pursuant to § § 1 and § 2 will be carried out by the State Pension Insurance Office by an assessment.
(2) The Commission, acting on a proposal from the Central Council of Trade Unions, appointed by the Government, shall decide on appeals against the measures given by the State Pension Insurance Office pursuant to Article 2. The decision of this commission is final. The appeal shall not have suspensory effect.
The directive for the implementation of this Regulation shall be issued by the Chairman of the State Pension Insurance Commission with the Minister for the Interior and in agreement with the Minister for Justice.
(1) Paragraph 2 shall apply mutatis mutandis to pension arrangements for members of the armed forces.
(2) The Directives for the implementation of paragraph 1 shall be issued by national defence and national security ministers, while determining, in agreement with the Minister for the Interior, which bodies shall carry out the procedure provided for in Article 2.
Measures taken within the limits of this Regulation before its effect shall be deemed to have been taken under this Regulation.
This Regulation shall enter into force on the day of its publication; They shall be carried out by the Chairman of the State Pension Security Commission and by the Ministers of the Interior, Justice, National Defence and National Security.
