THE LAW
of 25 June 2003
on the putting into circulation of seed and propagating plants and amending certain laws (Law on the circulation of seed and seed)
Parliament has decided on this law of the Czech Republic:
GROWTH, PLANTS AND PLANTS
GENERAL PROVISIONS
Subject matter
(1) This Act implements the relevant provisions of the European Union1, following the directly applicable provisions of the European Union17) and provides for the marketing of seed and planting plants, the registration of varieties of plant species listed in the generic list (hereinafter referred to as the "generic list") and varieties of ornamental species, the supervision of compliance with the obligations laid down by this Law to legal and natural persons and administrative penalties for their infringement.
(2) This Act shall not apply to agricultural, vegetable and fruit species not listed in the species list, except for seed mixtures provided for in Sections 12 and 12a and imports from third countries pursuant to Section 18, forest reproductive material of forest-relevant species and artificial cross-breeds intended for the restoration and afforestation of forests and for the maintenance and enhancement of biological diversity of forests, including genetic diversity of trees and sustainable forest management.
Definition of terms
(1) In this Act:
(a) a variety of plants belonging to the lowest degree of botanical grading, defined by the expression of characters resulting from a particular genotype or combination of genotypes, distinguishable from each other by the expression of at least one of those characteristics, and considered to be a reproduction unit unchanged;
(b) propagating material for seed and planting of grown plants,
(c) seed for planting or growing plants; seed shall be considered as seed of seed of potatoes or of garlic and the provisions of point (d) shall not apply to them;
(d) plants or parts of plants intended for reproduction or cultivation;
(e) components of a variety of lines, clones or other varieties from which the variety in question is composed or from which propagating material of the variety is produced,
(f) a genetically modified variety which includes genetically modified plants: (1a),
(g) by maintaining the variety, a procedure according to generally accepted practice ensuring the uniformity and stability of the variets2);
(h) the breeder of the variety is the person responsible for the maintenance of the variety;
(i) by putting into circulation commercial storage, sale or any other means of transferring or transferring propagating material to another person, provided that such activities are carried out for commercial use, the marketing for sale being considered as being put into circulation; the production or treatment of propagating material for any other person not connected with the transfer or transfer of propagating material and the provision of propagating material for breeding, research and experimental purposes shall not be considered as putting into circulation;
(j) by recognition procedure, the process of official testing of propagating and planting material; certification of the characteristics of propagating material for export purposes with the issuing of internationally valid certificates is also a form of recognition procedure,
(k) vegetable seedlings of young plants made from seed, seed or part of plants for planting for vegetable cultivation for final consumption;
(l) the rootstock of the genus or species including their hybrids and varieties suitable for grafting vine varieties, fruit genera and species, ornamental species or vegetables,
(m) an official description of the variety, a description of the variety drawn up on the basis of official tests for the difference, uniformity and stability of the variety, including the characteristics by which the variety is defined, relating to plants grown from recognised or standard seed or seed;
(n) breeding material categories of propagating material, pre-stage propagating material, basic propagating material, certified propagating material, standard vegetable seed, standard propagating material of vines and hops, conformal propagating material of fruit genera and species, commercial seed or propagating material of organic heterogeneous material distinguishing between the biological value and the extent of monitoring of the characteristics of the propagating material concerned;
(o) breeding propagating material corresponding to the official description of the variety, in the care of the breeder of the variety, which is used for the production of pre-stage propagating material and is not subject to recognition procedure, unless put into circulation;
(p) propagating material of pre-stages of propagating material produced or provided by the variety manager as a category prior to basic propagating material;
(q) basic propagating material propagating material which is used for the production of certified propagating material and is produced by or under the supervision of the keeper directly from breeding propagating material or pre-stage propagating material;
(r) certified propagating material produced directly from recognised breeding material, pre-stage propagating material or basic propagating material, or certified propagating material;
(s) the standard seed of a registered vegetable variety or vegetable variety listed in the common catalogue of varieties not subject to certification and intended in particular for the production of vegetables,
(t) the standard propagating material of the seed vine, which is genuine and varietal pure, intended for the production of grapes or for the production of plants or parts of such plants, intended for the production of grapes which complies with the requirements laid down in this law and for which compliance with these requirements has been verified by official examination;
(u) standard propagating material for hops, which is true and pure, intended for the production of hops or plants intended for the production of hops, which complies with the requirements laid down by this law;
(v) in conformed propagating material, propagating material of fruit and of a species which is of a variety which is genuine and pure and intended for the production of propagating material and seed;
(w) commercial seed seed of listed agricultural species which satisfies the requirements for the authenticity and purity of the species and is not subject to recognition procedure;
(x) the generation of the year or order of subsequent propagation within one category of propagating material used for propagating material of pre-stage, basic and certified propagating material;
(y) propagation crops for the production of propagating material;
(z) the supplier is a legal or natural person who puts into circulation, produces or imports from third countries propagating material for the purpose of putting into circulation;
(aa) by a clone of vegetatively propagated offspring of one plant of the variety, selected on the basis of the varietal identity of the characteristics of its phenotype and its health status.
(2) In this Act, the following definitions also apply:
(a) by lots of propagating material, the quantity expressed by weight or number of pieces of homogeneous propagating material, in the case of hop, vine, fruit genera and species and ornamental species, whether or not of uniform composition and origin;
(b) the official list of varieties of plants registered in the Czech Republic by the State Variety Book;
(c) the closed growing area of the cadastral territory in which the arrangements for the protection of propagating material are applied;
(d) health class for the designation of vine propagating material, hops, fruit and species free from or tested for viruses;
(e) a common catalogue of varieties of agricultural plant species or a common catalogue of varieties of vegetable species drawn up by the competent authority of the European Union on the basis of the lists of varieties of the Member States published in the Official Journal of the European Union,
(f) an official examination of the professional and test operations carried out by the Central Audit and Examination Institute of the Agricultural Institute (hereinafter referred to as "the Institute") or by an authorised person under this Act and under the Specific Law (3);
(g) a registered variety registered in the State Variety Book;
(h) equivalence for seed shows granted by third countries (2a), ensuring that seed shows carried out in that third country are equivalent to seed shows carried out under this law;
(i) equivalence for seed of an approval granted by a third country (2a), guaranteeing that seed produced in that third country is equivalent to seed produced in accordance with this law;
(j) by official supervision, a set of control measures carried out by the Constitution;
(k) propagating material of fast growing timber material grown on agricultural land for the establishment of production crops of fast growing timber;
(l) seed with uncompleted certification of seed harvested in another Member State of the European Union (hereinafter referred to as "Member State") or in a third country from a propagation crop which complies with requirements comparable to those laid down by this law or which has been harvested in the Czech Republic from a propagation crop complying with the requirements of this law, provided that it is intended for recognition in another Member State where the recognition procedure has not yet been completed,
(m) ornamental species of ornamental plants without distinguishing the degree of their botanical grading;
(n) by egalisation of the merging of seed lots or parts thereof of the same species and variety,
(o) genetic erosion the gradual loss of genetic diversity between and within populations or varieties of the same species, or the narrowing of the genetic base of the species as a result of human intervention or environmental changes;
(p) a region variety of populations or clones of plant species which are naturally adapted to environmental conditions in their area,
(q) the variety retained by the county variety or variety naturally adapted to local and regional conditions and threatened by genetic erosion, registered due to its importance for the conservation of plant genetic resources,
(r) the region of origin of traditional cultivation of the conservation variety to which the variety is naturally adapted or the area with which the mixture of seeds intended to protect the natural environment is naturally linked;
(s) a mixture of seeds intended to protect the natural environment, a mixture which may contain seed of feed crops and seed of other plant species, including species not included in the species list, and which is put into circulation in order to protect the natural environment in the context of the conservation of plant genetic resources;
(t) the source area of a European local5a) or specially protected area 5a);
(u) the location of the collection of the part of the source area in which the seed is collected for a mixture of seeds intended to protect the natural environment;
(v) a mixture of seeds directly harvested to protect the natural environment obtained by collection at the collection site;
(w) mixtures of separately grown constituents of a mixture of seeds intended to protect the natural environment obtained by mixing seed of individual constituents which have been grown separately outside the seed collection site obtained by collection at the collection site; the mixture contains genera, species and, where appropriate, subspecies that are typical of the site of collection,
(x) an officially recognised description of a variety of fruit species, drawn up on a basis other than official tests for the diversity, uniformity and stability of the variety, including the characteristics of the variety, at least to the extent required for the submission of an application for registration of a variety or an application for the grant of protection rights in respect of a variety approved by the Institute or by an equivalent authority of a Member State as an officially recognised description of the variety;
(y) micropropagation of plant material for the production of large quantities of plants by means of an in vitro culture from differentiated peak meristems;
(z) mericlone a set of individuals formed by microreproduction techniques from a single source of a side or peak meristem identified by an in vivo retained source plant.
(3) In this law,
(a) grown plants of plant species listed in the species list and ornamental species;
(b) a voluntary variety registered by a variety of grown plants belonging to a species listed in a species list whose varieties may be registered voluntarily under this law;
(c) an organic variety suitable for organic production pursuant to Article 3 (19) of Regulation (EU) 2018 / 848 of the European Parliament and of the Council;
(d) propagating material of organic heterogeneous material propagating material as referred to in Article 3 (18) of Regulation (EU) 2018 / 848 of the European Parliament and of the Council obtained in organic production as referred to in Article 3 (1) of Regulation (EU) 2018 / 848 of the European Parliament and of the Council.
CIRCUMSTANCES
Placing of propagating material into circulation
(1) Reproduction material may only be put into circulation:
(a) where breeding material is recognised in categories, except hops, vines and fruit genera and species, pre-stage propagating material, basic propagating material, certified propagating material of agricultural species, vegetables, hops, grapes, fruit genera and species and standard propagating material of vine,
(b) as standard vegetable seed,
(c) as standard propagating material of hops,
(d) as conformal propagating material of fruit genera and species;
(e) if authorised by the Institute as commercial seed,
(f) as a mixture of seeds of agricultural species, vegetables or, where appropriate, plant species not listed in the species list; or
(g) as propagating material of organic heterogeneous material as referred to in Article 13 of Regulation (EU) 2018 / 848 of the European Parliament and of the Council.
(2) The propagating material referred to in paragraph 1 (a) to (f) may be put into circulation provided that the quality, identity and variety requirements and other characteristics relevant for the use of propagating material (hereinafter referred to as "properties") laid down in the implementing legislation are met. The propagating material referred to in paragraph 1 (g) may be put into circulation if the requirements of Commission Regulation (EU) 2021 / 1189 are met.
(3) Propagating material of agricultural species and vegetables may only be put into circulation if it belongs to a registered variety or variety included in a common catalogue of varieties or if it belongs to an organic heterogeneous material notified by the Constitution pursuant to Article 13 of Regulation (EU) 2018 / 848 of the European Parliament and of the Council.
(4) Reproduction material of ornamental species, seeds of agricultural and vegetable species for ornamental purposes and propagating material of vine varieties, hops and fruit genera and species not covered by Section 23, Section 23a or 24 may be put into circulation in accordance with Section 25.
(5) The seed in the categories of pre-stage propagating material, basic propagating material and certified propagating material may only be put into circulation when the limits for the presence of harmful organisms laid down in the implementing legislation are not exceeded. Seed of species for which no limit on the presence of harmful organisms is established may be put into circulation uncontaminated.
(6) Pre-stage propagating material may also be produced from pre-stage propagating material for a specified number of generations. The implementing legislation sets out the number of generations for each plant species.
(7) The basic propagating material of agricultural species, hops and fruit genera and species may be produced from pre-basic propagating material or basic propagating material for a specified number of generations.
(8) Certified propagating material may also be produced from certified propagating material derived directly from recognised breeding material other than vine, fruit genera and species and hops, pre-stage propagating material and basic and certified propagating material for species covered by implementing legislation.
(9) A supplier who puts into circulation pre-stage propagating material, basic propagating material and certified propagating material of fruit genera and species and propagating material of vine and hops other than the final consumer is required to issue under the supervision of the Institute a document which must comply with the requirements laid down in the Decree. This document shall be used together with the label to indicate the different varieties or types of propagating material which are marketed together. Where the particulars on the document conflict with those on the label, the particulars on the label shall always prevail.
(10) The seed of agricultural and vegetable species in the categories of pre-stage propagating material and basic propagating material may be put into circulation with a germination capacity up to 10% lower than that laid down in the implementing legislation. The supplier shall indicate on the separate label the value of germination, the lot number and, for a natural person, the name, surname or business name (4), the place of residence or residence (4a), and the place of business of the supplier, if different from the place of residence or residence (4a); if it is a legal person, a business firm, a registered office, or the location of an organisational component in the Czech Republic. At the same time, the supplier shall indicate on the official label that the seed in question does not comply with the germination requirements laid down in the implementing legislation. For seed intended for circulation to the final consumer in the Czech Republic, the supplier may indicate the reduced germination capacity on the accompanying document. The provisions of this paragraph shall not apply to seed imported from third countries, except seed certified in accordance with Paragraph 4 (13).
(11) Garlic seed may only be put into circulation if breeding material, pre-stage propagating material, basic propagating material, certified propagating material or, as regards the category of standard seed or organic heterogeneous material, has been recognised in the categories.
(12) A supplier who places into circulation conformal propagating material of fruit genera and species or propagating material of fruit genera and species referred to in Article 3d other than to the final consumer shall be required to issue a document for such propagating material which shall contain the information provided for in the decree for this document. This document shall be indelibly printed in one of the official languages of the European Union and shall be easily visible and legible.
(13) In the case of the putting into circulation of conformal propagating material or fruit-fruit material of the species referred to in Article 3d to the final consumer, the particulars of the supplier's document referred to in Article 3 (12) may be limited to the particulars laid down in the decree.
(14) The Ministry of Agriculture (hereinafter referred to as "the Ministry") provides by decree:
(a) requirements for the characteristics of propagating material put into circulation in accordance with paragraph 2;
(b) limit values for the presence of harmful organisms;
(c) the maximum number of generations allowed in categories of pre-stage propagating material, basic propagating material and certified propagating material;
(d) the particulars of the document referred to in paragraphs 9, 12 and 13;
(e) a species list, including a list of species whose varieties may be registered voluntarily; and
(f) requirements and procedures for the production, recognition, packaging, labelling and putting into circulation of garlic seed.
Placing in circulation seed of varieties not officially registered
(1) On the basis of the authorisation of the Institute, seed of a variety of agricultural species for which an application for the registration of a variety has been submitted or seed of a variety of vegetable species for which an application for the registration of a variety or for the entry of a variety in the list of varieties of another Member State has been submitted may be put into circulation. Authorisations shall be granted only for tests and evaluations on farms in order to obtain information on the cultivation and, where appropriate, the use of the variety.
(2) The application for authorisation to put into circulation seed of an officially unregistered variety shall be submitted by the Institute:
(a) a supplier established in the Czech Republic or his authorised representative for a variety of agricultural species for which an application for registration of a variety has been submitted;
(b) the person or his authorised representative who has submitted an application for the registration of a variety or for the registration of a variety in the list of varieties of another Member State in the case of a vegetable species.
(3) The application referred to in paragraph 2 shall contain:
(a) the applicant's registration or registration number allocated pursuant to Article 16 (7);
(b) the name of the species and the design of the variety name;
(c) a description of the variety;
(d) the planned tests and evaluations, including the designation of the State (s) where they will be carried out and evaluated;
(e) an indication of the maintenance of the variety.
(4) The seed put into circulation referred to in paragraph 1 shall comply with the characteristics of certified seed of the first or second generation. Requirements for the characteristics of certified seed of the first or second generation for each species shall be laid down in implementing legislation.
(5) The characteristics of the seed shall be verified by official examinations or tests under official supervision, for seed potatoes only by official tests. In the case of vegetable species, seed shall be subject to subsequent control of varietal identity and purity; a similar procedure shall be used for sampling.
(6) The seed packages must be packed and sealed in accordance with Section 19 and marked with an official label for agricultural species or a supplier label for vegetable species. The label shall be orange and shall contain the following particulars:
(a) an indication of the authority responsible for certification of seed, with the exception of vegetable species;
(b) the lot number,
(c) month and year of closure of seed packaging,
(d) the name of the species, the name of the variety or the proposal for the name of the variety and the official number of the application for registration of the variety or the application for the entry of the variety in the list of varieties in another Member State;
(e) the designation "variety not officially registered,"
(f) the designation "for testing and evaluation only," with the exception of vegetable species;
(g) the designation "genetically modified variety," in the case of genetically modified varieties,
(h) for seed potatoes of size sorting;
(i) the weight of the package and, where appropriate, the quantity of pure seeds;
(j) when the packaging substance or granulated plant protection products is used, the weight of the additives and the ratio between them and pure seeds shall be indicated;
(k) the supplier's designation.
(7) The authorisation shall be valid for a maximum period of 1 year. The authorisation may be renewed for a period of 1 year at the request of the applicant, accompanied by the documents provided for in the implementing legislation.
(8) All authorisations will cease to be valid if the application for entry in the State Plant Variety Book for an agricultural species or the application for entry in the State Variety Book or similar list of another Member State for a vegetable species is withdrawn or rejected.
(9) The Institute shall notify the Commission and the competent authorities of the Member States of the receipt of an application, the granting, renewal or expiry of an authorisation or, where appropriate, the refusal.
(10) The Institute shall restrict or prohibit the use of the variety on the territory of the Czech Republic where:
(a) the insuitability of growing such variety from a plant health point of view shall be demonstrated;
(b) it is established that the variety is not suitable for cultivation in the territory concerned or does not produce the required results,
(c) there is a reasonable suspicion that the variety may endanger human health or the environment.
(11) The Ministry shall, by decree, lay down the requirements for the characteristics of the seed, the maximum weight of lots and the minimum weight of seed samples, the procedure for determining the quantity which may be authorised for each variety and seed species, the model of the document for the submission of applications for authorisation or for the renewal of authorisations, the type, method and extent of the control of the seed circulation and the monitoring of maintenance.
Production and marketing of seed of conservation varieties
(1) The seed of the conservation variety may only be produced in the region of origin of that variety. Where, due to adverse environmental conditions, recognised seed cannot be produced in the region of origin, the Institute may, on the basis of a recommendation from the person responsible for the plant genetic resources and micro-organisations3c, approve another area for the production of seed of the variety concerned, taking into account any Commission decision laying down restrictions or conditions for the establishment of that area. The seed of a conservation variety produced in another seed production area may only be used in the region of origin.
(2) The seed of the conservation variety may only be put into circulation in the region of origin. The Institute may approve other areas within the territory of the Czech Republic for the marketing of seed of a conservation variety if these areas are comparable to the region of origin as regards the natural and semi-natural habitats of that variety. If the Institute approves such another area, the variety maintenance shall keep for the conservation of the variety in its region of origin such a quantity of seed as provided for in the implementing legislation. Where an additional seed production area referred to in paragraph 1 has been approved, the Institute for the variety in question shall not approve another seed production area under this paragraph.
(3) The seed of the conservation variety may be put into circulation only if:
(a) comes from seed produced according to the principles of maintenance of the variety;
(b) in the case of agricultural species, it satisfies the characteristics of seed in the category of certified propagating material, in the case of vegetable species it satisfies the characteristics of seed in the category of certified propagating material or standard seed;
(c) it has been produced in a region of its origin or another region approved in accordance with paragraph 1;
(d) tests to determine the characteristics of propagating material have been carried out according to internationally applicable methods.
(4) The method of determining the maximum total quantity of seed of each conservation variety put into circulation and the method of determining the maximum total quantity of seed of all conservation varieties of one species put into circulation for the growing season for agricultural species shall be laid down in the implementing legislation. The supplier who produces propagating material shall notify the Constitution of the size and location of the propagation crop of the conservation variety before the beginning of each growing season. Where those notifications show that the maximum permitted quantity of seed determined in accordance with the first sentence will be exceeded, the Institute shall allocate to each participating supplier producing propagating material the quantity of seed which may be put into circulation during the relevant growing season in proportion to the quantity initially requested by the supplier and at a maximum quantity equal to the maximum quantity determined in accordance with this paragraph. The supplier shall report to the Institute for each growing season the quantity of seed of each conservation variety put into circulation.
(5) The seed packages put into circulation shall be sealed by the supplier in such a way that the packaging cannot be opened without damaging the sealing system or leaving traces of disturbance on the supplier's label or on the packaging. The supplier's label or seal shall be part of the sealing system. The packages of seed put into circulation shall bear the label of the supplier or printing, containing the following particulars:
(a) the designation "EU rules and standards,"
(b) the supplier's designation and address or his identification mark;
(c) the year of closure of the packaging, expressed in "Closed," followed by the year in question, expressed in four figures, or not by seed potatoes, the year of the last sampling for the purposes of the germination test, expressed in "Sampled," followed by the year in question, expressed in four figures,
(d) the name of the species,
(e) the name of the variety retained;
(f) in the case of agricultural species, the designation "conservation variety," for vegetable species, the designation "certified seed of the conservation variety" or "standard seed of the conservation variety,"
(g) the region of origin of the conservation variety,
(h) the seed production area where it is different from that of the conservation variety,
(i) the lot number allocated by the supplier;
(j) the net or gross weight of the package, or, if not seed potatoes, the number of seeds,
(k) in the case of granulated plant protection products, packaging substances or other solid ingredients, the type and indicative ratio between the weight of pure seed and the total weight, not including seed potatoes.
(6) The Institute carries out a follow-up check on the varietal identity and purity of the seed of the conservation variety put into circulation by a growing test.
(7) The Ministry provides by decree
(a) the quantity of seed referred to in paragraph 2;
(b) the method of determining the quantity of seed of each conservation variety which may be put into circulation;
(c) for agricultural species, the method of determining the total quantity of seed of all conservation varieties of one species which may be put into circulation;
(d) the method for carrying out subsequent checks on seed of the conservation variety put into circulation in accordance with paragraph 6.
Placing in circulation seed of varieties developed for cultivation under special conditions
(1) The seed of a variety developed for cultivation under special conditions may be put into circulation if:
(a) satisfies the requirements for the characteristics of seed in the category of standard seed;
(b) tests to determine the characteristics of propagating material have been carried out according to internationally applicable methods.
(2) The seed of a variety developed for cultivation under special conditions may be put into circulation only in small packages whose maximum net weight is laid down in the implementing legislation. The supplier shall report to the Institute for each growing season the quantity of seed put into circulation for each variety developed for cultivation under special conditions.
(3) The packages of seed put into circulation must be sealed by the supplier in such a way that the packaging cannot be opened without damaging the sealing system or leaving traces of disturbances on the supplier's label or on the packaging. The supplier's label or seal shall be part of the sealing system. The packages of seed put into circulation must bear the supplier's label or printing, containing:
(a) the designation "EU rules and standards,"
(b) the supplier's designation and address or identification mark;
(c) the year of closure of the packaging, expressed in the word "Closed" and a four-digit number indicating the year or the year of the last sampling for the purpose of the germination test, expressed in the word "Sampled" and a four-digit number indicating the year;
(d) the name of the species,
(e) variety denomination,
(f) the designation "variety developed for cultivation under special conditions,"
(g) the lot number allocated by the supplier;
(h) the net or gross weight of the package or the number of seeds;
(i) the type and indicative ratio between the weight of pure seed and the total weight where granulated plant protection products, packaging substances or other solid ingredients have been used.
(4) The Institute shall carry out a follow-up check on varietal identity and plant purity by examination of seed put into circulation of varieties developed for cultivation under special conditions.
(5) The Ministry shall determine by decree:
(a) the maximum net weight of a small package of seed of a variety developed for cultivation under specific conditions, in the manner laid down by the relevant European Union15);
(b) the method of carrying out a follow-up check on varietal identity and plant purity by examination of seed put into circulation of varieties developed for cultivation under special conditions.
Placing into circulation of propagating material of fruit genera and species under special conditions
(1) On the territory of the Czech Republic, propagating material of fruit genera and species, the description of which is deposited with the supplier, may be put into circulation under special conditions and shall be intended:
(a) experiments or scientific purposes;
(b) for breeding; or
(c) to promote the conservation of genetic diversity.
(2) The propagating material of fruit genera and species referred to in paragraph 1 may be put into circulation by the supplier only if it meets the requirements for the characteristics of propagating material in the category of conformal propagating material.
(3) The propagating material of fruit genera and species intended for putting into circulation under special conditions may be put into circulation only in the quantity laid down in the Decree.
(4) The Institute shall carry out a follow-up check on the varietal identity and purity of propagating material of fruit genera and species intended for circulation under special conditions.
