on the method of calculating the cost of the professional forestry operator's activity in cases where its activity is borne by the State
According to § 37 (8) of Act No. 289 / 1995 Coll., on Forests and on the amendment and amendment of certain laws (Forest Act), the Ministry of Agriculture provides:
Method of calculation of costs
(1) The cost of the professional forestry operator's activities is calculated as the product of the area of forest land of each forest owner, rounded up to the whole hectare and fixed rates. This rate shall be determined by the Ministry of Agriculture according to the average cost of the professional forestry operator's activities for the previous calendar year and shall be reported in the Ministry of Agriculture Bulletin. The total quarterly costs are the sum of the costs per owner.
(2) Where a natural or legal person carries out a professional forestry operator's activity for more than 50 forest owners, the public forest authority may increase the relevant rate by up to 40%. The total quarterly costs are then the product of the increased rate and the total area of forest land of all owners, rounded up to the whole hectares.
(3) For the purposes of calculating the cost of the activities of a forest operator, more than one operator shall be considered to be the owner of the same forest parcel.
Repeal
They shall be deleted:
1. Decree No. 102 / 1996 Coll., on how to calculate the costs of the activities of a professional forestry operator in cases where its activities are borne by the State.
2. Decree No. 191 / 1997 Coll., amending Decree No. 102 / 1996 of the Ministry of Agriculture Coll., on the method of calculating the costs of the activity of a professional forestry operator in cases where its activity is borne by the State.
This Decree shall take effect on 1 January 1999.
