DECLARATION
of 24 June 2024
amending Decree No. 117 / 2012 Coll., on a more detailed regulation of the activities of the pension company and the participating fund, as amended
The Czech National Bank provides pursuant to § 170 paragraph 1 of Act No. 427 / 2011 Coll., on Supplementary Pension Savings, as amended by Act No. 403 / 2012 Coll., Act No. 241 / 2013 Coll., Act No. 119 / 2020 Coll. and Act No. 462 / 2023 Coll., for implementation of § 77h (e) of this Act:
Decree No. 117 / 2012 Coll., on a more detailed regulation of the activity of the pension company and the participating fund, as amended by Decree No. 145 / 2014 Coll. and Decree No. 476 / 2017 Coll., is amended as follows:
1. In the title of the Order, the words "and the Participating Fund 'are replaced by the words", the Participating Fund and the supplementary pension savings intermediary'.
2. In the introductory sentence of the Decree, the words "pursuant to § 110 (1) of Act No. 426 / 2011 Coll., on Pension Savings, for implementation of § 52 (6), § 63 (5), § 68 (3), § 79 (3) and § 82 (3) of the Pension Savings Act and" deleted, after the text "§ 59," the words "§ 77h (e)," and "§ 115 (5)," are deleted.
3. in Paragraph 1 (h):
"(h) the content of the register of brokered pension savings contracts pursuant to Section 77h (e) of the supplementary pension savings law,"
4. In Part Three, Title III, including the title and footnote 5, is deleted.
5. the following Part Seven is inserted after Part Six:
RULES FOR THE COMPETENT PENSION SUPPLIER
(K § 77h of the supplementary pension savings law)
Content of the contract records
The register of brokered supplementary pension savings contracts pursuant to § 77h (e) of the supplementary pension savings law shall contain at least the following for each brokered supplementary pension savings agreement:
(a) identification of the supplementary pension savings contract;
(b) the company of the pension company,
(c) the participant's identification data pursuant to Article 3 (f) of the supplementary pension savings law;
(d) the reason for registration, which is the conclusion, modification or termination of the supplementary pension savings contract;
(e) the date of conclusion of the supplementary pension savings contract or the legal act which changes or ceases the supplementary pension savings;
(f) the date of creation, modification or termination of supplementary pension savings;
(g) the negotiated savings strategy pursuant to Article 3 (a) of the supplementary pension savings law, including the identification of the relevant participating funds or the specific standardised pension company strategy;
(h) the amount of the participant's contribution;
(i) the date on which the supplementary pension savings contract or legal act is transferred which changes or ceases the supplementary pension savings, the pension company;
(j) identification details of the tied agent where the activities are carried out by him; and
(k) the identification of the natural person who has dealt with the participant on behalf of a separate intermediary. ';
Part seven shall be renumbered part eight.
Transitional provision
The data contained before the date of entry into force of this Order in the register of contracts pursuant to § 77h (e) of Act No. 427 / 2011 Coll., on supplementary pension savings, as amended, shall be considered as data under § 46a of Decree No. 117 / 2012 Coll., as effective from the date of entry into force of this Order.
Efficacy
This Decree shall take effect on the day following that of its publication.
