The Act on Christmas allowance to pensioners who are entitled to arrangements under the Law on the care of military and war victims and victims of war and fascist persecution

on the Christmas allowance to pensioners who are entitled to arrangements under the Law on the care of military and war victims and victims of war and fascist persecution.
The Constitutional National Assembly of the Czechoslovak Republic decided on this law:
§ 1.
To pensioners who are entitled in December 1947 to the payment of provision benefits under the Act of 18 July 1946, No 164 Coll., on the care of military and war victims and war victims and fascist persecution (hereinafter referred to as "the law"), a one-off Christmas allowance (hereinafter referred to as "the contribution") shall be granted for 1947.
§ 2.
(1) The allowance shall be fixed to an invalid for whom a reduction in the gainful capacity has been fixed at:
45 až 54 %,částkou 600 Kčs,
55 až 64 %, částkou 720 Kčs,
65 až 74 %, částkou 840 Kčs,
75 až 84 %, částkou 960 Kčs,
85 až 94 %, částkou 1080 Kčs a
95 až 100 %, částkou 1200 Kčs.
(2) The allowance shall be increased by 300 CZK for each child to whom an invalidity allowance is payable under Section 21 of the Act.
(3) Invalides which have been granted a treatment or blind supplement pursuant to Article 19 of the Act increase the contribution by 300 CZK.
§ 3.
The survivors' allowance shall be:
(a) for a widow, partner or widower, an amount of 1000 Kcs;
(b) for other survivors, an amount of 700 CZK.
§ 4.
(1) The contribution is not due to:
1. to the beneficiaries of the retirement and provision salaries from public funds,
2. Beneficiaries of public pension schemes,
3. to beneficiaries of an accident insurance pension, unless it is an injured person whose ability to earn is reduced by less than 50% according to the last valid statement of the accident insurance holder;
4. Persons whose average monthly gross income in January to November 1947 was more than 8,000 CZK; and
5. persons who receive benefits abroad.
(2) Furthermore, the allowance shall not be payable to persons in the employment relationship who are entitled to a full Christmas allowance in 1947; However, if they are entitled to only a proportion of the Christmas allowance from their employment, they shall be entitled only to the difference between the two contributions under this law.
§ 5.
The allowance shall not be subject to payroll tax or any other deduction.
§ 6.
The State Offices for War Damage, which shall carry out the allowance voucher, shall be entitled to deduct the contribution which has been wrongly received by the pensioner from the normal provision benefits of the pensioner.
§ 7.
This Law shall take effect on 1 December 1947; It shall be carried out by the Minister for Social Welfare in agreement with the Minister for Finance.
