on security requirements for weapons, ammunition, black hunting powder, non-ferrous dust and matches and on ammunition storage
The Government hereby orders, pursuant to § 79 (1) (a), (b), (c) and (f) of Act No. 119 / 2002 Coll., on firearms and ammunition (Act on Weapons), as amended by Act No. 229 / 2016 Coll., ("the Act '):
INTRODUCTORY PROVISIONS
Subject matter
This Regulation provides for:
(a) technical requirements for the security of concealed weapons and ammunition;
(b) the quantity of black hunting powder, non-ferrous dust and matches which, pursuant to Article 69 (2) of the Act, the arms and ammunition entrepreneur is entitled to store for sale,
(c) technical requirements for the security and conditions of storage, storage and handling of black hunting powder, dust and matches,
(d) premises in which black hunting powder, powder and matches may not be stored;
(e) technical requirements for the security of the munitions warehouse;
(f) technical requirements for electronic security equipment to ensure the protection of the ammunition warehouse;
(g) minimum technical and organisational requirements for further measures to secure the munitions warehouse; and
(h) building and technical requirements for munitions storage and for how ammunition is stored.
Definition of terms
For the purposes of this Regulation:
(a) a risk event involving a risk to a secured material with regard to the possible access of an unauthorised person or the effect of another undesirable event which may pose a risk in terms of the hazardous properties of the secured material;
(b) an electronic security system of electrical, electronic, mechanical or other components installed at the location of the secure material and used to detect a risk event;
(c) by encapsulating the maximum quantity of ammunition stored in storage, taking into account the quantity of explosive contained in the ammunition; and
(d) by a manual storage of a munitions warehouse intended for the supply of operations in which the ammunition is developed, manufactured, otherwise processed, delabored, fired, fired or destroyed.
Application of technical standards
The technical requirements laid down in this Regulation shall be deemed to be met when the Czech technical standard or part thereof complies with another legislative act (1) (hereinafter referred to as the technical standard) referred to in this Regulation; those requirements may also be met by other technical solutions guaranteeing the same or higher level of security for retained weapons, ammunition, black hunting powder, dust and matches and ammunition stored against misuse, loss or theft and ensuring the safety of the ammunition warehouse as technical standard.
TECHNICAL REQUIREMENTS FOR PROTECTION OF TRANSFERRED COLLECTION AND CULTURE
They shall be considered technically eligible for security purposes in respect of concealed, stored or stored weapons and ammunition.
(a) a lockable steel box or a lockable steel box complying with the requirements of resistance to breaking and entering 15 resistance units according to technical standard ČSN EN 1143-1 and equipped with a lock with high security against unauthorised opening in Class A according to technical standard ČSN EN 1300;
(b) a special locked device which is inseparably anchored to a wall, ceiling or floor made of bricks, concrete panels or similar building material and equipped with a high-security lock in Class A according to technical standard ČSN EN 1300;
(c) a lockable box safe which meets the requirements for classification of safety class I box safes according to technical standard ČSN EN 1143-1;
(d) a locked room or a separate object (hereinafter referred to as "special object") which meets the requirements set out in Section 5;
(e) a chamber safe which meets the requirements for classification of safety class I safe doors and chamber safes according to technical standard ČSN EN 1143-1;
(f) window and glass windows which satisfy the conditions set out in Section 6; or
(g) glass of a case or counter which is fitted with a safety film against penetration with a resistance of at least 250 J or a glass similarly resistant to penetration or extrusion from the frame.
(1) The special object is equipped with a safe door that meets the requirements for the qualification of safety class I safe doors and chamber safes according to technical standard ČSN EN 1143-1, or with an all-steel door that meets the requirements of the 5th safety class according to technical standard ČSN EN 1627.
(2) The walls, ceilings and floors of the special building have minimal thickness
(a) 300 mm if they are made from bricks, or, where appropriate, from limestone blocks or poroconcrete blocks; or
(b) 150 mm if made of concrete panels or similar building material.
(3) Windows, skylights, chimneys, fans, shafts and other openings of dimensions greater than 150 mm x 150 mm, located in the outer shell of a special object, are provided with fixed steel bars with bars of a diameter of not less than 10 mm, the distance of the bars axes being not more than 130 mm. Plug joints are welded or riveted. The anchorage of the grate shall be carried out by means of anchors with a pitch of not more than 750 mm and mounted in the masonry to a depth of not less than 150 mm. For the protection of windows, skylights, chimneys, fans, shafts or other holes according to the first sentence, other security, such as bars or blinds, may be used, meeting the requirements of the 4th safety class according to the technical standard ČSN EN 1627.
(4) From the second above-ground floor of a special building, if it is not possible to easily penetrate into its level from the roof or through lightning pipes, gutters, parapets, other building elements, off-road inequalities, trees or other structures, a closed window with an all-steel window frame fixed to the wall of the building with glass which is equipped with a security film against penetration with a resistance of at least 250 J or a glass similarly resistant to penetration and extrusion from the frame or other security meeting the requirements of the 3rd safety class according to technical standard ČSN EN 1627.
(1) The window has an all-steel frame firmly built into the building wall and is equipped with
(a) glass of a window fitted with a security foil against penetration with a resistance of at least 250 J or a glass similarly resistant to penetration or extrusion from the frame;
(b) a fixed steel grate with bars of a diameter of not less than 10 mm and a length of not more than 130 mm, the joints of which are welded or riveted; or
(c) sliding, tilting or walling steel bars or shutters complying with the requirements of the 3rd safety class according to technical standard ČSN EN 1627 with two high-security locks classified in Class A according to technical standard ČSN EN 1300.
(2) Paragraph 1 shall also apply to the protection of showcases and interpreters located in the lockable interior spaces of buildings, unless such showcases and interpretations are under the constant supervision of the holder of the arms licence, who is the authorised holder of the arms or ammunition, the holder of the arms licence or the person holding the arms licence of the relevant group and holds the licence in an employment, Member or equivalent proportion.
DISCLOSURE WITH BLACK CATCH DRIVER, SECOND DRIVER AND WEAPONS
(1) Black hunting powder, free-of-charge dust and matches retained under Section 69 of the Act are stored in premises which have been designated for this purpose under another legislation (2); This does not apply if it is about overtaking rounds for your own use.
(2) Black hunting powder, free-of-charge dust and matches for sale may be kept in the premises of the entrepreneur in the housing and construction works for trade
(a) only in the space intended for customers (hereinafter referred to as "the sales space") or in the space intended for the possession of black hunting powder, free dust and matches (hereinafter referred to as "adjacent space"); and
(b) not more than the quantity exceeding the weight limit or the maximum number of pieces indicated for the relevant type of space in the Annex to this Regulation.
Black hunting dust, dust and matches can be preserved
(a) in one space, only in separate cabinets or boxes prepared against possible theft or abuse;
(b) only in such a way that any explosion or fire does not endanger lives, health or property;
(c) in the original packaging of the manufacturer or of such packages which satisfy the safety requirements, mutatis mutandis to the original packaging;
(d) dry and in such a way that their temperature does not exceed 40 ° C; and
(e) separately from flammable and slightly flammable objects.
(1) Black hunting powder, dust free of charge and matches can only be handled when the charges are taken by means of a method specified by the manufacturer of the individual components and equipment intended for overtaking.
(2) When charging charges
(a) open fire or smoke cannot be used;
(b) only appliances and equipment in technical condition which guarantee safety and health at work and safety of operations may be used; and
(c) only undamaged casings may be used.
MUNICS
Storage of ammunition with inert missiles or inert ammunition
Ammo containing inert missiles or grenades and other inert components of ammunition can be stored and secured
(a) under similar conditions as ammunition, provided that such ammunition contains only fillings, matchsticks or matchscrews; or
(b) in such a way as to prevent its misuse, loss or theft, unless such ammunition or components contain any active ingredients.
Technical requirements for the security of the munitions warehouse
(1) The ammunition storage facility shall be secured against entry of unauthorised persons by locking in accordance with § 12, installing an electronic security device to ensure the protection of the ammunition storage facility pursuant to § 13 and taking one of the measures to secure the ammunition storage facility referred to in § 14 to 17.
(2) The provision of additional measures to secure the munitions storage facility shall be based on local conditions, including taking into account the location of the ammunition storage facility in the enclosed premises, and the specific construction and technical execution of the ammunition storage facility.
Lockdown of the munitions warehouse
The locking of the ammunition warehouse shall be carried out by lock and safety forwarder or barrier meeting the requirements of the 3rd safety class according to technical standard ČSN EN 1627. The munitions warehouse is not locked if there are people in it.
Electronic security equipment for protecting ammunition storage
(1) Electronic security equipment to ensure the protection of the munitions storage facility allows the transmission of a risk report by an alarm transmission system to a person authorised to take measures to ensure the safety of the ammunition stored.
(2) Electronic security devices to ensure the protection of the ammunition storage facility and the method of its installation, including spatial protection, shell protection and emergency system, meet requirements at least for security level 2 according to technical standard ČSN EN 50131-1 ed.2 and general requirements for alarm transmission systems according to technical standard ČSN EN 50136-1.
(3) If the ceiling of the munitions warehouse is made of light building materials, the entire ceiling area is protected by an electronic security device.
Other measures to secure the munitions warehouse
Physical security of the munitions warehouse
(a) at least one natural person continuously present or performing irregular circumvention activities with a frequency of rounds at least every 2 hours; or
(b) by connecting an electronic security device or a special television system to a 24-hour reception centre.
(1) The special television system allows the scanning, transmission, display and documentation of a risk event inside and outside the ammunition warehouse. The output from the special television system allows for continuous monitoring by a natural person who, following the detection of a risk event, is entitled to take follow-up measures to secure a munitions warehouse or to transmit an alarm message to such a person.
(2) The special television system meets the requirements for video systems for use in safety applications for at least security level 2 according to technical standard ČSN EN 62676-1-1.
Perimeter protection shall be carried out by installing an electronic security device enabling the unauthorised person to be detected entering the outer perimeter of the munitions warehouse, at least at the level of fencing of the ammunition warehouse.
Consistent and complementary measures under another legislation governing security measures for objects classified in Group A or Group B under the Major Accident Prevention Act (3) are considered comparable.
Construction and technical requirements for ammunition storage
(1) In determining the method of ensuring the safety of an ammunition warehouse, the classification of ammunition according to hazard and tolerability, the risk of dissolution of the ammunition and its shrapnel in a risk event, including the possibility of unexploded munitions, and local conditions, in particular the fragmentation of the terrain surrounding the ammunition warehouse threatened with shrapnel and unexploded ammunition. The design of the munitions storage facility, including external security elements such as wallets, palisades or separation walls, and the way in which the ammunition is stored in such a designed ammunition storage facility shall ensure that the dissolution of the shards does not jeopardise residential buildings, transport infrastructure and engineering networks and that, in the event of an explosion or a fire of the ammunition storage facility, the possible dissolution of unexploded ammunition into the surrounding area is limited to a maximum extent.
(2) Equipment, including external security features, construction and vegetation in the vicinity of a munitions warehouse, must not endanger munitions storage and handling of ammunition in particular by falling objects on a munitions warehouse or carried ammunition or by capturing the ammunition transported.
(3) The ammunition warehouse shall be fenced by a fence of a minimum height of 2 m with a superstructure of at least one row of barbed wire at least 20 m from the ammunition warehouse; This requirement can also be met by placing an ammunition warehouse in a fenced area, provided that the minimum distance of the ammunition warehouse is maintained from the fencing. The method of fencing shall be determined in the project documentation, taking into account local conditions, linings, specific construction and technical execution of the ammunition warehouse and other measures to secure the ammunition warehouse.
(4) Unless otherwise provided for in this Regulation, a munitions warehouse shall comply with the requirements for the storage of explosives in accordance with another legislation governing the storage of explosives (4) in terms of design, location, arrangement, safety features and equipment, for general linings. In the event of a risk of shrapnel effect, the safety distance determined under another legislation governing the storage of explosives (4) shall be increased accordingly to a maximum distance at risk of the shrapnel effect of the ammunition. The definition of the maximum distance at risk of the shrapnel effect shall be based on the documentation stored by the ammunition or shall be determined on the basis of a test by which the protocol, signed by the ammunition, is drawn up and annexed to the munitions documentation; the definition of the maximum distance at risk of shrapnel effect shall take due account of the construction and technical solutions of the munitions warehouse.
(5) In the case of explosives packed in ammunition, the coefficient 1 for explosives and the coefficient 0,25 for ammunition shall be applied when determining the safety distances from hazard class A warehouses under another legislation governing the storage of explosives (4).
(6) All munitions warehouses, including loose complexes, shelters and ammunition handling sites, are secured against lightning effects in a manner consistent with technical standard ČSN EN 62305-1.
(7) Electrical equipment and wiring meet the requirements for equipment in environments with a risk of fire or explosion corresponding to technical standard CSN 33 2340.
(8) Save as otherwise provided for in this Regulation, the requirements referred to in paragraph 4 may also be met by the adoption of measures corresponding to an international standard for the storage of ammunition or a similar standard used by the armed forces of the Czech Republic based on such international standards (hereinafter referred to as the "international standard '). Where an international standard provides for specific measures for the storage of ammunition only from a certain quantity of refrigerated explosives, these measures shall also apply to the storage of ammunition containing any lower quantity of refrigerated explosives. The measures referred to in the first and second sentences shall be included in the documentation of the munitions warehouse referred to in Article 70r (5) of the Act; where the international standard leaves the specific form of the measures taken to the user or refers to the conduct of technical tests, the documentation of the munitions warehouse shall contain a description and justification of the adoption of the specific form of the measures taken and, where appropriate, a report on the technical tests carried out.
An ammunition warehouse, which is a hand warehouse, complies with the requirements for a hand warehouse under another legislation governing the storage of explosives 4), for the quantity of explosives in ammunition stored in a hand warehouse.
Prevention of the risk of the occurrence or spread of a fire or explosion of stored ammunition
(1) Unless otherwise specified, ammunition shall be stored in buildings intended for this purpose under another legal provision (2).
(2) The construction must be designed and carried out in such a way that in the event of a fire:
(a) the load-bearing capacity of the structure is maintained for a specified period;
(b) the formation and spread of fire and smoke are restricted within the building;
(c) the spread of fire to neighbouring buildings is limited;
(d) users may have left the building or been rescued by other means; and
(e) the safety of fire protection units has been taken into account.
Requirements for how ammunition is stored
(1) The ammunition is stored in undamaged packaging approved for the transport of the species and type of ammunition under the Europe Agreement on the International Carriage of Dangerous Goods by Road (ADR) 5. If the container for transport according to the first sentence is not approved for the species and type of ammunition, the ammunition shall be stored in packages ensuring the safe storage and handling of the ammunition. Only intact pallets shall be used when stored on pallets.
(2) The ammunition of the same type and type is always stored separately from ammunition of other types and types. Together in one room, only ammunition classified in the tolerance classes for which this is permitted under the European Agreement on the International Carriage of Dangerous Goods by Road (ADR) is allowed. The location of ammunition of a particular species and type in the munitions warehouse shall be indicated in the documentation of the munitions warehouse according to § 70r (5) of the Act.
(3) If a munitions warehouse is divided into several constructional parts, such as rooms, dungeons, compartments or compartments, each section of the ammunition storage unit shall be marked with a description of the ammunition stored and the marking of the components and their maximum linings shall be included in the documentation of the ammunition storage unit in accordance with Section 70r (5) of the Act. The total maximum lining of the munitions warehouse is determined by the sum of the linings of all its constructively separated parts according to the first sentence.
(4) A maximum of 3 pallets of ammunition, for which the type and nature of the ammunition, method of packaging and palletisation are permitted, may be imposed, up to a total maximum height of 3 m Pallets may be stored at a distance of not less than 0,6 m from the warehouse walls, with escape routes and working passages free from each door and around the front (front) wall of the warehouse at least 1.2 m wide. The ammunition shall be stored by calibre, type, series and year of manufacture and, where appropriate, by manufacturer's mark. The data on the ammunition stored shall be indicated on the storage cards placed visibly on the ammunition stored.
(5) The documentation of the munitions warehouse shall specify the frequency and extent of the checks carried out on the condition of the ammunition stored, its packaging, warehouse equipment and technical means of security pursuant to Section 70r (5) of the Act. The minimum permissible interval between checks according to the first sentence is 30 calendar days.
(6) The storage of ammunition on loose complexes and shelters is not permitted except for handling ammunition directly intended for transport or processing. The storage time on an open site or shelter shall not exceed 24 hours; all the time the ammunition is stored, the complex or shelter shall be guarded by the holder of the ammunition licence.
(7) Unless otherwise provided for in this Regulation, the requirements on how ammunition is to be deposited may also be fulfilled by adopting measures corresponding to an international standard. Where an international standard provides for specific measures for the storage of ammunition only from a certain quantity of refrigerated explosives, these measures shall also apply to the storage of ammunition containing any lower quantity of refrigerated explosives. The measures provided for in the first and second sentences shall be included in the documentation of the munitions warehouse pursuant to Paragraph 70r (5) of the Act.
(1) In an ammunition warehouse, ammunition, including ammunition in packaging, can only be sorted, stored, translated and collected. The ammunition packaging can only be opened in the ammunition storage room at inspection, inventory or random inspection to determine the numbers and laboratory data of the ammunition and to collect the ammunition. Any other handling of ammunition, such as assembly, delaboration, maintenance or repair of ammunition, is not permitted in munitions storage.
(2) In the case of special ammunition, such as incendiary, smoke or lighting, no more than two pallet boundaries may be placed next to each other. There is a control passage between the other two borders, each ammunition container must be accessible from the floor of the ammunition warehouse. Phosphorus incendiary ammunition, such as aerial bombs, shall be stored in an ammunition storage facility in such a way as to allow for an easy check of the tightness of its ammunition packaging and the rapid removal of defective pieces.
(3) It is not permitted to store flammable substances, preservatives and cleaning agents, paints and similar substances in the ammunition storage site. The substances referred to in the first sentence are stored outside a munitions warehouse in boxes, under shelters and in other restricted areas.
PROVISIONS TRANSITIONAL, REPEAL AND FINAL
Transitional provision
The specific object, display, display or unloading located in the lockable interior areas of buildings intended to secure weapons and ammunition which comply with the requirements for the protection of retained weapons and ammunition laid down in Government Regulation No 338 / 2002 Coll., on the technical requirements for the protection of retained weapons or ammunition and on the conditions for storage, possession and handling of black hunting powder, free of dust and matches, as amended before the date of entry into force of this Regulation, and which were used for the storage of arms and ammunition on 31 July 2017, shall be considered as technically eligible within the meaning of Part Two of this Regulation.
Final provision
This Regulation has been notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Repeal
They shall be deleted:
1. Government Decree No. 338 / 2002 Coll., on technical requirements for the security of retained weapons or ammunition and on conditions for the storage, possession and handling of black hunting powder, dust and matches.
2. Government Decree No. 347 / 2003 Coll., amending Government Decree No. 338 / 2002 Coll., on technical requirements for the security of retained weapons or ammunition and on conditions of storage, possession and handling of black hunting powder, dust and matches.
3. Government Decree No. 503 / 2005 Coll., amending Government Decree No. 338 / 2002 Coll., on technical requirements for the security of retained weapons or ammunition and on conditions for the storage, possession and handling of black hunting powder, dust and matches, as amended by Government Decree No. 347 / 2003 Coll.
Efficacy
This Regulation shall enter into force on 1 August 2017.
