GOVERNMENT REGULATION
of 15 June 2016
amending Government Regulation No. 272 / 2011 Coll., on the protection of health against adverse effects of noise and vibration
The Government hereby orders, pursuant to Article 108 (3) of Act No. 258 / 2000 Coll., on the Protection of Public Health and on the Amendment of Certain Related Laws, as amended by Act No. 274 / 2003 Coll., Act No. 392 / 2005 Coll. and Act No. 267 / 2015 Coll., ("the Act ') to implement § 30 (3), § 34 (1) and § 77 (5) of the Act, and pursuant to § 21 (a) of Act No. 309 / 2006 Coll., which regulates further requirements for safety and health at work in and for the provision of safety and health at work conditions, as well as amended by Act No. 362 / 2007 Coll.
Government Regulation No. 272 / 2011 Coll., on the protection of health against adverse effects of noise and vibration, is amended as follows:
1. Paragraph 1 (2), including footnote 2, is deleted and the designation of paragraph 1 is deleted.
2. Paragraph 2, including the title and footnote 4, reads as follows:
Basic concepts
For the purposes of this Regulation:
(a) a determining indicator of a physical variable which characterises noise, infrasound, ultrasound or vibration and is used to assess the adverse effects of noise, infrasound, ultrasound and vibration in terms of public health protection;
(b) noise with tone components of noise in whose frequency spectrum the sound pressure level in the third octave band, or even in the two immediately adjacent third octave bands, is more than 5 dB higher than the sound pressure level in the two adjacent third octave bands, and in the 10 Hz to 160 Hz frequency band, the equivalent sound pressure level in that third octave band is higher than the hearing threshold set out for that frequency band in Annex 1 to this Regulation; noise with tone components is always music or singing; if noise with tone components cannot be identified by that definition, a narrowband analysis definition may be used,
(c) high energy impulse noise consisting of sound impulses in the open air, the source of which is explosions in quarries and mines, sonic Starches, demolition and industrial processes with the help of explosives, heavy weapons fire, explosive tests, other sources of explosions whose equivalent mass of trinitrotoluene exceeds 25 g and similar sources, and which at the assessment site comply with the criteria set out in Annex 4 to this Regulation;
(d) highly impulse noise consisting of sound impulses in the outdoor area resulting from light weapons fire, explosions of explosives below 25 g equivalent to the weight of trinitrotoluene and from the impact of solids, and which at the assessment site comply with the criteria set out in Annex 4 to this Regulation;
(e) variable noise, the sound pressure level of which varies by more than 5 dB at a given location depending on time;
(f) steady-state noise, the sound pressure level of which does not change by more than 5 dB at a given location depending on time;
(g) Lpeak sound pressure level Lpeak the highest instantaneous sound pressure level within a given time interval;
(h) the maximum sound pressure level Lmax the highest sound pressure level within a given time interval;
(i) the permissible exposure limit shall reflect the exposure of the staff member to noise or vibrations converted into an eight-hour shift;
(j) a health limit on exposure to noise or vibration at work for a shift of less than or more than eight hours or as a requirement for work;
(k) the reference period for the assessment of the average noise exposure of weekly, monthly and longer periods within the meaning of the specified standard according to ČSN ISO 1999, which is estimated to be hearing loss due to noise;
(l) the reference period for the assessment of average vibration exposure to weekly, monthly and longer periods within the meaning of the defined standard according to ČSN EN ISO 5349-1, which is measured and evaluated for vibration exposure to hand-transmitted vibration,
(m) the typical flight date of the average operating conditions at the aerodrome derived for the assessment of long-term noise exposure, to be determined as the average 24 hour number of take-offs and landings at the aerodrome, calculated from the total number of take-offs and landings at the aerodrome from 1 May to 31 October of the calendar year; the number of movements shall be separated for daily and nightly periods;
(n) the old noise load of noise in the protected outdoor area and the protected outdoor areas of buildings caused by road or rail transport, which existed before 1 January 2001 and exceeded the health limits set for the protected outdoor area and the protected outdoor area of construction at that date;
(o) the integrated section of infrastructure or the runway of the section defined in accordance with other legislature4) and, if not defined in such a integrated section, the section shall be considered to be homogeneous in terms of noise assessment;
(p) stationary sources of noise, in particular buildings, buildings, premises and premises serving industrial and agricultural production, commercial and administrative activities and services, including transport in these areas, non-moving machinery and equipment fixed in their place or those whose operating radius is restricted at work, and portable and ferrous machinery and equipment which do not move in their use as a whole; For the purposes of this Regulation, resources related to activities related to the normal use of apartments, houses, family houses, buildings for family recreation and land belonging thereto, with the exception of ventilation and heating facilities, shall not be considered as stationary sources of noise,
(q) an unbuilt space in the existing continuous installation including unbuilt corners intended for installation;
(r) maintenance and reconstruction of railway track activities related to the replacement or renewal of railway superstructure, bottom and related equipment, underlining and grinding of tracks, possibly the addition of track, pre-electrification, electrification of track and other related modifications, where there is no deterioration of existing noise in the protected outdoor area and the protected outdoor space of buildings;
(s) an area of significant importance for noise penetration of the space prior to the opening of the perimeter of the structure, ensuring direct natural ventilation, where the protected interior space of the structure is situated, unless this protected space can be directly ventilated otherwise.
4) Decree No. 177 / 1995 Coll., which is published in the Construction and Technical Regulations of Railways, as amended. Decree No. 104 / 1997 Coll., implementing the Road Law, as amended. '
3. Paragraph 3 (5) reads as follows:
"(5) In determining the average workplace noise exposure over the reference period, it shall be based on the total number of shifts during the period and the number of shifts where the staff member is exposed to noise. ';
4. In Article 3, paragraphs 6 to 9 are added:
"(6) The procedure referred to in paragraph 5 shall also apply in the case of regular or irregular shifts with a duration of more than 8 hours, at a variable number of hours over the reference period, but the individual daily noise exposure shall first be converted into 8 hours working hours.
(7) The average weekly exposure of LAeq noise, w is calculated according to the relation:
LAeq, w = 10 · lg15,
where n is the number of shifts during weekly working hours during which the staff member is exposed to noise.
(8) The average monthly exposure to LAeq noise, s is calculated according to the relation:
LAeq, s = 10 · lg1s ijk = 1n100,1 · LAeq, 8h, k, dB,
where n is the number of shifts during the monthly working hours in which the staff member is exposed to noise and s is the total number of working days in that month.
(9) According to the relationship referred to in paragraph 8, the average exposure of the staff member to noise over the reference period shall be treated mutatis mutandis for more than one month. ';
5. Paragraph 8 (5) becomes paragraph 2.
6. In Paragraph 8 (2), the words "T is an eight-hour shift 'are replaced by the words" T is a non-eight-hour shift in minutes'.
7. in Article 9 (3) (i), the words "farm preventive care facilities" are replaced by the words "provider of occupational medical services."
8. In the title of Part Three, the word "STAVEB 'is inserted after the words" NOISE IN THE PROTECTED INTERNAL AREA'.
9. In Paragraph 11 (1), the first sentence is replaced by the sentence "The sound level A LAeq, T and the maximum sound level A Lamax, or corresponding levels in the frequency bands, as the case may be 'and in the third sentence, the words" except for special purpose communications' are deleted.
10. In Article 11 (2), the second sentence is replaced by the following: "In the case of noise with tone components, with the exception of noise from road, rail and air traffic, additional correction -5 dB shall be added."
11. in Article 11 (3), the second sentence is replaced by the following: "In the case of noise with tone components, with the exception of noise from road, rail and air traffic, additional correction -5 dB shall be added."
12. in Article 11 (4) and (5), the words "at equivalent level" are replaced by the words "equivalent levels."
13. In Paragraph 12 (1), the first sentence is replaced by the sentence "The indication of noise, except for high energy impulse noise, is equivalent to the sound level A LAeq, T and the corresponding levels in the frequency bands." and in the third sentence, the words "Except for special purpose communications' are deleted.
14. In Article 12 (2), the first sentence is replaced by the following: "The determining indicator of high energy impulse noise is the equivalent sound pressure level C LCeq, T and the average sound exposure level C LCE of individual impulses. '
15. in the first sentence of Article 12 (3), the words "equal to" are deleted, the words "according to" are replaced by the words "listed in Table 1 (A)" and the third sentence is replaced by the words "In the case of noise with tone components, with the exception of noise from road, rail and air traffic, further corrections -5 dB shall be added."
16. In Paragraph 12, the following paragraphs 4 to 6 are inserted after paragraph 3:
"(4) The old noise load LAeq, 16h for the day and LAeq, 8h for the night shall be determined by measuring or calculating from the data on the annual average daily intensity and traffic composition in 2000 provided by the administrator, where appropriate, by the owner of the infrastructure or rail. The hygiene limit laid down for the old noise load applies to integrated sections of infrastructure or runway.
(5) Hygienic limit of equivalent sound level And the old noise load determined by the sum of the basic sound pressure level A LAeq, T 50 dB and the correction for the old noise load set out in Table 1 of Part A of Annex 3 to this Regulation shall remain as follows:
(a) after laying of a new road surface, maintenance and reconstruction of railway tracks or road extensions, while maintaining the road or runway direction or height line; and
(b) for short-term routes.
(6) Hygienic limit of equivalent sound level A old noise load determined by the sum of the basic sound pressure level A LAeq, T 50 dB and correction for the old noise load given in Table 1 of Part Annex 3 to this Regulation shall not apply where the noise caused by road and rail transport has increased by more than 2 dB after 1 January 2001 in the infrastructure or runway section concerned. In this case, the hygiene limit equivalent to the sound level A LAeq, T shall be determined in accordance with the procedure laid down in paragraph 3. However, if the value of road and rail noise before its increase by more than 2 dB according to the first sentence was higher than the values set out in Table 2 of Part A of Annex 3 to this Regulation, additional correction + 5 dB shall be added to the sanitary limits equivalent to the sound pressure level A LAeq, T as determined in paragraph 3. ';
Paragraphs 4 to 6 shall be renumbered paragraphs 7 to 9.
17. in Paragraph 12 (8), the last sentence is deleted;
18.Paragraph 15 (2) reads as follows:
"(2) In determining the average exposure to vibrations at the workplace over the reference period, the total number of shifts during the period and the number of shifts where the employee is exposed to vibrations. ';
19. In Article 15, paragraphs 3 to 8 are added:
"(3) The procedure referred to in paragraph 2 shall also apply in the case of regular or irregular shifts with a duration of more than 8 hours, with a variable number of hours over the reference period, but the individual daily vibration exposure shall first be converted into 8 hours working hours.
(4) The average weekly vibration exposure expressed by the mean aggregate weighted acceleration level of Law, w shall be calculated according to the relation:

where n is the number of shifts during weekly working hours in which the employee is exposed to vibration.
(5) The average weekly vibration exposure expressed by the average aggregated weighted effective value of the aew vibration acceleration, w is calculated according to the relation:

where n is the number of shifts during weekly working hours in which the employee is exposed to vibration.
(6) The average monthly vibration exposure expressed by the mean aggregate weighted acceleration level of LAW shall be determined according to the relation:

where n is the number of shifts during the monthly working hours in which the employee is exposed to vibration and s is the total number of working days in that month.
(7) The average monthly vibration exposure expressed by the average aggregated effective value of the aew vibration acceleration shall be determined according to the relation:

where n is the number of shifts during the monthly working hours in which the employee is exposed to vibration and s is the total number of working days in that month.
(8) The relationship referred to in paragraph 7 shall be treated mutatis mutandis in the calculation of the average exposure of the employee to vibration over the reference period of more than one month. ';
20. In Paragraph 20 (2), "must 'is replaced by" must'.
21. In Paragraph 20, the following paragraph 3 is inserted after paragraph 2:
"(3) In the protected exterior space of buildings, sound pressure levels are determined for the falling sound wave."
Paragraphs 3 and 4 shall be renumbered paragraphs 4 and 5.
22. in Paragraph 20 (4):
"(4) When measuring noise in protected outdoor spaces of buildings, protected outdoor space and in protected indoor spaces of buildings, an uncertainty shall be given, which means extended combined standard measurement uncertainty. The uncertainty shall be applied in the assessment of the measured values. The resulting sound level value does not exceed the hygiene limit if the resulting equivalent sound level after deduction of the uncertainty is equal to or below the hygiene limit or the resulting maximum sound level is equal to or below the hygiene limit. ';
23. In Article 20 (5), the word "assessment 'is replaced by" assessment'; the word "noise 'is replaced by" determining'; the words "calculated or measured 'are inserted after the words" in the protected space of buildings' and the sentence "The first sentence does not apply in the case of an assessment of the measured value of the determining noise indicator in relation to the hygiene limit '.
24. In Paragraph 20, paragraph 6 is added:
"(6) An increase of more than 2 dB at the date of assessment of the demonstrable increase in noise compared to the measured noise values or the noise values calculated in the acoustic assessment of the source of noise submitted to the competent public health authority in the context of the request for an opinion pursuant to Article 77 (2) and (4) of the Act shall be regarded as demonstrable noise increase within the meaning of Article 77 (5) of the Act. The acoustic assessment of the source of noise according to the first sentence shall mean an assessment which is made on the basis of data on the source of noise not earlier than 9 months before the date of application referred to in the first sentence. ';
25.
The assessment of noise and vibrations in the workplace and vibrations in the protected interior areas of buildings shall be subject to uncertainty, which shall be understood as extended combined standard measurement uncertainty. The uncertainty shall be applied in the assessment of the measured values. The resulting value determining the noise and vibration levels in the workplace and vibrations in the protected indoor areas of the buildings clearly meets the hygiene limit if, when added, the uncertainty value is below the hygiene limit. '
26. Annex 2 reads as follows:

For other types of protected internal space in a table not specifically mentioned, the values for functionally similar spaces shall be used.
The purpose of the use of the construction is given by the approval decision for the buildings authorised before 1 January 2007, for later authorised buildings by notification of the construction office or approval of the building. The above hygiene limits do not apply to noise caused by the use of a protected room.
+) For traffic noise in the vicinity of motorways, roads I and II, and local roads I and II, where traffic noise on these roads is predominant, and in the railway protection zone a further correction + 5 dB is added. This correction shall not apply in relation to the protected internal space of the buildings authorised for use for a specific purpose after 31 December 2005. ';
27. The heading of Annex 3 reads as follows:
"Determination of sanitary noise limits in protected outdoor areas of buildings and in protected outdoor areas."
28. In Annex 3, Part A, the table is renumbered "Table 1 '.
29. In Annex 3, Part A, the following heading is inserted under the designation of Table 1:
"Correction for the determination of health limits of noise in protected outdoor areas of buildings and in protected outdoor areas."
30. In Annex 3, Part A, the text under Table 1 reads:
"The corrections given in the table shall not be added.
For night time, additional correction -10 dB is added for the protected outdoor space of buildings, except for noise from rail transport, where correction -5 dB is used.
The correction rules set out in Table 1:
1) It shall be used for noise from the operation of stationary sources and noise from railway stations providing train work, in particular the sorting and assembly of freight trains, the inspection of trains and the repair of wagons. For noise from railway stations providing trains that were put into service before 1 November 2011, additional correction + 5 dB is added for night time.
2) It shall be used for noise from rail, III-class roads, III-class local roads and special purpose roads within the meaning of Article 7 (1) of Act No. 13 / 1997 Coll., on roads, as amended.
3) It shall be used for noise from traffic on motorways, first and second class roads and local roads in the territory where noise from traffic on these roads is predominant over noise from traffic on other roads. It shall be used for traffic noise on rails in the track protection zone.
(4) It shall be used to determine the hygiene limit of the old noise load. ';
31. In Annex 3, Part A, Table 2 is added as follows:

This Regulation shall enter into force on the 15th day following its publication.
