amending Act No. 156 / 2000 Coll., on the Verification of Firearms, Ammo and Pyrotechnic Articles and amending Act No. 288 / 1995 Coll., on Firearms and Ammo (Firearms Act), as amended by Act No. 13 / 1998 Coll., and Act No. 368 / 1992 Coll., on Administrative Charges, as amended, as amended
Parliament has decided on this law of the Czech Republic:
Čl. I
Act No. 156 / 2000 Coll., on the verification of firearms, ammunition and pyrotechnic articles and on the amendment of Act No. 288 / 1995 Coll., on firearms and ammunition (Act No. 309 / 2002 Coll., Act No. 227 / 2003 Coll., Act No. 444 / 2005 Coll., Act No. 36 / 2008 Coll., Act No. 281 / 2009 Coll., Act No. 148 / 2010 Coll., Act No. 155 / 2010 Coll., Act No. 18 / 2012 Coll., is amended as follows:
1. In the title of the Act, the words "amending Act No. 288 / 1995 Coll., on Firearms and Ammo (Firearms Act), as amended by Act No. 13 / 1998 Coll., and Act No. 368 / 1992 Coll., on Administrative Charges, as amended 'are replaced by the words" Treatment of certain pyrotechnic articles'.
2. At the end of the title of Part One, the words "and the treatment of certain pyrotechnic articles' shall be added.
3. In Paragraph 1, the current text becomes paragraph 1 and the following paragraph 2 is added, including footnote 24:
"(2) In addition, this Act regulates the obligations of manufacturers, importers or distributors in the treatment of certain types of pyrotechnic articles (hereinafter referred to as" the person handling pyrotechnic articles'). This law does not apply to the obligations of the manufacturer in the manufacture of pyrotechnic articles under special legislation24).

4. In Article 2, the following paragraph 3 is inserted after paragraph 2, including footnote 25:
"(3) Verification shall not be subject to expansion apparatus the marketing of which is governed by specific legislation25).

Paragraphs 3 to 5 shall be renumbered paragraphs 4 to 6.
5. in Part One, the following Title III is inserted after Title II:

„HLAVA III

PREPARATION OF PYROTECHNICAL PRODUCTS
§ 16b
(1) A person handling pyrotechnic articles must treat pyrotechnic articles in such a way as to minimise the risk of life, health, property or the environment.
(2) The person handling pyrotechnic articles is required to store pyrotechnic articles in warehouses and to sell them in premises which meet the technical requirements for the technical, special purpose and construction engineering solutions of buildings and which have been approved under construction regulations.
(3) The person handling pyrotechnic articles shall also be obliged to store and sell pyrotechnic articles in accordance with the safety mark on the pyrotechnic article and the instructions for use attached to the pyrotechnic article. The Government shall, by regulation, determine the storage method and the quantity of pyrotechnic articles which may be placed in storage or in an establishment.
(4) The obligations set out in paragraphs 1 to 3 apply to the treatment of pyrotechnic articles of categories 1, 2, 3, P1 and T1, intended pyrotechnic articles of categories 4, P2 and T2 which are not considered to be explosive articles, pyrotechnic articles of classes I, II and III, subclasses T0 and T1, and to those pyrotechnic articles of classes IV and T2 which are not considered to be explosive articles. The Government shall, by regulation, establish a list of designated pyrotechnic articles of categories 4, P2 and T2, Class IV and subclasses T2 which are not considered explosive articles.
(5) Only pyrotechnic articles of category 1, class I and subclass T0 may be sold in sales stands. The Government shall determine by regulation the quantities of pyrotechnic articles which may be placed in the sales booth. ';
Title III shall be renumbered Title IV.
6. In Article 20 (1), the words "who prove themselves by means of service cards' are replaced by the words" with the exception of checking compliance with the obligations laid down in Article 16b, carried out by the Czech Trade Inspection Office 'and the second sentence is replaced by the words "Inspectors of the Office shall be shown by means of service cards, the specimen of which is laid down by the Ministry of the Order'.
7. In Paragraph 22a, the following paragraph 4 is inserted after paragraph 3:
"(4) A person handling pyrotechnic articles shall commit an administrative offence by:
(a) treat pyrotechnic articles in breach of Paragraph 16b (1); or
(b) store or sell pyrotechnic articles in contravention of Article 16b (2), (3) or (5). ';
Paragraphs 4 to 9 shall be renumbered paragraphs 5 to 10.
8. in Paragraph 22a (10) (a), "6 or 7" is replaced by "4, 7 or 8."
9. in Paragraph 22a (10) (b), "up to 5" is replaced by "5 or 6."
10. in Paragraph 22a (10) (c), "paragraph 8" is replaced by "paragraph 9."
11. in Paragraph 22b, the words "except for an administrative offence pursuant to § 22a (4) which is under discussion by the Czech Trade Inspection Office" shall be added at the end of the text of paragraph 4.

Efficacy
This Act shall take effect on the 15th day following its publication.
