THE LAW
of 2 November 1994
on granting a lump sum to certain victims of Nazi persecution
Knowing
the penitent historical injustice caused by victims of Nazi persecution,
the need to address this problem in particular with regard to the age of persons affected by Nazi persecution,
the fact that this law does not affect the application of claims by citizens of the Czech Republic in terms of international legal obligations in force, but also in terms of moral policy,
the impossibility of mitigating all the suffering caused by Nazi persecution to the citizens of the Czech Republic through this law,
Parliament has decided on this law of the Czech Republic:
Disabled citizens or their widows, widows and orphans under the conditions laid down in this Act shall be entitled to a lump sum under this Act if they are citizens of the Czech Republic at the time of their establishment.
For the purposes of this law, the affected citizen is a citizen who is a Czechoslovak political prisoner under a special law. 1)
(1) The entitlement to a lump sum shall be:
(a) disabled citizens who have not been compensated for their disability by another State;
(b) widows and widows of disabled citizens whose marriage to the affected citizen existed at the time of his disability;
(c) to widows and widows of affected citizens executed or deceased in custody, prisons, concentration and internment camps or killed violently in connection with arrest;
(d) the same proportion to orphans who were executed or deceased in custody, prisons, concentration and internment camps or killed violently in connection with arrests, who did not reach the age of 18 at the date of death.
(2) Where a lump sum has not been decided upon or a lump sum has not been paid, it shall, in the event of the death of the person referred to in paragraph 1, pass on to its heir.
(1) Persons referred to in § 3 (a) and (b) are entitled to a lump sum of CZK 2300 for each and only month of imprisonment or internment.
(2) If the affected citizen has been imprisoned or interned repeatedly, the calendar days of imprisonment or internment shall be added together; the month of imprisonment or internment is understood as 30 calendar days.
(3) The persons mentioned in § 3 (c) are also entitled to a lump sum of CZK 100 000.
(4) The persons referred to in § 3 (d) are entitled to a lump sum of CZK 100 000. If one of these persons does not claim to be granted a share of the one-off amount within the time limit laid down by this law, the other persons who have exercised the right to be granted a share of the one-off amount within the time limit laid down by that law shall acquire that share equally.
(5) Reimbursement will be made from state financial assets.
(1) In cases where the disabled citizen is, or has been, a pensioner or a person referred to in § 3 is, or has been, a survivor of the survivor's pension pension paid by the social security institution of the members of the armed forces, 2) that institution shall decide and pay a lump sum and a lump sum.
(2) The person referred to in Article 3 shall apply the right to grant a lump sum to the authority responsible for the decision referred to in paragraph 1 within nine months of the date of application of this law by written application, otherwise the right to grant a lump sum shall cease.
(3) The persons referred to in Article 3 shall submit a certified copy of the document issued pursuant to Act No. 255 / 1946 Coll., which concerns the affected citizen and, where appropriate, other documents certifying entitlement to the grant of a lump sum where the authority responsible for the decision referred to in paragraph 1 so requests.
(1) The procedure for granting a lump sum (hereinafter referred to as the "procedure") shall be initiated only on the request of the person referred to in Article 3. Proceedings initiated on the basis of the person referred to in § 3 (d) shall be suspended until the deadline referred to in § 5 (2) has expired.
(2) Unless otherwise provided for in this law, the rules of procedure shall apply. (3)
(3) An appeal to the Supreme Court may be brought against the decision of the authority referred to in Article 5 (1).
Proceedings under this Act shall be exempt from fees.
This law is without prejudice to the rights of beneficiaries under international legal obligations.
This Law shall take effect on 1 December 1994.
