DECLARATION
of 3 October 2014
amending Decree No. 346 / 2013 Coll., on the submission of statements by banks and branches of foreign banks to the Czech National Bank
Czech National Bank provides pursuant to § 41 paragraph 3 of Act No. 6 / 1993 Coll., on the Czech National Bank, as amended by Act No. 227 / 2013 Coll.:
Decree No. 346 / 2013 Coll., on the submission of statements by banks and branches of foreign banks to the Czech National Bank, is amended as follows:
1. footnote 1 shall read:
"(1) Article 5 of Protocol (No 4) on the Statute of the European System of Central Banks and of the European Central Bank. Council Regulation (EC) No 2533 / 98 of 23 November 1998 concerning the collection of statistical information by the European Central Bank, as amended. Regulation (EU) No 549 / 2013 of the European Parliament and of the Council of 21 May 2013 on the European system of national and regional accounts in the European Union. Regulation (EU) No 1071 / 2013 of the European Central Bank of 24 September 2013 on the balance sheet of the MFI sector (recast) (ECB / 2013 / 33). Regulation (EU) No 1072 / 2013 of the European Central Bank of 24 September 2013 on interest rate statistics applied by MFIs (recast) (ECB / 2013 / 34), as amended. Regulation (EU) No 1409 / 2013 of the European Central Bank of 28 November 2013 on statistics on payments (ECB / 2013 / 43). Regulation (EC) No 184 / 2005 of the European Parliament and of the Council of 12 January 2005 on Community statistics on balance of payments, international trade in services and foreign direct investment, as amended. Regulation (EU) No 575 / 2013 of the European Parliament and of the Council of 26 June 2013 on prudential requirements for credit institutions and investment firms and amending Regulation (EU) No 648 / 2012. ';
2. in Paragraph 3 (1) (b):
"(b) within 17 days of the end of the calendar month to which they relate, the following statements:
1. VT (ČNB) 1-12 "Monthly statement of the bank / branch of the foreign bank on write-offs of loans and other claims,"
2. VUS (CNB) 1-12 "Monthly account of the bank / branch of the foreign bank on interest rates of deposits and loans received,"
3. VUS (CNB) 2-12 "Monthly account of the bank / branch of the foreign bank on interest rates of loans granted"; and
4. VUS (ČNB) 3-12 "Monthly statement of the bank / branch of the foreign bank on interest rates of non-marketable debt securities," "
3. in Paragraph 3 (1) (c) (1) to (3):
"1. VUS (ČNB) 11-12" Monthly account of the bank / branch of the foreign bank on interest rates of newly received deposits and loans, "
2. VUS (CNB) 12-12 "Monthly statement of the bank / branch of the foreign bank on interest rates of newly granted loans"; and
3. VUS (CNB) 13-12 "Monthly statement of the bank / branch of the foreign bank on interest rates of non-marketable debt securities in new business," '
4. In Article 3 (1), point (d) is deleted.
Points (e) to (h) shall be renumbered as points (d) to (g).
5. in Article 3 (1) (e), points 1 to 3 are deleted;
Points 4 to 7 shall become points 1 to 4.
6. in Article 3 (2), "(f) to (h) 'is replaced by" (e) to (g)';
7. In Paragraph 4 (1) (d), at the end of point 2, comma is replaced by "a '; at the end of point 3," a' is replaced by "a ', and point 4 is deleted.
8. in Article 5, the following point (b) is inserted after point (a):
"(b) by 20 February, according to the status as at 31 December of the preceding year, the declaration of the PLS (CNB) 10-01" Annual statement of payment by the bank / branch of the foreign bank, "'.
Points (b) to (d) shall be renumbered (c) to (e).
9. Paragraph 7 (2) is deleted.
Paragraphs 3 to 5 shall be renumbered paragraphs 2 to 4.
10.Paragraph 7 (4) reads as follows:
"(4) The statement referred to in paragraph 3 for the fourth quarter shall be submitted by 25 March of the following year. ';
11. in Article 8 (1), "(f) to (h)" is replaced by "(e) to (g)";
12. in Article 9 (1), the words "a" shall be replaced by "a" after the words "Bil (CNB)," and the words "E (CNB)," shall be inserted after the words "9-01" and the words "E (CNB), 10-01";
13. in Article 11 (1), "§ 7 (4)" is replaced by "§ 7 (3)";
14. in Article 12 (2), the words "Bil (ČNB) 9-12," and "E (ČNB) 7- 04," shall be deleted;

Specific provisions
The report referred to in Article 3 (1) (g) shall be drawn up by the bank and the branch of the foreign bank for the last time by 31 March 2015. '
16. In Annex 1, points 2, 4 to 8 and 40 are deleted.
Point 3 becomes point 2, points 9 to 39 become points 3 to 33 and points 41 to 43 become points 34 to 36.
17. In the last sentence of point 14 of Annex 1, the words "relations with clearing parties and specialised institutions for securitisation of assets' are replaced by the words" obligations towards clearing counterparties, specialised institutions for securitisation of assets and trust funds'.
18. In Annex 1, point 15, first sentence, the word "individual 'shall be inserted after the words" state'.
19. the following point 37 is added at the end of Annex 1:
"37.PLS (ČNB) 10-01" Annual statement of payment by the bank / branch of the foreign bank "
The statement shall contain information on the number and type of accounts held by the clients, the number and volume of client transactions by type of payment service in the geographical breakdown, the number and volume of payment transactions carried out on the admission facilities, the number and type of payment cards issued and the number and volume of payment transactions carried out on them, the number and volume of cash client transactions carried out on the account of the reporting bank / branch of the foreign bank or the trader. ';
Efficacy
This Decree shall enter into force on 1 January 2015.
